임신중지 상담체계 구축의 방향 -성과 재생산 건강권의 관점에서- = Building Abortion Counseling Services for Sexual and Reproductive Health and Rights in Korea

2019년 헌법재판소의 낙태죄 헌법불합치 결정에 따라 임신중지 보건의료전달체계에 대한 모자보건법 개정안들이 발의되었음에도 불구하고 2023년 현재까지도 여전히 소관위원회 검토단계에 머물러 있을 뿐 법개정을 위한 논의는 중단된 상태이다. 입법불비 상황에서도 정부는 임신중지 관련 상담 및 정보제공 체계를 마련하기 위한 제도적 정비를 정부가 제출한 모자보건법 개정법률안의 방향에 따라 추진하고 있으나 정부안을 비롯한 모자보건법 개정안에서의 상담 및 정보제공에 대한 논의는 제대로 진행된 바 없다. 이에 임신중지와 관련된 보건의료체계의 구축을 논의함에 있어 우선적으로 추진되고 있는 상담 및 정보제공을 위한 체계에 대한 방향성과 규정방식에 대해 상세히 검토할 필요가 있다.
임신중지 관련 상담 및 정보제공에 대한 모자보건법 개정안들에서는 다음과 같은 세 가지 입법상의 쟁점이 제기된다. 첫째, 여성에게 임신중지 이전 상담의무를 부여할지에 관한 것이다. 상담 의무화에 대한 판단은 임신중지 상담체계의 목적, 상담의 의미와 역할에 대한 고민과 함께 진행되어야 한다. 둘째, 임신중지 이전 상담기관에서의 상담과 시술의사의 정보제공의 관계 설정에 관한 것이다. 여기에서는 상담과 정보제공의 의미와 역할, 그에 따른 정보제공의 내용에 대한 검토가 필요하다. 셋째, 임신⋅출산 등 재생산 건강을 포괄하는 상담⋅지원 전달체계의 구성에 대한 고민이다. 모자보건법이 임신⋅출산 등 재생산 건강과 관련된 보건정책을 총괄하는 법률이라는 점에서, 중앙 및 지역 내 상담⋅지원기구의 역할과 업무 범위는 결국 모자보건법의 목적과 취지, 방향설정과 연관되어 있다.
세게보건기구가 권고하고 있는 임신중지 관련 보건의료정책의 방향은 국제인권법상 성과 재생산 건강권의 관점에 기초하고 있으며, 이에 따라 모든 임산부들이 연령이나 상황에 관계없이 포괄적인 지식과 정보를 제공받음으로써 어떠한 압력 없이 자유로운 결정을 내릴 수 있도록 지원하기 위해 상담과 정보제공이 이루어져야 한다는 원칙이 제시된다. 그러나 이러한 원칙과 방향성은 임신중지에 대한 상담과 정보제공을 의무화하거나 의무적 숙려기간을 두고 있는 해외 국가들에서는 제한되고 있는데, 상담 의무를 부과하고 있는 경우에 임신중지를 위한 형식화된 상담이 주가 되는 경향이 나타나며. 의사의 정보제공 의무화 역시 의무적 숙려기간과 함께 부과되어 임신중지 의료서비스 접근성을 저해한다는 우려가 제기된다. 이에 따라 최근 개정된 해외 법률들은 의무적 상담이나 숙려기간을 폐지하거나 정보제공에 있어 여성의 선택을 보장하는 방향으로 마련되고 있다.
우리의 모자보건법이 재생산 건강 관련 보건의료정책 전반을 담당하고 있음에도 불구하고 인구정책의 관점에서 재생산 건강을 다루어왔던 과거의 방향을 여전히 유지하고 있으나, 낙태죄에 대한 헌법불합치 결정 이후 임신중지를 성과 재생산 건강의 한 축으로 포함함으로써 재생산에 대한 개인의 자기결정권을 존중해야 한다는 점을 고려할 때 모자보건정책의 방향이 성과 재생산 건강권의 관점에서 전면적으로 변화해야 한다는 점은 분명하다. 이에 따라 임신중지를 포함한 재생산 건강과 관련된 상담은 필요한 사람들에게 자율적으로 제공되어야 하며 편견 없이 중립적인 방식으로 진행될 수 있는 원칙들이 보완될 필요가...
In 2019, following the Constitutional Court's decision on the unconstitutionality of abortion, amendments to the Maternal and Child Health Act were proposed for the healthcare delivery system for termination of pregnancy, but as of 2023, they are still in the subcommittee review stage and discussions on amending the law have been suspended. Even in the absence of legislation, the government has been promoting institutional maintenance to establish a system for counseling and information provision related to pregnancy termination under the direction of the government's proposed amendment to the Maternal and Child Health Act, but the discussion on counseling and information provision in the government's proposed amendment to the Maternal and Child Health Act has not been properly conducted. Therefore, when discussing the establishment of a healthcare system related to pregnancy termination, it is necessary to examine in detail the direction and regulation method of the system for counseling and information provision, which is being promoted as a priority.
The proposed amendments to the Maternal and Child Health Act on counseling and information on termination of pregnancy raise the following three legislative issues. First, there is the issue of whether women should be obligated to consult before terminating a pregnancy. The decision on mandatory counseling should be made in conjunction with consideration of the purpose of the abortion counseling system and the meaning and role of counseling. Second, the relationship between counseling at pre-abortion counseling centers and the provision of information by doctors. Here, it is necessary to review the meaning and role of counseling and information provision, and the contents of information provision accordingly. Third, we need to consider the organization of a counseling and support delivery system that encompasses reproductive health, including pregnancy and childbirth. Given that the Maternal and Child Health Act is a law that oversees health policies related to reproductive health, including pregnancy and childbirth, the role and scope of work of central and local counseling and support organizations are ultimately related to the purpose, intent, and direction of the Maternal and Child Health Act.
The direction of health care policies related to termination of pregnancy recommended by the World Health Organization is based on the perspective of sexual and reproductive health rights under international human rights law, and the principle that counseling and information provision should be provided to all pregnant women, regardless of their age or situation, in order to provide comprehensive knowledge and information to support them in making free decisions without any pressure. However, these principles and directions are limited in countries that mandate counseling and information on termination of pregnancy or have mandatory reflection periods, and where counseling is mandated, it tends to be formalized counseling on termination of pregnancy. Mandatory information provision by physicians is also imposed in conjunction with mandatory reflection periods, which raises concerns that it hinders access to medical care for termination of pregnancy. In response, recent amendments to international laws have been designed to eliminate mandatory counseling and deliberation periods or to ensure women's choice in the provision of information.
Despite the fact that the Korean Maternal and Child Health Act is in charge of the overall healthcare policy related to reproductive health, it still maintains the past direction of dealing with reproductive health from the perspective of population policy, but it is clear that the direction of maternal and child health policy must be completely changed from the perspective of sexual and reproductive health rights, considering that the decision on the unconstitutionality of abortion requires respect for the individual's right to self-determin...
