디지털 전환에 따른 새로운 공과금 유형에 대한 고찰 = Consideration on new types of taxes and dues following digital transformation

디지털 전환을 통해 우리 산업과 생활 전반에서 효율성을 제고할 수 있으며, 양적인 성장을 도모할 수 있다. 디지털 전환은 인류의 생활에 편리함을 가져다 주었지만, 사회와 경제의 구조에 지대한 변화를 일으키기도 하였다. 전통적인 의미에서의 노동과 이윤 창출 및 그에 대한 과세라는 관점이 유효성을 잃었다고 볼 수는 없지만, 종래의 공과금 논의로 해결할 수 없는 새로운 형태의 이윤에 대해 어떻게 바라보고, 필요한 경우 과세(혹은 공과금 부과)의 가능성을 모색할 것인지 생각해 보는 일은 디지털 전환 시대를 맞는 법정책학의 과업 중 하나일 것이다.
지능정보기술이 촉발할 수 있는 부작용에 대응하고, 기술을 좀 더 유연하게 사회에 안착시키기 위해서는 새로운 재원이 필요하다. 먼저 일반적인 공장 노동자가 소득세를 비롯한 각종 세금을 납부하듯, 로봇이 동일한 일을 한다면 같은 수준의 세금을 내야 한다는 로봇세 논의가 제기되었다. 다만 로봇세의 현실화를 위해서는 정책결정권자의 판단에 따라 세수의 안정적인 확보와 현안에 대한 직접적인 대응 중 어떤 것이 중요한지를 비롯한 고려가 필요하다. 인공지능을 비롯한 지능정보기술의 소유자에 대해서 특별한 판매세 내지 재산세를 부과하는 특별 과세도 생각해 볼 수 있으나, 기술 도입을 통해 생산성을 개선한 행위에 대해 오히려 징벌적인 과세가 부과된다는 모순이 존재한다. 디바이스를 기반으로 다국적 기업에게 과세를 하는 디지털세 역시 고려할 수 있다. 기존 과세 체계의 한계를 극복하고, 디지털 시대에 적합한 매출 계산 방식이 될 수 있다는 장점을 가지지만, 기업의 디지털 서비스 확대를 위축시키고, 기술 개발 노력을 저하할 것이라는 우려 역시 존재한다. 사회보험 체계를 재편하는 대안도 제기되고 있다. 지능정보기술 개체가 야기하는 손해의 전보에 충당할 수 있는 재원 마련을 위해 새로운 형태의 사회 보험을 창설하는 것이다. 마지막으로 데이터가 부가가치를 창출하는 재화라는 점을 고려하여, 공과금의 형태로 그러한 부가가치 중 정보주체에 귀속하는 부분을 환수하는 데이터세의 도입도 고려할 수 있다.
로봇세에서 데이터세에 이르기까지 비록 완결된 논의와 정책이 존재하는 것은 아니지만, 새로운 유형의 과세 방법에 대한 지속적인 논의와 토론을 통해 인류 사회의 변화에 대응할 수 있는 해법을 찾아나갈 수 있기를 기대한다.
Through digital transformation, efficiency can be improved throughout industry and life, and quantitative growth can be promoted. It has brought not only convenience to human life, but also profound changes in the structure of society and the economy. It cannot be said that the perspective of labor and profit creation and taxation in the traditional sense has lost its validity. But one of the task of law and politics in the era of digital transformation is to think about how to view new forms of profit that cannot be resolved through the traditional discussion of public utility bills and, if necessary, explore the possibility of taxation.
New financial resources are needed to respond to the side effects that intelligent information technology may trigger and to allow the technology to settle in society more flexibly. First, discussion of a robot tax was raised, that robots should pay the same level of taxes if they do the same work, just as ordinary workers pay income tax. However, in order to make the robot tax a reality, it is necessary to consider whether securing a stable tax revenue or direct response to current issues is important, depending on the decision of the policy decision maker. A special taxation that imposes a special sales or property tax on owners of intelligent information technology systems, including artificial intelligence, can be considered. But there is a contradiction in that punitive taxation is imposed on actions that improve productivity through the introduction of technology. A digital tax that taxes multinational companies based on devices can also be considered. Although it has the advantage of overcoming the limitations of the existing taxation system and becoming a sales calculation method suitable for the digital era, there are also concerns that it will discourage companies from expanding their digital services and reduce their efforts to develop technology. An alternative to reorganizing the social insurance system is also being proposed. A new form of social insurance is created to provide financial resources to cover damages caused by intelligent information technology entities. Lastly, considering that data is a good that creates added value, the introduction of a data tax that recovers the portion of such added value that belongs to the information subject in the form of a utility fee can also be considered.
From robot taxes to data taxes, there are no complete discussions or policies. Nevertheless, I hope that through continued discussion and debate on new types of taxation methods, we will be able to find solutions that can respond to changes in human society.
