법률이 정한 부동산의 등기사항을 공시하는 부동산등기제도는 중요한 재산권의 하나인 부동산의 거래 활성화와 안전을 보장하는 기능을 수행한다. 외국의 상업등기제도와 마찬가지로 외국의 부동산등기제도도 경제활동과 밀접한 관련이 있기 때문에, 베트남·라오스·몽골의 부동산등기제도에 관한 연구는 현지 부동산에 투자하는 우리 국민의 재산권을 보호하는 데 도움을 준다. 2020년에 사법정책연구원이 발간한 베트남·캄보디아·라오스의 상업등기제도에 관한 연구보고서의 후속 연구에 해당하는 베트남·라오스·몽골의 부동산등기제도에 관한 연구보고서는 연구과제의 다양화 방안으로 제안된 ‘유사한 주제 간 시리즈물’에 해당하며, 우리나라와 베트남·라오스·몽골과의 부동산등기제도의 이해 및 발전에 도움을 주고, 양국 간 국제 사법교류의 디딤돌이 될 뿐만 아니라, 부동산등기제도 지원의 방법론과 시사점을 찾기 위한 기초자료를 확보하게 한다. 베트남·라오스·몽골의 부동산등기제도와 관련된 주요 내용은 다음과 같다. 등기부와 대장이 일원화된 제도를 취하고 있는 베트남과 라오스의 부동산등기제도를 통해, 등기부와 대장의 일원화제도가 등기의 효율성·신속성·정확성을 보장할 수 없음을 확인할 수 있었다. 또 우리나라의 경우 누구나 수수료를 내면 부동산등기기록을 열람할 수 있는 반면, 베트남·라오스·몽골에서는 열람이 상당히 제한된다는 사실도 알 수 있었다. 우리나라와 달리 베트남·라오스·몽골 세 나라는 등기사항증명서와 등기필정보를 사용하지 않고, 등기 권리증제도를 운영한다. 사회주의 체제를 유지하고 있는 베트남과 라오스의 경우 개인의 토지소유권을 인정하지 않지만, 사회주의 체제에서 민주주의 체제로 전환된 몽골은 개인의 토지소유권을 일부 인정하여 그에 관한 토지소유권등기를 경료할 수 있다. 이러한 몽골 부동산등기제도의 특수성은 우리나라의 통일 후 발생할 부동산등기제도의 문제점을 해결할 수 있는 방안이 될 수 있다. 베트남·몽골과 달리 라오스에는 건물등기제도가 별도로 없다. 토지사용권과 관련하여 라오스의 경우 종래에는 외국인이 콘도미니엄(Condominium)의 건설용지등기를 할 수 없었으나, 2019년 토지법의 개정으로 50년을 한도로 외국인 명의의 ‘콘도미니엄 용지’ 등기가 가능해졌다. 베트남과 라오스의 경우 토지와 건물을 분리하여 등기할 수 없으나, 몽골의 경우 예외적으로 공동체주택의 구분소유자는 전유부분을 단독으로 등기할 권리를 가진다. 대법원 법원공무원교육원은 「2023년도 KOICA 정부부처 제안사업」에 ODA 지원이 적합한 개발도상국을 대상으로 한 사업제안서를 제출하여 등기제도에 관한 국제연수사업을 추진하고 있다. 하지만 일본이 자본금이 80조가 넘는 JICA(Japan International Cooperation Agency)를 필두로 법무성, 외무성 등과 함께 개발도상국의 등기제도에 대해 적극적으로 연구, 교류하고 있는 것에 비하면, 그 규모가 너무 미미하여 개발도상국에 대한 등기제도의 지원 및 교류의 규모 확대가 강력히 요청된다. 이미 한국은 유엔무역개발회의(UNCTAD)에서 만장일치로 선진국으로 변경되었다. UNCTAD가 1964년 설립된 이래 개발도상국에서 선진국으로 지위가 변경된 국가는 한국이 처음이다. 한류 열풍을 통해 알 수 있듯, 한국은 이제 경제뿐만 아니라 여러 분야에서 선진국의 일원이 되고 있다. 등기제도 분야도 예외일 수 없다. 선진화된 등기법제와 등기시스템을 통해 개발도상국을 적극 지원하고, 체계적이면서도 전문적인 방법으로 다양한 등기제도 상호교류를 수행하고, 외국 현지를 방문하여 비교법적으로 그 곳의 등기실무를 깊이 있게 연구한다면 미래의 한국 등기제도도 분명 전 세계를 선도할 것이다. 아무쪼록 본 연구가 우리나라와 베트남·라오스·몽골과의 등기제도 상호교류에 도움이 되고, 나아가 그 외 더 많은 국가와의 등기제도 상호교류 확대 및 비교법적 연구로 이어지는 모퉁이의 머릿돌이 되길 기대한다.
더보기The real estate registration system is a recording system that aims to publicly announce the registration matters of real estate as prescribed by the relevant laws. This system performs the function of promoting active transactions of real estate, which is one of the important property rights, and ensuring the safety of transactions. The real estate registration systems of foreign countries have as much to do with their economic activities as their commercial registration systems do. This study on the real estate registration systems of Vietnam, Laos and Mongolia is conducive to the protection of property rights of Korean people who invest in real estate located in those countries. Following the “Study on the Commercial Registration Systems of Vietnam⋅Cambodia⋅ Laos” by the Judicial Policy Research Institute in 2020, this study on the real estate registration systems of Vietnam, Laos and Mongolia falls into the “series on similar themes” proposed as a way of diversifying research projects. This study is instrumental in understanding the registration systems of real estate in Korea, Vietnam, Laos, and Mongolia and improving these systems, serving as stepping stones for bilateral judicial exchanges among these countries as well as securing basic materials on the methodologies and implications of supporting the real estate registration systems. The main contents of the real estate registration systems of Vietnam, Laos and Mongolia are as follows. Through a review of the real estate registration systems of Vietnam and Laos,where the register and ledger are unified, it was found that the unifying system of the register and the ledger could not guarantee the efficiency, swiftness, and accuracy of the registration. In addition, anyone in Korea can peruse registration record by paying fees, whereas in Vietnam, Laos, and Mongolia, access to registration record is considerably limited. Unlike Korea, which uses a certificate of registered matters and information on the completion of registration, the three countries have systems that use Land title. Because Vietnam and Laos are clinging to the socialist system, land ownership is not acknowledged. In contrast, former socialist Mongolia partially recognizes land ownership of individuals after the transition to democracy, enabling procedural completion of land ownership registration. Such specificity of the Mongolian registration system of real estate can be a candidate for solving potential problems in our registration system of real estate after Korean reunification. Laos does not have a separate registration system of buildings as opposed to Vietnam and Mongolia. Concerning the right to the use of land, foreigners in Laos used to be prohibited from the registration of building sites for condominiums. But with the revision of the Land Law in 2019, it became possible to register “sites for condominiums” in the name of foreigners for a maximum of 50 years. Land cannot be alienated from a building when making registration in Vietnam and Laos. On the other hand, community housing in Mongolia is exceptional in that the owners of such sectioned buildings have the right to register their exclusive possessions. The Court Officials Training Institute of the Supreme Court of Korea is pushing ahead with international training projects on the registration systems, submitting project proposals targeting developing countries which are apt beneficiaries of official development assistance (ODA) as “the 2023 KOICA Projects Proposed by the Government Departments.” However, Japan actively pursues research and exchanges regarding the registration systems of developing countries, with the Japan International Cooperation Agency (JICA) having capital exceeding 8 trillion yen as the head of such efforts in collaboration with Japan’s Ministries of Justice and Foreign Affairs. …
