경찰활동과 인권보호의 상관성에 대한 연구 = A Study on Human Right Protection during Policing of Police

국문 초록 (Abstract)

이 글은 경찰활동의 목적과 근거는 인권보호와 침해방지임을 확인하는 것이다. 지금까지 오류인 경찰의 권능이공공성과 치안질서유지라고 명명되고 있지만 실천적으로는 인권보호다. 개인의 집합이 집단과 국가를 구성하지 국가의 부분이 개인이 아니라는 것이다. 이를 위해 국가의 원리인 공공성, 법치주의, 그리고 민주주의의 보편성과 특수성, 이에 관련된 경로와 결과적인 특성들을 확인한다. 민주화 이후 한국사회는 국가지배의 일원주의보다는 거버넌스와 다원주의적인 구성원리가 개입되고 논의가 되고 있다. 그러한 논의의 배경에는 민주주의는 인권을 위한 불안전한 지배체제를 보다 완전한 합의와 협의체를 만들기 위한 노력이라 할 수 있다. 이를 위해 먼저 「경찰법」과 「경찰관직무집행법」이 「헌법10조」를 넘어서는 수권규정 인가를 밝히고 표현의 자유를 억압하는 국가주의하의 경찰권의 범위와 한계를 밝힐 것이다. 다음으로는 「집회및시위에관한법률」이 갖는 반인권적이고 반민주적인 치명적인 오류와 한계를 분석함으로써 경찰권은 특정집단과 정치세력을 위한 기구가 아니라 보편적인 인권을 위한 중립적이고 공평한 공적서비스를 제공해야 하는 의무체임을 확인하고자 한다. 경찰은 기득권이나 단지 지금 형성된 인위적 질서만을 위해서 존재해서는 안 된다. 동일하게 경찰작용은 개입과 중지가 보편적인 인권법칙에 의해서 작동되어야 한다. 이는 국가기구가 사적인 영역과 공적인 영역이 보다 조화와 균형을 만들어가는 것이 정치가 갖는 목표인 ‘행복’을 위한 보조적인 제도나 기구여야 함이다.

다국어 초록 (Multilingual Abstract)

This study aims to confirm that the justification for and the objective of police activities are the to protect, and to prevent infringement of, human rights. After liberation, it has been suggested that the objective of Korean police activities and duties are maintenance of social order and public interest, but this study takes the stance that the ultimate source of police function is human rights protection. After democratization, the Korean society no longer depends on Unitarism based on state leadership, but rather operates on the basis of governance and diversity. This is a process of democracy to transform an incomplete social community into a complete, consensus-based society through human rights. At the same time it confirms that organizations and the state is conglomeration of individuals, rather than individuals being parts of the whole. State does not exist for public interest or rule of law, but it is a minimum and maximum mechanism for human rights and self-governance. To achieve aforementioned objective, the paper first argues that [Police Law] and [Duty police officers direct Practices Act] should never override [Article 10 of Korean Constitution]. Regarding the two laws, it will be shown that a nationalistic police operates to suppress freedom of expression. Further, from an analysis of [Assembly and Demonstration Act] the paper finds anti-human rights and anti-democratic fallacies and errors to ultimately posit that police is not a tool for specific organizations or political factions, but an obligatory body which should provide neutral and fair public service for universal human rights. Police should not exist for vested interests nor for established social order. There are regulations for human rights should be keep in the process of public sphere(and sectors) activity, but many censures have happened for human rights violations. It should overcome all those to operate on the sole basis of universal human rights. These suggestions are based upon the concept that police activity to prevent danger and to maintain safety of the public should distinguished from the police activity for criminal investigation. Their basic rights to be treated with compassion and respect; to be informed of their role on the proceedings and of the disposition of cases; to have their views represented and considered. Especially, In this paper, I emphasized human rights of police officers. At present, police officers have a status of the subject of human rights invasion. But, as a conception of human rights is enlarged, police officers also can be a object of human rights invasion.
