로마 공화정 초기의 정치적·헌정적 역사에서 아주 중요한 전환점을 차지하는 리키니우스-섹스티우스 법은 전혀 다른 평가를 받고 있다. 하나는 평민의 승리이며, 다른 하나는 신귀족의 승리 또는 평민의 실패다. 본 논문의 목적은 법의 배경과 영향을 검토함으로써, 기존 평가들의 문제점을 보여주는 동시에 법의 성격과 의미를 재평가하는 것이다.
사건의 발단은 기원전 4세기 초 로마가 단행했던 정부 조직의 개편이었다. 하지만 새로운 행정 개혁은 그동안 정치참여를 거의 법적으로만 허용받았던 부유한 평민을 철저하게 배제하였다. 두 호민관이 원했던 것은 콘술직의 부활이 아니라 귀족이 부활하려 했던 콘술직의 한자리를 평민에게 허용하는 것이었다. 자신들의 요구를 관철할 수 없었던 평민지도자들은 일반 대중의 지지를 얻고자 ‘귀족과 부유한 평민의 투쟁’이 아닌 ‘귀족과 평민의 투쟁’, 즉 ‘신분 투쟁’이라는 정치적 프레임을 다시 이용했다. 그들은 토지와 부채 문제를 부각함으로써, 콘술직의 부활과 관련된 정치적 갈등에 무관심했던 평민 대중을 끌어들이는 데 성공하였다. 귀족이 주도한 행정 개혁에 대한 부유한 평민의 반발로 제출되었던 법안이 일반 평민의 집단적 지지로 통과되었다는 사실은 두 호민관의 법을 이해하는 준거틀로 ‘신분 투쟁’이 여전히 유효함을 입증한다.
부유한 평민의 정치참여를 법적으로 한 번 더 허용한 리키니우스-섹스티우스 법은 온건한 귀족과 부유하고 야심적인 평민으로 구성된 과두주의적인 신귀족을 형성하고 이 새로운 계층의 중심체로서 원로원이 성장하는 데 분명 중요한 역할을 담당했다. 하지만 신귀족의 형성만을 강조하는 주장은 법의 통과에서 결정적인 역할을 한 일반 평민의 정치적 영향력을 간과하였다. 귀족과 평민의 권력 공유의 원칙을 선언하였을 뿐만 아니라 지도자와 지지자 간의 정치적 소통의 중요성을 재확인함으로써, 리키니우스-섹스티우스 법은 원로원뿐만 아니라 평민회가 로마 공화정의 중요 의사 결정 기구로 성장하는 기틀을 제시했다.
The Licinian-Sextian laws have been generally regarded as such a landmark in the political and constitutional history of the early Roman Republic. One takes them as a plebeian victory, while the other takes them as a victory of the patrician-plebeian nobility, namely a failure of the plebeians. This paper aims to reappraise the nature and historical significance of these laws as well as to show the problems of the existing opinions by re-examining their backgrounds and influences.
The beginning of the event in question was related to the administrative reorganization of the government carried out by Rome in the early 4th century BCE. The new administrative reform thoroughly excluded the wealthy plebeians, to whom political participation had only been legally allowed. It should be remembered that what the two plebeian tribunes wanted was not a revival of the consulships, but a place for the plebeians among the consulships that the nobles tried to revive. The wealthy plebeians, unable to carry their points, again framed their argument as a struggle between the patricians and the plebeians, that is, a ‘Struggle of the Orders’, rather than a struggle between the patricians and the wealthy plebeians to gain the support of the ordinary plebeians. By highlighting the land and debt problems, they succeeded in attracting the participation of the common people, who had been indifferent to the political conflicts over the restoration of the consulship. The fact that the legislation, which was introduced as a protest from the wealthy plebeians against the patrician-led administrative reform, was passed through the collective support of the common people, proves that the ‘Struggle of the Orders’ is still valid as a framework for understanding the laws of the two tribunes.
The Licinian-Sextian laws, which once again legally permitted the political participation of the wealthy plebeians, certainly contributed both to the formation of an oligarchic nobility made up of the moderate patricians and the wealthy and ambitious plebeians, and to the growth of the senate as an important institution of this new class. However, arguments that have emphasized only the formation of the patrician-plebeian nobility have overlooked the political influence of the ordinary plebeians who played a decisive role in the passage of the laws. By not only declaring the principle of power sharing between the patricians and the plebeians, but also reaffirming the importance of political communication between leaders and supporters, the Licinian-Sextian laws served to show the future direction for the plebeian assembly as well as the senate to grow into the important decision-making bodies of the Roman Republic that they became.
