긴 분열의 남북조시대가 끝나고 짧지만 나름 통일제국의 면모를 갖춘 隋代(581~618년)를 거쳐 법제를 비롯한 典章制度가 정비된 명실상부한 통일제국으로서의 唐朝(618~907년)가 건국되었다. 당대는 율령체제를 정비하고 하나의 완비된 지배체제를 이루고 있었다. 지배체제를 형성하고 발전시키는데 있어 중세 중국 및 동양 사회의 이념 축으로서 ‘충’과 ‘효’의 문제가 대두된다. 그럼 ‘충’ㆍ‘효’문제에 있어, 또는 ‘효’자체에 대해서 당대에는 어떤 윤리를 선택하였으며 강조하였을까? 더 나아가 전통시대로부터 끊임없이 유지되어 온 효윤리는 과연 당대에서 어떻게 자리매김 되었으며, 발전되었을까? 당대 전반에 걸쳐 ‘충’ㆍ‘효’가 충돌하였을 때 어떤 윤리를 선택, 강조하였는지, 만약 ‘효’를 선택하였다면 당 이전 시대 특히 위진남북조시기에 ‘효’를 강조한 것과 무엇이 다른지, 그리고 이 시기에 국가적 차원으로 ‘효’를 강조한 정황에 대해 법조항, 상소문, 조칙 등을 중심으로 살펴보고자 한다. 또한 당조 전반에 걸쳐 위로는 황제들로부터 아래로는 일반 백성들에 이르기까지 효에 대한 윤리가 어떠하였지에 대해서 상례 준수 사례 등을 중심으로 분석하였다. 이에 본 연구는 자율적 효실천과 ‘奪情’으로 당조 전반에 걸쳐 제시된 상소문과 勅文 그리고 실제 자율적 효실천 관련 사례를 통해서 살펴보았다. 덧붙여 ‘충’ㆍ‘효’ 문제와 ‘탈정’에 관해 절대적인 ‘충’을 강조한 漢代를 당대의 비교대상으로 하여 당시 정치상황과 사회풍조를 엿볼 수 있는 사례와 국가적 차원에서 ‘효’를 강조하고 장려하는 사례 등을 통해 당대의 ‘효’를 살펴보았다. ‘忠’ㆍ‘孝’ 문제는 ‘충’ㆍ‘효’라는 사상적인 문제가 사회적ㆍ정치적으로 표면화된 것이다. 唐代는 율령과 지배체제가 정비된 시기이기 때문에 사적 영역에서 강조되던 개인윤리로서의 ‘효’를 국가적 차원인 율령체제내로 흡수하여 민에 대한 지배체제를 보다 긴밀히 하였다는 것이다. ‘奪情’은 부모의 3년상을 둘러싸고 ‘충’ㆍ‘효’가 충돌하였을 때 해결방안으로 漢代 황제의 權宜에 의해서 제정된 임시조치였다. 이 조치는 漢代에는 국가적으로 위급한 상황이나 戰時에, 또는 황제가 아끼는 유능한 관리가 부모상을 당하였을 때 文武를 불문한 모든 관리에게 적용되었다. 그러나 唐代에 이르러서는 이 조치의 적용 시기가 戰時로, 적용 대상이 軍職과 翰林의 관리로 제한되었다. 이러한 변화는 단순히 시기변화에 따른 것이 아니라 唐代에 이르러 사회적으로 ‘효’를 강조하는 풍조를 국가가 제도적으로 추진하고 있었다는 것을 나타내는 것이다. 이 사실은 ‘효’를 강조한 사례를 통해서도 알 수 있다. 결국 唐代는 기존 연구의 분석과 달리 초기뿐만 아니라 唐代 전체가 ‘효’를 강조, 장려하였다고 볼 수 있다. 그리고 이 시기에는 唐 이전시기의 ‘효’가 정치적으로 簒奪政權의 정당성을 부여하고 사대부를 통제하는 수단으로서 강조된 것과 달리, 사적 영역에서 개인윤리로서 ‘효’를 하나의 민을 지배, 통치하는 이데올로기로서 강조하였다. 이렇듯 唐代에 ‘효’개념에 대한 이념화는 사회 전반에서 진행되었다고 볼 수 있다. 그러나 唐代가 ‘충’을 배제한 ‘효’만을 中心으로 한 시기라는 것은 아니다. 개인윤리로서의 ‘충’ㆍ‘효’가 상호 병존하다가 漢代에 이르러 ‘충’은 지배체제에 흡수되었고 ‘효’는 唐代에 와서야 비로소 민을 지배하는 이데올로기로서 정립되었다고 생각한다. 제왕들이 名君으로서의 칭송을 받을 수 있는 수단으로서 이용되어가는 과정에서 드러나는 사실이다. 이러한 과정을 통해 이 시기부터 제도적으로 ‘효’가 ‘충’을 보완하는 역할을 하게 된다고 볼 수 있는 것이다.
더보기The long division of the North and South Dynasties was ended by the Sui dynasty(隋代: AD 581-681), an united empire in China despite its short-term domination. It was then the Tang dynasty(唐朝: AD 618-907) that succeeded the Sui dynasty, and established imperial sovereignty over China with its legislations and cultures(典章制度), thereby the dynasty organized a complete ruling system. In order to create and develop the ruling system, ``Filial Piety`` and ``Loyalty`` were articulated as ideological core values to the medieval Chinese and Asian societies. What ethics were selected and emphasized in regard to ``Filial Piety`` and ``Loyalty`` in the Tang dynasty? How did this ``Filial Piety``, which had been highlighted consecutively from the ancient times, settled in the Tang dynasty? During the overall reign of the Tang dynasty, which value was selected and weighed more between ``Filial Piety`` and ``Loyalty`` in case of value collision? In assumption that ``Filial Piety`` was selected over ``Loyalty,`` what were the points distinguished from the ``Loyalty`` focused in the Period of North and South Dynasties? To answer the above question, this study reviewed the background of centering national emphasis on ``Filial Piety`` mainly with the Tang legislations(唐律). In addition, the study also analyzed, on the basis of historical cases, how these ``Filial Piety`` ethics were in effect from the emperor to the people; how they were encouraged, and how these ethics were applied to the public. The second verse reviewed the autonomous practices of filial ethics and the cases of Service in Mourning(奪情) based on appeals raised and imperial messages(勅文) bestowed during the Tang dynasty. Furthermore, this paper studied the ``Filial Piety`` in the Tang dynasty based on Tang’s political situation and social atmosphere along with the cases of encouraging ``Filial Piety`` at national level, in comparison with those of the Han dynasty(漢代) who put absolute emphasis on ``Loyalty`` over ``Filial Piety.`` The embodiment of the Tang’s filial ethics is the criminal law clauses on ``Undutifulness to parents,``(不孝) which was designated as one of the ``Ten Deadly Sins`` that led to granted severe or capital punishment only if violated. This clearly shows that the Tang dynasty highlighted ``Filial Piety,`` and its government power was even influential to the ``Filial Piety`` in family ethics. Service in mourning(奪情) was a temporary course of action(權宜) established in the Han dynasty(漢代) to resolve value collision between ``Filial Piety`` and ``Loyalty`` caused by the traditional three-year-mourning custom for dead parents. This was applied in national emergency or hostilities(戰時) to all competent civil and military officials(文武) Emperors cared for. Later, this system was revised to limit its effect only in hostilities(戰時) and for military officials(軍職) and Royal archivists(翰林). It indicates the social encouragement of ``Filial Piety`` was systematically promoted by the Tang dynasty, which is supported, as aforementioned in the first verse of the second chapter, by the legislations throughout the entire Tang history; by the appeals and imperial messages; and by the cases articulating the significance of ``Filial Piety.`` It appears that the entire Tang dynasty encouraged and emphasized ``Filial Piety``, which is not coherent with other existing analyses and studies. The Tang dynasty differentiated itself in practice of the concept ``Filial Piety`` from other late dynasties who utilized ``Filial Piety`` as an instrument of justification of its regime usurpation(簒奪政權) and control over nobility; for it embraced ``Filial Piety`` within its legal system with national promotion of the value to the public, desiring to use it as a ruling ideology and to expand the influence of Buddhism against that of Confucianism. The efforts to perfect ``Filial Piety`` as an ideology was in progress all over the Tang society, which does not necessarily mean the value of ``Loyalty`` was set aside from the governing ideas of the Tang period. These two values co-existed equally in the privatl the Han dynasty embraced ``Loyalty`` in its ruling philosophy. It was the Tang dynasty who established ``Filial Piety`` as a ruling ideology to control the people. It had been a useful tool to gain popularity, and made people to praise monarch as an enlightened monarch. It also expanded national Buddhist influence while Buddhism, once alien and exotic, rising to be the mainstream ideologies along with Confucianism and Taoism. With this progress, it seems the value of ``Filial Piety`` had been developed to systematically supplement that of ``Loyalty.``
