본 연구는 해방 후 여성관련 법제들이 제정되는 과정이 축첩제 폐지운동과 어떠한 연관이 있는가를 추적한다. 기존의 한국 여성운동관련 연구들은 상대적으로 축첩제 폐지운동에는 덜 주목하였을 뿐만 아니라 해방 후 동시다발적으로 제기되었던 축첩제 폐지운동, 공창제 폐지운동, 인신매매금지운동 간의 연관성에도 주목하지 않았다. 아마도 이것은 보다 쉽게 폐지된 인신 매매금지와 좌우합작운동으로 이루어진 공창제 폐지운동에 비해 축첩제 폐지운동은 성과도 덜 가시적이었을 뿐만 아니라 축첩이 가족의 형태로 오래도록 지속되었기 때문이라고 생각된다. 이러한 기존의 연구는 해방 후 가장 활발하였던 여성운동의 이슈인 가족법개정운동이 일어나게 된 배경에 대한 설명을 할 수 없을 뿐만 아니라 1980년대 이후 이른바 ‘진보적’ 여성운동과 그 이전 세대와의 단절을 설명할 수 없다.
‘축첩’의 문제는 미군정 이후 제1공화국의 제헌의회까지 끈질기게 여성계의 요구로 제기되면서 법제정과정에서 다양하게 논의되었던 것으로 앞에 제기한 의문들을 살피는데 중요한 지점이 된다. 즉 첩의 문제는 해방 후 문명세계의 일원으로 규정하여야 할 혼인의 형태의 문제이자 기존의 가족의 문제를 재구성하도록 요구하였던 것이다. 그뿐만 아니라 국가가 가족의 문제에 어떻게 개입할 것인가에 대한 당시 사회적 인식을 엿볼 수 있게 한다. 이처럼 법제화 과정은 당시의 사회적 인식과 이에 대한 반발과 교정으로서의 운동 그리고 이에 대한 결과로써의 법제정을 살핌으로써 당시의 국가와 사회의 구성에 대한 역동적인 재구성을 가능하게 한다. 축첩을 둘러싼 법제화는 헌법상으로는 ‘혼인의 순결’ 조항을 삽입하는 한편, 「형법」에서는 간통쌍벌주의로 분화되었고 신민법 제정과정에서 혼외자의 출생신고의 문제로 드러났다. 하지만 해방이후 축첩의 문제를 둘러싸고 이루어진 운동과 담론 속에서 여성의 지위는 진정으로 남성과 같은 수준으로 다루어진 적이 없으며 이후의 더 지난한 가족법개정운동과 더불어 정치, 사회, 경제, 문화의 영역을 가로지르는 여성들의 목소리와 문제제기가 등장할 때까지 기다려야 했다.
This study focuses on the women’s objection to concubine, an issue from the 1920s, and the discourse on formulation a new law against it after liberation in Korea. After common-law marriage was changed to civil marriage, the status of wife and concubine became unstable. In the name of love, marriage through free love and divorce became crucial. Therefore, stress was gradually laid upon partners remaining chaste, and doing so was considered an indicator to measure gender equality. To keep a concubine in addition to a wife was considered to violate the institution of marriage and was considered a feudal or corrupt practice from a man. In this situation, women pushed two agendas after liberation. The first was for the new constitution to prescribe the“chastity of marriage” and to prohibit keeping a concubine. The second was to establish legislation for banning men who already had a concubine from working as a government employee. Article 20 on the “chastity of marriage” was accepted without much resistance; however, the potential prohibition on government employees faced fierce objections. This may have been because this prohibition would result in individual and familial problems for men. As a result, this prohibition was rejected by a vote of 83 against to 53. Shortly after this vote was defeated, women began demonstrating in its favor, and women’s organizations forced President Lee to legislate for the abolition of concubine. As the Korean war broke out immediately after this period, women’s movement against concubines cooled down, and objections and criticisms subsided owing to the strong anticommunist sentiment after the war. Although many punishments were imposed for keeping a concubine, they were very light and applied only sparingly. They seemed no more than a formality to soothe the public opinion. Furthermore, expressions like democracy, gender equality, and antidiscrimination that women had demanded and that were prescribed under the Constitution were not included in the new criminal law and civil law. At this time, lawmakers were given to conservative thinking and to maintaining old customs in society. Whereas women considered concubines to be a public problem linked to licensed prostitution and human trafficking, men considered it a private problem. These attitudes resulted in society being divided sexually. As long as there existed a division between “good” and “bad” women, women remained trapped in the image imposed by society. Women’s status was not dealt with in the same manner as that of men in the discourse and movement, and the demand of gender equality that women hoped would be enshrined in the Constitution emerged through the reform in family law, thus ultimately gaining acceptance in the areas of politics, society, economy, and culture.
