太極旗의 制定背景과 法哲學的 意義 및 南北韓 統一國旗 制定案 小考 : 國旗에 관한 比較憲法的 考察과 관련하여 with the viewpoint of the comparative constitutional law about the national flag = A Study of the Bakcground, Legal Philosophical Significance of the Taeguk Flag and the Establishment of the South-North Unification Flag

다국어 초록 (Multilingual Abstract)

This paper are mainly concerned about the history of the Taeguk flag-Korean national flag-and its phylosophical significance.
And then we try to make out a symbol of the South-North Unification flag which represents the whole Korean peninsula in case of the south-north reunification.
In addition, this thesis points out the need that the stipulation of the national flag should be manifested in our constitutional law as in most other countries.
After the Taeguk flag was used for the first time by Young-Hyo pack who was dispatched to Japan as a Korean envoy in August 1882 under the treaty of Chemulpo, it came to be our national flag officially on February 4,1883,by King Kojong's royal announcement and was used if necessary for foreign diplomatic relations. But the Taeguk Flag could not be used under the Japanese colonial system in Korea, owing to the control of Japan.
It came to be used again as our national flag after the Liberation of our country from Japan on August 15,1945.
By the way, it couldn't be unified as one kinds of form, until the Liberation from Japanese rule, so the symbol of the Taeguk flag has many kinds of diagram.
Under the order of Seung-Man Lee the first President of Korea, the work of unifying the national flag began in January, 1949. Among five types of diagrams, the one suggested by the 「Woorikukkiboyanghoe」(Our National Flag Preservation Committee) was decided by a majority of vote(March 25, 1949), which was the symbol of the present our national flag.
The great philosophical significance of the Taeguk flag could be summarized as follows:
Firstly, the ground of the flag is white and squared at the ratio of three to two which symbolizes the Temporality and Spatiality of the universe. Especially, white means pure peace.
Secondly, "그림삽입(원문을 참고하세요)" in the middle is called as Taeguk diagram.
그림삽입(원문을 참고하세요) represents Taeguk(Great Polarity), 그림삽입(원문을 참고하세요) and 그림삽입(원문을 참고하세요) each indicates Weum(the negative, femininity) (그림삽입(원문을 참고하세요)) and Yang (the position, masculinity)(그림삽입(원문을 참고하세요)) originated from the Taeguk.
this Taeguk diagram, which is the central idea of Taeguk Flag, indicates a fundamental principle of the generative development of the universe with neither the beginning nor the end.
The Taeguk flag can be appreciated not on an understandable level but on an intuitive condition.
Weum and Yang originated form Taeguk, comprises a basic form of the universe, that is to say, all of the metaphysical quality(Yee) and physical quantity (KI) is made up of both Weum and Yang.
The basic principle of the universe is that the Weum and Yang Principle consists of the properties of nature such as the and the moon, fire and water, day and night, summer and winter, north and south: moral principles like man and woman, the rich and poor, life and death, parient and child, husband and wife; Political phenomena as in capitalism and communism, King and subjects. Yet the idea of Weum and Yang is contrastive each other, it each combines very well, as it is not only dualistic monism but circular affirmative dialectic.
Thirdly, four Kweh is composed of Kun, Kon, Kam, Ni, which are developed from the Weum and Yang.
The concrete meaning of them are as follows:

그림삽입(원문을 참고하세요)(Kam) stands for the Moon, Water, Wisdom, West, Winter,
그림삽입(원문을 참고하세요)(Ni) stands for the Sun Fire, Courtesy, East, Summer,
These four Kweh are the most inevitably basic foundation to the generation of the universe, corresponding to four virtues which human being should have fundamentally. The four Kweh in the Taeguk Flag represents that our country will develop infinitely and in the end contribute to the world peace and welfare if only our nation endowed with the basic elements of universe as well as four virtues of benevolence, justice, wisdom and courtesy, lead faithful lives, about 170 countries all over the world have national flags of their owen, however, it is not common to have a national flag like our Taeguk flag which symbolizes the properties of the universe, representing human nature and implying phylosophical idea.
Most other national flag cannot be exempted from simplicity, only symbolizing their own historical tradition, political concepts and system, or the sprit of revolution.
On the other hand, the Taeguk Flag can be evaluated to have lofty phylosophical significance in the sense that it contains the fundamental logic of the universe beyond one nation like Korea. Therefore, our national flag could be a representative flag of the world(the one country of the earth) which stands for the peace of the world.
