검찰의 정치적 중립성 확보방안 = A Study for Guarantee of the Political Neutrality of Public Prosecution Services

국문 초록 (Abstract)

검찰은 그동안 국민전체에 대한 봉사자가 아니라 특정집단(정치ㆍ경제)을 위한 봉사자로 의심받아왔으며, 민주화가 이루어진 지금까지도 국민들은 검찰에 대하여 의심의 눈초리를 보내고 있다. 특히 MB정부 출범 후‘MBC PD 수첩사건’,‘KBS 정연주 전 사장사건’,‘YTN 노조사건’,‘미네르바 사건’,‘시국선언 전교조 교사사건’,‘MB 내곡동 사저매입 사건’,‘BBK 사건’ 등의 편파수사 내지 부실수사를 통해 검찰개혁이야말로 가장 중요한 시대적 사명으로 이야기하고 있는 실정이다. 이에 따라 정치권은 물론 시민단체 등에서 검찰개혁을 둘러싼 다양한 의견이 나오고 있으며, 대통령 후보들도 각자의 인생관 내지 철학관에 따라 여러 가지 제도적 개혁을 주장하고 있다. 그러나 국민의 자유에 직결된 형사사법 제도를 논함에 있어 진정 필요한 것은 뜨거운 가슴이 아니라 차가운 이성이라고 생각한다. 왜냐하면 국민은 무소불위의 권력을 휘두르는 검찰을 원하지도 않지만, 우리나라처럼 학연ㆍ혈연ㆍ지연 및 이념적 갈등이 첨예하게 대립된 나라에서 정치적 중립성이 훼손된 검찰은 더욱 원하지 않기 때문이다. 물론 서울 고등검찰청 김OO 검사 뇌물사건이나 동부지검 피의자 성추행 사건에서 볼 수 있듯이 검찰이 반성해야 할 점은 많이 있지만, 검찰의 본질적 문제는 권력형 부패 사건이나 정치적 사건에 대해서 정치권력의 눈치를 살피면서 수사를 주저하는 검찰의 행태가 문제되는 것이다. 즉 검찰에 대한 개혁은 정치권력으로부터 중립성을 어떻게 보장할 것인가에 초점이 맞추어져야 하며, 이와 본질적 상관관계가 없는 수사권의 조정 내지 분점문제를 거론하는 것은 논리의 비약이다. 결국 검찰의 개혁은 정치적 중립성을 어떻게 확보할 것인가에 있으며, 이는 정치권력으로부터의 인사권의 자유에 있다고 보아도 과언이 아닐 것이다. 즉 청와대 등 권력집권층과 검찰 상층부의 연결고리를 끊는 것만이 검찰의 정치적 중립성을 확보하는 방안일 것이다. 그리고 이러한 정치적 중립성 및 독립성을 확보한 검찰이 해야 할 본래적 기능은 권력층이나 대기업ㆍ언론 등 소위‘힘 센’자의 부정부패의 척결과 경찰에 대한 법치국가적 통제를 통하여 국민의 자유와 인권을 보장하는 것이라는 점을 강조하고 싶다.

다국어 초록 (Multilingual Abstract)

Public prosecution services are facing the serious crisis of trust through series of recent situation, example as‘MBC PD case’,‘KBS jeong yeon-joo the former president case’,‘YTN labor union case’,‘MB Negong-Dong private residence case’,‘BBK case’. Especially, Kim Gwang-jun bribery case and sexual-assault case in the Seoul Eastern District Prosecutor's Office demolished Public prosecution services in Korea. So, many people feel
unfairness when they observe the criminal justice system seems to be politically biased. First of all, Serious political corruption cases are often assigned to the Central Bureau of Investigation[CBI] under the Supreme Public Prosecutor's Office. CBI may be one of the most terrifying agencies, but their investigation practices have been often blamed for "target investigation" or "willful witchhunting of opposition leaders". In case that the suspect is a high-ranking official or a financial conglomerates, such arbitrariness of targetting or hesitating caused the people'resentment and distrust. Recently, another point where Public prosecution services are blamed for their political abuse of power is related to the hierarchical structure of the public prosecutor system. So, this thesis is to review the reality of political biases of prosecution services, and analyze their structural-institutional background. On the basis of such an analysis, some alternatives are suggested for achieving the more independent public prosecution from the political power and the strong control against the power-abusive crimes. In present, the politicized, monopolized, and overarching power of Public prosecution services is under strong pressures for change. Pressures from civil societies and candidates for the presidency are steady and growing in recent months. But in spite of growing objections to the influential power of Public
prosecution services, there are few effective means for controlling the prosecutorial discretion. So, they insist that CBI must be demolished and an new agency for the investigation of the high-ranking officials should be established for the decentralization of the influential power of Public prosecution services. Though I agree to their opinion partly, I think that new direction for the prosecution authority shall be to control the crimes of the powerful with the support of the people rather than to seek the guardian of the ruling political
power. So, I object the demolition of the CBI and the establishment of the new agency for the investigation of the high-ranking officials. Because the Guarantee of the Political Neutrality of Public Prosecution Services lies at how the prosecutors are active and fair about controlling political corruption. With the diminishment of the influential power of Public prosecution services, I think that CBI should have the function for the investigation of the high-ranking officials. Above all, I think that the fairness of the personnel management should be realized in order to accomplish a function like this. And even if there exists deep-rooted public distrust of the public prosecutors, I think that the Police should investigate under the direction and supervision of the public prosecutors for the human-right.
