소비자원의 법적 성격과 시료수거권에 관한 고찰 = A Study on the Legal Characteristic and Authority to Collect sample of Korea Consumer Agency

국문 초록 (Abstract)

본 논문은 소비자권익 증진시책의 효과적인 추진을 위하여 「소비자기본법」에 따라 설립되어 기능을 수행하고 있는 소비자원의 법적 성격을 살펴본다. 이를 위한 전제로서 공법인의 개념과 사법인과의 구별기준에 대한 기존의 학설과 판례를 조사 및 분석하여 소비자원이 공법인지를 분석할 기준을 도출한다. 그리고 「소비자기본법」상 소비자원에 부여된 시료수거권의 의미와 특성을 살펴보고 법제상 문제점과 개선방안을 제시한다. 본 논문은 소비자원이라는 특정 사례를 통하여 공법인의 개념과 사법인과의 구별기준에 대한 기존의 논의를 정리하고 공법인에 대한 법제상 유용한 개념과 구별기준을 제시하고자 한다. 동시에 소비자원의 시료수거권이 가지는 법제상 문제를 통해 공법인의 권한에 관한 입법적 문제와 개선방안을 제안한다.
이러한 논문 목적을 위해 2장은 공법인의 개념과 사법인과의 구별기준에 대한 기존의 학설과 판례를 조사하고 분석한다. 그리고 학설과 판례에 대한 비판적 검토를 통하여 본 연구목적을 위한 개념과 구별기준을 도출하고, 공법인의 분류에 대한 기존의 학설을 검토한다. 3장은 2장에서 도출한 결론을 소비자원에 적용하여 소비자원의 법적 성격을 분석한다. 이를 위하여 「소비자기본법」상 소비자원의 설립과 운영 및 주요 권한을 살펴본다. 또한, 관계 법률인 「공공기관운영법」상 소비자원의 위상을 살펴보고 이러한 법령상 규정을 토대로 소비자원의 공법인 여부 및 그 종류를 분석한다. 4장에서는 현행 「소비자기본법」상 소비자원의 시료수거권의 의미와 법적 성격 대하여 조사하고 이의 법제적 문제를 검토한다. 특히 소비자원과 유사한 법적 위상을 가지는 다른 기관의 행정조사권과 비교하여 문제를 도출하고 법제적 개정방안을 제안한다. 5장은 이상의 논의를 정리하고 연구의 결론을 제시한다.

다국어 초록 (Multilingual Abstract)

This thesis examines the legal nature of the Korea Consumer Agency(hereinafter 'KCA'), which was established under the 「Framework Act on Consumers」 to effectively promote consumer rights and interests promotion policies. As a premise for this, the existing theories and precedents on the concept of public Legal entity and the criteria for distinguishing it from private legal entity are investigated and analyzed to derive the criteria for analyzing whether the KCA is a public legal entity. In addition, the meaning and characteristics of the authority to collect samples granted to the KCA under the 「Framework Act on Consumers」 are reviewed, and legal problems and improvement plans are presented. This paper aims to organize the existing discussions on the concept of public legal entity and the criteria for distinguishing them from private legal entity through a specific case of the KCA, and to present useful concepts and criteria for distinguishing public legal entity in the legal system.
At the same time, it proposes legislative issues and improvement plans regarding the authority of public legal entity through legal issues with the KCA's authority to collect samples. For the purpose of this thesis, Chapter 2 examines and analyzes existing theories and precedents on the concept of a public legal entity and the criteria for distinguishing it from private legal entity. In addition, through a critical review of theories and precedents, concepts and distinction standards for the purpose of this study are derived, and existing theories on the classification of public legal entity are reviewed.
Chapter 3 analyzes the legal nature of the KCA by applying the conclusions drawn in Chapter 2. To this end, the establishment and operation of the KCA and its major authorities under the 「Framework Act on Consumers」 will be reviewed. In addition, the status of the KCA under the related law 「Act on the Management of public institutions」 is reviewed, and based on these laws and regulations, whether or not the KCA is a public Legal entity and its type is analyzed.
Chapter 4 investigates the meaning and legal nature of the KCA's authority to collect samples under the current 「Framework Act on Consumers」, and reviews its legal issues. In particular, by comparing the administrative investigation authority of other public establishments with similar legal status to the KCA, problems are drawn and legislative amendments are proposed. Chapter 5 summarizes the above discussion and presents the conclusion of the study.
