조약 해석의 문제는 국제법체계 내에서 가장 근본적인 사안 중 하나라 할 수 있다. 그러나 생각보다 조약 해석에 있어서 난해한 부분이 없지 않다. 전통적으로 조약의 해석과 관련하여 3개의 입장이 대립하여 왔고 이를 상호 배척관계로 보기보다는 조화롭게 수용해야 한다고 봐왔다. UN 국제법위원회(ILC)도 조약 해석에 대하여 특정 입장을 취하기 보다는 조화로운 접근을 취하고 있다. 그럼에도 전통적으로 조약의 문언을 강조하는 문언주의적 시각이 다수의 입장이었다고 할 수 있다. 따라서 ILC의 이와 같은 조화로운 접근 제시에도 불구하고 문언주의가 강조된 듯하고 조약법에 관한 비엔나협약 제31조 제1항이 다른 조항보다 강조된 듯하다. 그러나 ILC는 주석서에서 조약 해석을 재량적 행위이며 하나의 예술 혹은 기예로 표현하기도 한다. 그렇다면 조약 해석이라는 예술 또는 기예 행위는 어떻게 실현해야 하는가? 조약법 협약의 구조는 사실 문언주의를 취하는 것과 무관하게 그 구조가 난해한 부분이 있다. 이 사안에 대해 본 연구는 조금 더 근본적인 질문을 던지고자 한다. 즉, 조약의 문언을 해석하여 성취하고자 하는 바는 무엇인가? 본 연구의 목적은 조약법체계에 대한 유기적 이해를 바탕으로 조약법에 관한 비엔나협약 체계를 관통하는 조약 해석의 원칙을 확인하여 그 해석 기준을 밝히는 것이다. 본 연구는 ILC가 초안을 작성한 조약법에 관한 비엔나협약의 해석 원칙 기저에 “당사국들이 조약 문언에 부여하고자 의도한, 즉 법적 구속력을 받고자 동의한 공통 의사를 파악”하고자 함이 존재하고, 바로 이 공통 의사주의적 접근이 조약 해석의 기준으로 활용될 수 있다고 본다. 주의하여 할 것은 ‘공통의사주의’는 전통적인 접근방법 중 하나인 당사국의 내심의 의도에 방점을 두는 ‘주관주의’와 차이가 있다는 점이다. 합의하여 법적 구속력이 생긴 공통 의사와 당사국의 의사는 구분된다. 나아가 본 협약 제31조 제1항에 따라 문언이 조약 해석의 출발점인 것은 분명하다. 그 문언에 공통 의사가 반영되어 있기 때문이다. 그러나 그 이외의 일반적 규칙과 보충적 수단을 관통하는 공통의사주의적 기준이 있고 이에 따라 조약을 해석을 해야 한다. ILC는 제31조의 조항들은 위계질서가 없고 “단일의 결합된 작업”이라 강조하였다. 나아가 ILC는 주석서에서 제31조 ‘일반적 규칙’과 제32조 ‘보충적 수단’이 연결되어 있고 통합하여 해석 해야하는 작업이라는 점을 제시하였다. 따라서 본 협약의 구조의 기저에 놓인 공통의사주의적 원칙을 고려하지 않는다면 조약 해석 자체가 난해한 과정이 될 수 있다. 이와 같은 의사주의 접근방법에 한계도 있다. 그럼에도 ILC가 초안을 작성한 난해한 조약법에 관한 비엔나협약에 따라 조약을 해석하는 데에 도움이 될 수 있을 것이다.
더보기The principles of treaty interpretation are one of the most fundamental issues within the international legal system. However, treaty interpretation is not without its difficulties. Traditionally, there have been three competing positions on the interpretation of treaties, which should be accommodated in harmony. The UN International Law Commission (ILC) also takes a harmonized approach to treaty interpretation, rather than taking a particular position. Nevertheless, a literalist or textualist view, emphasizing the text of the treaty, has traditionally been the majority position. Thus, despite the ILC's harmonized approach, it appears to emphasize textualism and emphasize Article 31(1) of the Vienna Convention on the Law of Treaties over other provisions. However, the ILC also characterizes treaty interpretation as an art with discretionary exercises. What does it mean by art? How is the art of treaty interpretation to be practiced and realized, then? The structure of treaty law conventions, whether textualist or not, is not without its difficulties. The purpose of this study is to identify the principles of treaty interpretation that run through the Vienna Convention on the Law of Treaties system, based on an organic understanding of the treaty law system, and to shed light on the standards of interpretation. It argues that underlying the principles of interpretation of the Vienna Convention on the Law of Treaties drafted by the ILC is an attempt to ascertain the common intention that the parties intended to give to the text of the treaty, i.e., the common intention that they agreed to be legally binding and that this common intention approach can be utilized as a standard for treaty interpretation. It is important to note that common intentionality is distinct from one of the traditional approaches, subjectivism, which focuses on the inner intentions of the parties. A distinction is made between common intentions, which are consensual and legally binding. Furthermore, under Article 31(1) of the Convention, it is clear that the text is the starting point for treaty interpretation. But treaties must be interpreted in terms of the common intentionality standard that runs through the general rule and supplementary means. The ILC emphasized that the provisions of Article 31 are not hierarchical and are all designed to be interpreted systematically and integrally. Furthermore, the ILC's commentary suggests that Article 31 “general rules” and Article 32 “supplementary means” are not hierarchical, but rather of a unity of interpretation. This intentionalist approach has its limitations. Nevertheless, the Vienna Convention on the Law of Difficult Treaties, drafted by the ILC, may be helpful in interpreting the treaty.
