이 연구는 일하는 청소년은 증가하고 있지만 이들의 근로현실은 점점 더 열악해지는 현실에 근거하여, 청소년들의 근로환경에 대대적인 개선이 필요하다는 문제의식에 바탕을 두고 있다. 이에 본 연구는 청소년을 대상으로 아르바이트 관련 실태를 파악하고, 이를 토대로 정책과제를 개발하는 데 목적이 있다.
이 같은 연구목적을 효과적으로 달성하기 위해 본 연구는 2개년 연구로 설계되었다. 1차년도인 2014년에는 만 15세 이상 18세 미만 연소근로자를 대상으로 이들을 둘러싼 아르바이트 참여 실태와 정책욕구를 확인하였다. 2015년에 수행된 2차년도 연구에서는 후기 청소년을 대상으로 아르바이트 실태를 파악하고 관련 정책 수요를 발굴하였다. 주지하다시피, 18세 미만 연소근로자와는 달리 18세 이상의 청소년들은 성인으로 간주되기 때문에 예외적인 보호의 대상이 되지 않는다. 그러나 이들은 성인들과 동일하게 근로를 제공하고 있음에도 불구하고 아르바이트가 단기적, 임시적, 과도기적 근로라는 이유로 정당한 대우를 받지 못하고 있다. 상술한 맥락에서 본 연구는 후기 청소년의 아르바이트 실태를 파악하기 위해 설문조사와 면담조사를 실시하였다. 또한 후기 청소년 아르바이트 관련 법령 및 정책에 대한 성과를 분석하였다. 설문조사와 면담조사 분석결과, 이들은 아르바이트에 상당한 시간과 에너지를 쏟고 있는 반면 부당대우와 권리침해를 경험하고, 근로권익에 대한 인식 수준도 높지 못한 것을 확인할 수 있었다. 이러한 연구결과를 토대로, 본 연구에서는 후기 청소년 아르바이트 정책 방안으로 4가지 범주를 설정하고 세부과제를 제시하였다. 첫째, 후기 청소년 아르바이트 구직환경 개선을 위한 정책 과제로 인터넷 직업정보제공/직업 소개 사이트에 대한 관리감독 강화, 근로보호 정책 확산의 통로로 인터넷 직업정보제공/직업 소개 사이트 활용도 제고, 괜찮은 아르바이트 일자리 지원 방안을 제안하였다. 둘째, 아르바이트 근로환경 개선을 위한 정책 과제로 근로계약서 작성 규정을 준수하는 노동시장 환경조성, 급여명세서 작성 강화, 휴게권 보장 방안, 사업장 근로감독 방법 개선, 근로감독 확대를 세부과제로 제안하였다. 셋째, 아르바이트 근로권익 보호를 위한 정책 과제에는 아르바이트 임금체불 대응 제도 개선, 부당대우에 대한 신고・상담제도 내실화, 아르바이트 일자리에서 수습 중 감액 금지, 감정노동종사자 보호를 위한 실질적 방안 마련을 제안하였다. 넷째, 노동인권교육 활성화를 위해 후기 청소년 대상 노동인권교육 방안과 고용주 대상 노동법 교육 실시 방안을 제안하였다.
The research is conducted with the understanding that the working conditions of youth need to be significantly improved, based on the fact that the percentage of Korean youth in part-time employment is increasing yet their working conditions are gradually deteriorating. This study aims to develop policy plans based on the thorough understanding of youths part-time working experiences.
To effectively accomplish the purpose of the research, the study was designed as a 2-year project. In 2014, the first year of research, survey was conducted on minors between the ages 15 and 18 to grasp their working conditions and to identify policy needs. In 2015, working conditions of late adolescents were studied along with the development of policy plans. Unlike minors under the age of 18, youths over 18 are considered adults and not subject to special protection. Although they are providing the same labor as adults, they are not receiving fair compensation because their part-time employment is deemed temporary, short-term, and transitional labor. With the abovementioned context in mind, survey and face-to-face interview were conducted to grasp the working conditions of late adolescent part-timers. Also, laws related to late adolescent part-time employment and the outcome of related policy measures were analyzed. Survey and interview results revealed that although the respondents were investing significant amount of time and energy to part-time employment, they were experiencing unfair treatment and violation of rights. Also, awareness of labor rights and interests were low among late adolescents. Based on these results, the research makes policy suggestions for late adolescent part-time employment in 4 different areas. First, strengthening management and supervision of online employment information sites/employment agency sites, increasing utilization of online employment information sites/employment agency sites as channels to spread labor protection policy, and supporting adequate part-time employment opportunities were proposed as ways to improve job searching environment for late adolescents. Second, nurturing labor market environment that complies to employment contract requirements, requiring detailed statement of wages, devising plans to guarantee rights to break, improving labor supervision methods in places of business, and expanding labor supervision were suggested as plans to improve part-time working conditions. Third, policy measures suggested for protecting part-time labor rights include improving the system for handling overdue part-time working wages, strengthening the reporting and counseling system for unfair treatment at workplace, prohibiting wage cuts of part-timers during probation, and devising substantial measures for protecting emotional laborers. Fourth, to stimulate labor rights education, implementing labor rights education to late adolescents and conducting labor law education to employers were proposed.
