오경에는 두 개의 서로 다른 전통의 십계명이 존재한다. 전통적으로 우리가 ‘십계명(열 개의 말씀)’으로 알고 있는 것은 출애굽기 20장 1-17절과 신명기 5장 6-21절이다. 각각은 시내광야의 산과 호렙에 있는 산에서 체결된 언약법에 속한다. 하지만 좀 더 주의 깊게 읽어보면, 신명기는 신명기 5장 6-21절을 ‘십계명’이라 칭하지만(신 4:9-13; 5:22; 9:7-10:11), 출애굽기는 출애굽기 20장 1-17절을 ‘십계명’이라 칭하지 않는다는 것을 알게 된다. 오히려 출애굽기는 34장 11-26절을 ‘십계명’이라 칭한다(출 34:28). 이렇듯 오경에는 서로 다른 두 종류의 십계명이 존재한다. 본 논문에서는 출애굽기의 시내광야에 있는 산에서의 언약을 ‘시내산 언약’으로, 신명기의 호렙에 있는 산에서의 언약을 ‘호렙산 언약’으로 각각 구별하여 칭할 것이다.
전통적인 자료비평학자들은 단순히 신명기의 호렙산 언약을 출애굽기 시내산 언약의 회상으로 이해하였다. 그래서 그들은 전통적으로 출애굽기 20장 1-17절과 동일한 것이 신명기 5장 6-21절에 나타나는 것으로 이해하였다. 출애굽기의 언약법전(Covenant Code: 출 20:22-23:33)은 이차적인 것으로 간주되었다. 그리고 출애굽기가 ‘십계명’이라 칭하는(출 34:28) 출애굽기 34장 11-26절의 문제는 후대 편집의 결과로 생각되었다. 왜냐하면 그들은 출애굽기 34장 11-26절은 물론 시내산 언약 전반에 걸쳐서 나타나는 신명기(사가)적 표현을 후대의 첨가로 보았기 때문이다. 하지만 시내산 언약의 신명기(사가)적 표현과 사상은 단순히 이차적인 첨가가 아니라 오히려 신명기 호렙산 언약을 전제한 후대적 작품임을 보이는 증거라는 주장이 지속적으로 제기되었다. 필자 역시 후자의 흐름에 서 있다고 할 수 있다. 그리고 본 논문에서 필자는 시내산 언약을 non-P(비-제사장 전승)에, 호렙산 언약을 Dtr(신명기적 전승)에 속한 것으로 구분할 것이다. 그리고 두 언약본문의 내러티브와 언약법 사이의 다소 복잡한 형성의 역사를 추적해 볼 것이다. 다시 말해서 출애굽기 시내산 언약 본문이 어떤 과정을 통해서 현재의 본문이 되었는지 신명기의 호렙산 언약본문과의 관계 속에서 그 형성과정의 역사를 추적하고자 한다. 그래서 신명기의 호렙산 언약과 달리, 출애굽기 시내산 언약이 출애굽기 34장 11-26절을 왜 ‘십계명’으로 칭하게 된 것인지를 밝히고자 한다.
시내산 언약본문은(출 19:1-34:35) 본래부터 하나의 연결된 이야기가 아니라 두 부분으로 구분된다. 본래 출애굽기 19장 1절-24장 11절은 언약법전을 ‘언약서’에 기록함으로(출 24:4,7) 언약체결을 완료하는 본문이다. 출애굽기 20장 1-17절은 처음 시내산 언약본문에(출 19:1-24:11) 이차적으로 삽입된 것이다. 그리고 갑작스럽게 등장하는 돌판 모티브를 중심으로 이루어진 출애굽 24장 12절-34장 35절은 처음 언약체결 본문(출 19:1-24:11)에 이차적으로 연결된 본문이다. 시내산 언약의 두 부분은(출 19:1-24:11/ 24:12-34:35) 신명기의 호렙산 언약의 두 부분(신 5-28*/ 9:7-10:11)과 각각 병행을 이룬다. 돌판에 십계명을 기록하였다는 모티브가 중심인 출애굽기 24장 12절-34장 35절과 신명기 9장 7절-10장 11절은 문자적으로 거의 일치한다. 두 병행본문을 비교하여 살펴보면, 출애굽기의 것이 신명기의 것을 자료로 삼았다는 것을 알 수 있다. 출애굽기 24장 12절-34장 35절에서 갑작스럽게 등장하는 ‘돌판에 새겨진 십계명’이라는 모티브는 신명기 9장 7절-10장 11절을 자료로 삼은 결과이다. 그리고 출애굽기 19장 1절-24장 11절과 신명기 5-28*장의 비교에서도 출애굽기 본문이 신명기 본문을 자료로 삼았다는 것이 드러난다. 하지만 내러티브 간의 관계와 달리 언약법 간의 관계는 다소 복잡하다. 시내산 언약의 언약법과(‘언약법전:출 20:22-23:33’) 호렙산 언약의 언약법을(‘십계명: 신 5:6-21’과 ‘신명기 율법:신 12-26’) 비교대조하여 살펴보면, 언약법전의 고대성과 시내산 언약 내러티브의 후대성이라는 다소 모호한 관계가 발견된다. 시내산 언약본문의 저자(non-P)는 호렙산 언약체결 양식(Dtr)을 모델로 고대의 전통적인 규정이나 관습 등을 모아서 시내산 언약법으로 선포한 것이다(‘언약법전’). 이에 대한 신명기전승의 대응 본문이 신명기 9장 7절-10장 11절이다. 그 구체적인 대응 내용은 언약법을 돌판에 새겨진 ‘십계명’만으로 제한한 것이다. 이러한 돌판 모티브는 조약을 확증하기 위해 돌판에 기록하는 근동의 관습에 근거한 것이다. 신명기 전승의 이러한 조치는 시내산 언약의 ‘언약법전’을 무효화시키려는 의도이다. 이후 non-P전승(시내산 언약)에서 Dtr전승(호렙산 언약)과의 통합을 지향하며 변화를 시도한다. 이러한 변화는 당시의 사회 정치적 환경의 변화에 따른 것이다. 출애굽기는(non-P) 신명기 9장 7절-10장 11절을 자료로 삼아 시내산 언약법인 ‘언약법전(출 20:22-23:33)’과 호렙산 언약법인 ‘십계명(신 5:6-21)’을 통합한 형태인 출애굽기 34장 11-26절을 돌판에 새긴 십계명으로 선포한다(출 34:28). 그 이야기가 바로 출애굽기 24장 12절-24장 35절이다.
출애굽기와 신명기에 병행되는 두 언약본문이 존재하게 된 것은 포로기 말과 포로기 이후 귀환공동체의 삶을 규정할 언약법으로 인정받기 위한 두 전승간의(non-P, Dtr) 갈등과 타협의 결과라 할 수 있다. 그러한 역사를 간략히 살펴보면 다음과 같다. 포로기 초, 신명기적 전승(Dtr)에서는 이스라엘 백성에게 그들이 여전히 야훼의 백성이라는 정체성을 부여하여 야훼신앙을 고수하도록 하였다. 그래서 이스라엘 백성과 야훼의 언약체결을 ‘회상’이라는 모티브를 통해 과거 사건으로 역사화하였다. 호렙산 언약의 중심 언약법은 ‘십계명’이란 이름으로 선포된 신명기 5장 6-21절이다. 그리고 약속의 땅에서 지켜야 하는 규정으로 선포되었던 포로기 이전의 유산인 ‘신명기 율법(신 12-26)’도 언약법에 포함시켰다. 이후 포로기 말, non-P전승은 신명기전승(Dtr)의 호렙산 언약 본문을 기초하여 신명기개혁 이전의 전통적인 규정들을 모아서 귀환 후 고국 땅에서 지켜야 할 언약법으로서 ‘언약법전’을 선포한다. 곧 신명기전승의 대응이 뒤 따른다. 신명기는 ‘언약법전’을 무효화시키기 위해 돌판에는 오직‘십계명’만이 기록되었다고 말하여 언약법을 제한시켰다(신 9:7-10:11; 4:9-14; 5:22). 이후 포로귀환이 이루어지고 성전이 건축될 때에(B.C. 520-15), non-P전승은 신명기 9장 7절-10장 11절을 자료로 삼아 출애굽기 24장 12절-34장 35절을 저작하여 출애굽기 34장 11-26절을 돌판에 기록된 ‘십계명’으로 선포한다. 하지만 신명기 전승에 대한 대립적인 태도였던 포로기 말의 non-P의 태도와 달리, 이제는 신명기전승과의 통합을 시도한다. 그러한 시도의 일환으로 신명기 십계명(신 5:6-21)의 내용을 처음 시내산 언약본문에(출 19:1-24:11) 삽입한다. 그것이 바로 출애굽기 20장 1-17절이다(출 19:9, 19절 포함). 이러한 시도는 처음 시내산 언약(출 19:1-24:11)에서부터 신명기 전승의 십계명이(신 5:6-21) 언약법전(출 20:22-23:33)과 함께 있었던 것처럼 보이려는 것이다. non-P의 태도 변화는 제 2 성전 건축과 관련이 있다. 제 2 성전 건축은 중앙 성소 사상을 중심으로 한 신명기전승에게 유리하게 작용했기 때문이다. 앞에서 열거한 과정들을 통해, 현재 오경에는 신명기적 전승(Dtr)의 십계명(신 5:6-21)과, 비-제사장적 전승(non-P)의 십계명(출 34: 11-26)이라는 서로 다른 두개의 십계명이 존재하게 된 것이다.

A Study of the History of the Formation
in the Sinai Covenant text in Exodus

There are two different traditions of the Decalogue in the Pentateuch. Traditionally we believed Exodus 20:1-17 and Deuteronomy 5:6-21 as Decalogue (Ten Words). Each belongs to the covenant law that was concluded in the Mount Sinai and in the Mount Horeb. However, a more careful study of the Pentateuch reveals that Deuteronomy 5:6-21 is referred to as called ‘Decalogue’ (Deut 4:9-13; 5:22; 9:7-10:11), but Exodus 20:1-17 is not. Rather, there is a reference within the book of Exodus that identifies Exodus 34:11-26 as ‘Decalogue’ (Exod 34:28), revealing that there are two different kinds of Decalogue in the Pentateuch. One is related to the covenant on Mount Sinai, and the other is related to the covenant on Mount Horeb. In order to distinguish between the two, I will refer to them as ‘Sinai covenant’ and ‘Horeb covenant’respectively.
Traditionally many scholars perceived the Horeb covenant in Deuteronomy as being simply a reminder of the Sinai covenant. So they understood Horeb covenant as a recollection of the story that proclaimed the Decalogue of Exodus 20:1-17, which was the same as Deuteronomy 5:6-21. Futhermore, because Deuteronomic words and expressions throughout the Sinai covenant were regared as later additions, scholars believed that the Covenant Code (Exod 20:22-23:33) was inserted secondarily and that Exodus 34: 11-26 was thought to be the result of later redaction. However, recently many scholars argue that the Deuteronomic expressions in the Sinai Covenant story are not merely secondary additions, but rather are a proof that it presupposes the Horeb Covenant in Deuteronomy. This thesis supports the latter view point.
In this paper, I will classify the Sinai covenant as non-P (non-priestly tradition) and the Horeb covenant as Dtr (Deuteronomic tradition). I will also track down the complex formation history of the narrative as well as the covenant law contained in the Sinai covenant story. In other words, I will trace the formation process of the Sinai covenant text in comparison with the text of the Horeb covenant in Deuteronomy in order to understand the process behind the current Sinai covenant text. Through this examination, you will see why Exodus, unlike Deuteronomy, refers to the verses in the Exodus 34:11-26, as the Decalogue.
The Sinai covenant story (Exod 19:1-34:35) is not a story that was originally connected, but is rather a two-part story. Exodus 19:1-24:11 is the first story concluding a covenant by recording the covenant laws in the ‘covenant book’ (Exod 24:4, 7). Exodus 20:1-17 was later inserted into the first Sinai covenant story (Exod 19:1-24:11). Exodus 24:12-34:35, which is centered on stone motif, is a second one that was secondarily connected to the first covenant text (Exod 19:1-24:11). Both segments of the Sinai covenant story (Exod 19:1-24:11/24: 12-34:35) run parallel with the two parts of the Horeb Covenant in Deuteronomy (Deut 5-28* / 9:7-10:11). The individual stories found in Exodus 24:12-34:35 and Deuteronomy 9:7-10:11, centered on the motif that the Decalogue is written on the two tablets, are literally almost identical. Comparing the two reveals that Exodus made use of the Deuteronomy as basic text. The reason for the sudden appearance of the‘stone tablets’ motif in Exodus 24:12-34:35 is that it is written based on Deuteronomy 9:7-10:11. In regard to the comparison between Exodus 19:1-24:11 and Deuteronomy 5-28*, it will be revealed that the Exodus text used the Deuteronomy text as basic material. However, unlike the relationship between the narratives, the one between the covenant laws is somewhat complicated. A comparison of the Sinai and Horeb Covenant stories reveals a rather ambiguous relationship with ‘ancient’ Covenant Code, and ‘later’ Sinai covenant narrative. Based on the narrative of the Horeb covenant, the author(s) (non-P) of Sinai covenant wrote the narrative, but collected traditional rules and customs and declared them as the covenant law (that is ‘Covenant Code’). A prompt response to the non-P’s challenge is found in Deuteronomy 9:7-10:11 and states that only Decalogue is recorded on the tablets. This was an attempt to nullify the‘Covenant Code’ of Sinai covenant. Due to the socio-political environment at the time, the non-P (Sinai covenant) attempted to integrate with the Deuteronomic tradition (Horeb covenant). The non-P made use of Deuteronomy 9:7-10:11 as narrative material, but they proclaimed Exodus 34:11-26 as Decalogue (Exod 34:28) which was an amalgamation of ‘Covenant Code (Exod 20:22-23:33)’ and the ‘Decalogue (Deut 5:6-21).’ This story is found in Exodus 24:12-24:35.
The existence of two covenant stories in parallel (in Exodus and Deuteronomy) is the result of conflict and compromise between two traditions(non-P, Dtr) to be recognized as the only authorized covenant laws regulating the lives of people returning from exile. The Deuteronomic historian(s) (Dtr) tried to endow the Israelites with the identity ‘the people of Yahweh’ even in their exile so that they could adhere to the faith. Therefore, Deuteronomic historian(s) had the establishment of a covenant between Israelites and Yahweh historized into the past event through the motif of ‘recollection,’ proclaimed Deuteronomy 5:6-21 under the name of the ‘Decalogue,’ and included the Deuteronomic Code, a legacy of pre-exile in the covenant law. The non-P gathered the traditional rules and regulations that had been invalidated by the Deuteronomic reform during the late monarchy age, and proclaimed the ‘Covenant Code’ as the covenant law to keep in the Promised Land. In response, Deuteronomy restricted the covenant law to the Decalogue (Deut 9: 7-10: 11; 4: 9-14; 5:22) and invalidated the Covenant Code, stating that the two tablets only contained the Decalogue. The non-P wrote its narrative (Exod 24:12-34:35) based on Deuteronomy 9:7-10:11, but proclaimed that Exodus 34:11-26 was ‘Decalogue’ carved on the stone tablets. However, unlike the opposing attitude toward Deuteronomic tradition at the end of the exile, the non-P tradition made effort to integrate with Dtr. So the non-P inserted the Decalogue of Deuteronomy (Deut 5:6-21) in the first story of Sinai covenant (Exod 19:1-24:11). That is Exodus 20:1-17 (Exod 19:9, 19). The non-P tried to make it look as if there had existed the Deuteronomic Decalogue (Deut 5:6-21) together with the Covenant Code (Exod 20:22-23:33) in the first story of the Sinai covenant (Exod 19:1-24:11). This attitude change was related to the construction of the Second temple (B.C. 520-15), which was favorable for the Deuteronomic tradition centered on the central sanctuary. As a result of this complex history, the present Pentateuch contains two different Decalogue: Deuteronomy 5:6-21 (Dtr) and Exodus 34:11-26 (non-P).
