미국 연방대법원은 종래 여러 판결에서 여성차별의 고정관념적인 경향에 대한 문제의식을 표명하였으며, 성별에 의한 차별을 심사하는 추가적인 기준으로 특히 반고정관념화의 원칙을 발전시키려고 노력해왔다. 그러나 미국 연방대법원이 반고정관념화 원칙을 완전하게 수용하는 단계에 이르렀다고 보기는 어렵다. 연방대법원은 “비록 임신에 의한 차별이 한 성별의 구성원을 다른 성별의 구성원에 비해 현저히 차별하는 결과를 야기할 수 있다는 것을 인식하면서도, 임신에 기한 차별이 필연적으로 성별에 의한 차별로 귀결되지 않는다”고 판시하기도 하였다. 연방대법원의 임신차별 인정의 소극적 태도를 극복하기 위하여 미국 연방의회는 1978년 임신차별금지법을 통과시켰다. 동법에 따르면 임신에 근거한 차별은 성별에 근거한 차별로 정의된다. 최근 연방대법원은 Young v. United Parcel Service, Inc. 사건에서 임신과 관련되지 않은 장애로 자격을 상실한 운전자에게는 편의를 제공하고 있는 고용주에게 임신차별금지법 규정이 어떻게 적용되어야 하는지에 대한 판단을 하였다. 따라서 임신 여성의 차별성에 관한 연방대법원의 Young v. United Parcel Service, Inc. 판례를 면밀하게 검토할 필요가 있다. 연방대법원의 판례를 살펴보면서, 성역할의 반고정관념화 이론이 우리나라에서도 고용이나 근로관계에 있는 임신 여성의 차별행위에 대한 위헌심사기준으로 적절히 고려될 수 있는지 살펴보고자 한다. 특히 임신을 직접적인 사유로 하지 않으면서도, 임신 상태의 유지를 위해서는 고용관계의 유지 혹은 해고에 있어서 차별을 수용해야 하는 간접적인 차별유형에 대한 헌법적 조명이 요청된다. 본 연구는 임신 여성에 대한 차별에 관한 미국 연방대법원의 판례의 함의를 바탕으로 「남녀고용평등과 일・가정 양립 지원에 관한 법률」등 관련 법령의 개선 방향에 대해서도 유의미한 방안을 제시한다.
더보기The U.S. Supreme Court has rightly pointed to it with a questionable view of the stereotypical trend of female discrimination in various rulings. Justice Ginsberg has been striving to develop the principle of anti-identity, especially as an additional standard for screening discrimination by gender. Still, the U.S. Supreme Court still limits its hiring of anti-stereotyping principles. Nevertheless, the Supreme Court also ruled that while it was aware that discrimination by pregnancy could result in significantly discriminating against members of one gender compared to those of another, pregnancy discrimination does not necessarily result in discrimination by gender. In order to overcome this attitude in the Supreme Court, the U.S. Congress passed the Pregnancy Discrimination Act of 1978 which defines discrimination based on pregnancy as gender-based. However, the impact of the Pregnancy Discrimination Act is still limited because the enactment of the anti-pregnancy law did not immediately change the attitude of the Supreme Court's interpretation of the Constitution on equal protection. In a recent case in Young v. United Parcel Service, Inc., where a pregnant driver, Young, was fired for not being able to carry a heavy burden, the Supreme Court is making a judgment on how the anti-pregnancy rule should be applied to an employer who is providing convenience for a driver who is disqualified for a disorder not related to pregnancy. Therefore, it is necessary to carefully examine the attitude of the Supreme Court's ruling on the discrimination of pregnant women. In this regard, this article also examines whether the theory of anti-stereotyping of gender roles can be properly considered as a standard of unconstitutionality for discrimination of pregnant women in employment or working relationships in our country. In particular, a new constitutional explanation is strongly requested for the type of indirect discrimination that involves accepting discrimination in the maintenance or dismissal of an employment relationship in order to maintain a pregnancy without directly citing pregnancy. For this reason, this study aims to suggest meaningful ways to improve relevant laws, including the Act on Equal Employment for Men and Women and Support for Work-at-House compatibility, based on the implications of the U.S. Supreme Court's ruling on discrimination against pregnant women.
