인도헌법은 세계 여러나라의 헌법을 모방한 것이다. 지난 60년을 헌정의 중단 없이 헌법을 운영해오면서 인도헌법은 외국과 다른 매우 독특한 점들을 보유하게 되었다. 그 중의 하나가 헌법개정에 관한 것이다. 인도헌법은 사실상 연성에 가까운 헌법이다. 전체적으로 미국이나 스위스, 오스트레일리아, 대한민국에 비교해볼 때도 헌법개정이 그렇게 어렵지 않다. 많은 헌법조항들은 법률개정과 마찬가지로 의회의 단순다수결로써 개정할 수 있다.
헌법 제368조는 의회로 하여금 일정한 절차를 거치면 헌법의 어떤 규정도 개정할 수 있도록 하였다. 개헌발의는 양원 중 어느 한 원이 할 수 있고, 각 원의 전체의원 과반수의 참석과, 투표자의 3분의 2 이상의 찬성을 얻은 경우에 개헌법안으로 확정된다. 다만 일부 규정에 대한 개헌을 위해서는 각 주의 의회들이 발효에 대한 결의를 하는 방식으로써 전체 주의 과반수의 의회에서 비준을 받아야만 한다. 이 경우조차도 미국 헌법의 개정이 전체 주의 4분의 3의 동의가 필요한 것과 대비된다. 이렇듯 인도헌법의 개정은 매우 연성적이라는 것을 알 수 있다.
그러나 제368조에 의한 개헌은 의회와 대법원 사이에 권한충돌을 초래하였다. 의회는 무엇이든지 개헌할 수 있고, 이에 관한 사법심사는 할 수 없다는 규정까지 헌법에 두었다. 하지만 대법원은 사건 심사과정에서 이러한 개헌규정을 헌법의 핵심사항(기본구조)을 위반한 것이라 해서 해당 개헌법을 무효로 선언하였다. 한편으로는 대법원의 보수성을 타파하기 위해 의회가 의욕적인 헌법개정을 한 측면이 있는 반면, 의회가 다수당의 횡포로 헌법의 핵심사항에 관한 개정까지 나아가는 것에 대한 대법원의 견제가 있었던 것으로 이해할 수 있다. 이런 시행착오과정 속에서 인도헌법은 현대적 입헌국가로 성숙해가고 있는 것을 볼 수 있다.
The Constitution of India is made up of contents imported from many countries which had already their own characteristically developed constitution. Indian Constitution as a result is usually called, rather cynically, a ‘mosaic Constitution’ or a ‘beautiful patchwork’.
But nowadays Indian Constitution has come to a stage where we can appreciate that it has achieved a few characteristics distinct from the Constitutions of many other countries after over 60 years of Indian democratic, constitutional experience. One of them is a way of Constitutional Amendment. Indian Constitution is close to the ‘flexible’ constitution although it is classified as a ‘rigid’ one. Lots of articles of the Constitution can be changed as easily as ordinary acts by the simple majority in the Parliament.
However Art. 368 empowers the Parliament to change whatever in the Constitution just in accordance with the procedure laid down in this article. An Amendment of this Constitution may be initiated only by the introduction of a bill is passed in each House by a majority of the total membership of that House and by a majority of not less than two-thirds of the members of that House present and voting, Above all, when some special articles are sought to make any change, the amendment shall also require to be ratified by the Legislature of not less than one-half of the states by resolutions to that effect passed by those Legislatures before the bill making provision for such amendment is presented to the President for assent. Even in this case, we can see that Indian Constitution is rather easier in amendment than the USA Constitution which requires more than the ratification of two-thirds of the whole states.
But on the other hand, the Amendment based on the Art. 368 brought about the conflicts between the Parliamen and the Supreme Court. Forty-second Amendment Act, 1976 inserted the section (4) “No amendment of this Constitution made or purporting to have been made under this article shall be called in question in any court on any ground”. As Art. 368 made the Parliament almost omnipotent in the Constitutional changes, the Supreme Court began to take tough position in great reaction against it. The Supreme Court declared that there are Constitutional basic features or basic structure which are the limits of the Constitutional amendment, therefore the Parliament cannot override it even though empowered by the Art. 368. Conservativeness of the Supreme Court is overwhelmed by the Parliament which is active for the social justice. However, the Parliament is again checked by the Court because of its abuse of power. Through trial and error, the relation of the Parliament and the Supreme Court has been brought on balance, and the Indian Constitution, in the mean while, has grown up enough to show off its ripeness.
