이 연구는 경찰관들의 각종 일탈행동들을 감소시키기 위한 예방책을 강구하는 것을 목적으로 한다. 경찰은 공공의 안녕과 질서유지를 위해 시민들과 가장 가까운 곳에 존재하는 법집행기관이다. 그럼에도 불구하고 뇌물수수나 공권력 남용 등과 같은 각종 일탈행위들이 끊이지 않고 발생하여 법집행기관으로서의 신뢰를 얻지 못하고 있는 형편이다. 따라서 이 연구에서는 현재의 경찰일탈 정책을 평가하고 그 효율성을 경험적으로 검증하여 경찰일탈의 감소에 기여하고자 하였다.
현재 경찰조직 내에서 부패를 비롯한 각종 일탈행동들을 통제하는 대표적인 제도는 윤리교육, 직무적성검사, 내부고발제도와 감찰 및 징계제도로 요약된다. 그러나 감찰과 징계를 제외한 나머지 제도들은 형식적 수준에서 운영되고 있어 실질적으로 경찰일탈 억제에 기여하는 바가 거의 없다. 다시 말해 경찰일탈에 대한 견제책은 감찰과 징계로 대별되는 처벌위주의 정책이다. 따라서 이 연구는 경찰에 대한 처벌정책이 실제로 경찰관의 일탈행동을 억제하는 데 효과적인지를 검증하고자 하였다. 이를 위하여 억제이론과 확대된 억제이론을 도입하여 경찰관들을 대상으로 경험적 연구를 진행하였다.
이 연구에서 주요한 독립변수는 공식적 제재와 비공식적 제재이다. 공식적 제재로는 처벌의 확실성, 엄격성, 신속성을, 비공식적 제재로는 수치심과 당혹감, 애착손실, 관여손실, 충동성을 선정하였다. 그리고 동료의식, 청탁, 재량권, 감독부재를 내용으로 하는 경찰조직․문화적 요인을 독립변수로 추가하였다. 성별이나 계급과 같은 개인적 특성을 통제하였으며, 종속변수는 세 가지 시나리오에 대한 일탈가능성으로 측정하였다.
이 연구에서 사용된 자료는 서울, 경기, 대구 등 전국 7개 지역의 경찰관들을 대상으로 실시된 588부의 설문조사자료이다. 다중회귀분석 결과, 억제이론과 확대된 억제이론에 근거하여 제시되었던 대부분의 가설들이 지지되었다. 공식적 제재 중에서는 처벌의 확실성과 엄격성이, 비공식적 제재에서는 수치심과 당혹감, 애착손실, 관여손실을 내용으로 하는 손실인지가 경찰관들의 일탈가능성에 통계적으로 유의미한 영향을 미치는 것으로 나타났다. 또한 조직․문화적 요인 중에서는 동료유대가 일탈가능성에 영향을 미치는 것으로 검증되었다. 이러한 결과는 제시된 세 가지 시나리오에서 유사하게 검증되어 경찰관들의 일탈행동을 예방하기 위해서는 공식적 제재와 비공식적 제재, 경찰의 조직․문화적 요인이 모두 고려되어야 함을 시사하였다. 연구결과에 기초하여 다음과 같은 개선방안이 제시되었다.
첫째, 경찰일탈에 대한 처벌의 확실성을 높여야 한다. 적발가능성을 높이기 위한 구체적인 방안으로는 감찰부서의 확대개편과 인력보강, 감찰인력의 전문성 제고, 내부고발제도의 활성화를 제안하였다.
둘째, 엄격한 징계제도를 일관성 있게 유지하여야 한다. 현재 경찰조직의 징계수준은 다른 조직에 비하여 높은 편이나 소청이나 행정소송 등으로 구제받는 경우가 많아 실제 처벌이 엄격한 수준으로 이루어지고 있지는 못하다. 따라서 사후구제를 제한하는 보완책 마련이 필요하다.
셋째, 윤리교육을 강화하여야 한다. 검증결과에 따르면, 비공식적 제재인 손실인지는 모든 시나리오에서 예외 없이 중요한 억제요인으로 나타났다. 따라서 경찰일탈을 예방하기 위해서는 경찰관의 윤리의식을 고취시킬 필요가 있다. 윤리의식이 강한 경찰관들은 수치심․죄책감을 더 많이 인지할 것이며 결국에는 일탈행동을 범할 가능성이 낮아질 것이기 때문이다.
넷째, 장기적으로는 조직문화 정화에 힘써야 한다. 분석결과에 따르면, 동료의식이 강하고 청탁문화의 영향을 많이 받는 경찰관일수록 재량권남용과 같은 일탈행위를 범할 가능성이 높았다. 따라서 가족주의, 빗나간 동료애, 청탁관행 등 조직내 하위문화가 개선된다면 경찰관의 일탈행위는 상당히 감소될 것으로 기대된다.
This study aims to devise preventive measures to reduce deviant behavior among police officers. The police, in order to protect the public and maintain order, are a law enforcement agency closest to citizens. Despite their intrinsic purpose, the police have engaged in all sorts of deviant behaviors including accepting bribes and abusing public power. Consequently they have failed to earn public trust as a law enforcement agency. Thus, this study set out to evaluate current countermeasures against police deviance, examine the empirical evidence of their efficacy, and contribute to the reduction of police deviance.
Prominent programs to control deviant behavior including corruption within the current police organization include ethics education, vocational aptitude test, whistleblowing, inspection and censorship, and disciplinary actions. Those systems, however, remain merely perfunctory measures that make few contributions to the actual deterrence of police deviance. All current measures of controlling police deviance are punishment-oriented policies represented by inspection and discipline. Thus, this study aimed to test the deterring effectiveness of such punishment policies. Based on Deterrence Theory and Extending Deterrence Theory, the study conducted an empirical examination of police deviance.
The primary independent variables in this study were formal and informal deterrence. Formal deterrence refers to certainty, severity, and celerity of punishment, whereas informal deterrence refers to shame, embarrassment, attachment cost, commitment cost, and impulsivity. Additionally, other independent variables are organizational and cultural factors of the police, including fellowship, solicitation, discretion, and absence of supervision. Control variables used in this study were police officers' demographic characteristics, including gender, and police officer rank and etc. Finally, the dependent variable was the likelihood of committing deviant behavior in the three proposed scenarios.
The data used in this study was gathered from a survey of 588 police officers in seven regions across the nation including, Seoul, Gyeonggi-do, Daegu, and etc. Multiple regression analyses show results supporting most of the proposed hypotheses derived from Deterrence Theory and Extending Deterrence Theory. Among formal deterrence variables, certainty and severity of punishment show statistically significant effects on the possibility of police deviance. For informal deterrence variables, the shame, embarrassment, attachment, and commitment also showed a statistically signifiant impact. Of the organizational and cultural factors, fellowship affected the possibility of deviance. These findings, consistent in all the three proposed scenarios, imply that all of the deterrence factors, both formal and informal, as well as organizational and cultural factors should be considered in order to prevent police deviance. Based on the results, the following improvement measures were suggested:
First, it is necessary to increase the certainty of punishment for police deviance. Specific measures to increase the possibility of detection are expanding the inspection department, adding more manpower, increasing the professionalism of inspection personnel, and encouraging whistleblowing.
Secondly, strict disciplinary action should be consistently applied. Although the police organization currently enforces its disciplinary decisions on a more consistent basis than other organizations, many guilty officers are ultimately shielded from punishment through leniency requests or administrative suits. As a result, it is necessary to restrict the availability of such relief after disciplinary decisions are made.
Thirdly, ethics education should be reinforced. According to the research findings, informal deterrence factors were an important control factor in all the scenarios. Therefore, the promotion of ethical consciousness is necessary to prevent police deviance. Those who are well-armed with a strong ethical consciousness that recognizes shame and guilt, will be less likely to commit deviant behaviors.
Finally, the police should work on the purification of their organizational culture in the long term. According to the analysis results, those who have strong fellowship and who are influenced by solicitation culture are more likely to be at risk of committing deviant behaviors including abuse of discretion. Thus, deviant behaviors within the organization should decrease considerably upon the improvement of subcultures such as familism, wrong fellowship, and customary solicitation.
