地方自治團體間 葛藤에 관한 硏究
Recently, various changes are taking place in our local administrative setting. Due to the rise of various administrative demand, local self-governing organizations are facing many problems for solving major problems on their own, and also the flow of administration is shifting from centralized government to the local self-governing organizations taking the initiative.
Through the new form of administration called decentralization, there is a rise in demand of residents for active and voluntary administration through participation of residents, and conflicts are continuously arising between interest related local-governing bodies in the process.
As the freedom of local governing bodies are expanded, there seems to be a tendency of sudden increase in business of processing and decision-making between self-governing bodies. And the problem of how to settle conflicts between self-governing bodies in the aspect of mutual interest is surfacing as the most important key problem of the local administration.
Especially, the conflicts which are recently occuring is appearing to have the tendency of becoming widespread, group oriented and violent and this trend is expected to appear more frequently in the future.
Although conflicts between local self-governing bodies has it positive aspects such as providing its local residents with better service, vitalization of local governing bodies' function, and promotion of mutual cooperation and understanding, If the conflict is not handled in an efficiency and rational way, it could serve as a obstacle for the interested area as well as causing inefficient administration in the national level and improvement of quality of life for its residents through the postponing of specific project or policy enforcement.
Therefore, these conflicts need to focus on the following views in order for more efficient mediation of the situation.
First of all, they must clarify the legal regulations and abide by the administrative procedure. Enactment of all policies must be based on the regulations of the law, and if the regulation is unclear or violates the procedure, conflict is bound to occur in respect to the way the regulation is interpreted.
Secondly, local governing bodies and local residents who is the interested party in the conflict must actively improve their awareness. We must all strive to share the overall view through active public announcement of administrative information and active policy participation of interested residents.
Third, the local governing body head who is the local representative and the local assembly need to actively change their awareness about problem solving. They must make effort to change their awareness and understanding of the limit of the inability to carry out a decisive policy due to an excessive voting district resident awareness when they can carry out the right to decide and execute their policy with heightened freedom and independence.
Fourth, superior organization such as central department need the willingness to control and the power of execution. The heightening of the freedom and independence of self-governing bodies following the full execution of the self-governing system, the past centralized administration organization chief's weakened regulation and control can be another conflicting factor. Therefore, we need to look for a new organizational system to reinforce the administrative and financial control of the central government within the limits of not violating the essence of self-government.
Fifth, we must reinforce the function of the administrative council between self-governing bodies and the self-governing body conflict resolution committee. We must secure the power to execute in respect to the mutual agreement involving budgets by allowing the participation of a member of the local assembly to the administrative council and reinforce the actual mediating function by granting independence to the self- governing body conflict resolution committee.
Sixth, we must reinforce the mediation role through active participation of citizen organizations and the media. The political authority and government's role has hit a dead end for dealing with conflicts in various social sectors. As an alternative, the role of the citizen organization and the media is expanding and the inevitability also tends to gradually expand as well. The media , voluntary citizen organization, and interested parties' systematic approach of participation, conflict resolution and management could also be one way to solve this problem.
