계획입지의 중복지정과 관리법제의 체계 정당성 확보 방안 - 첨단의료복합단지 입지 사례를 중심으로 - = The Duplicate Designation of a Planned Location and the Measures to Secure the Legitimacy of the Systems of Management Legislation - Focused on the Case of Location in High-tech Medical Complexes -

This study inquired into what problems may arise in the management systems due to the duplicate designation of a planned location, and what measures can be taken to solve these problems and secure the legitimacy of the systems of management legislation focusing on the case of two high-tech medical complexes located in the industrial complexes or innovation city. Although duplicate designation itself of a planned location is not a problem, it can lead to considerable confusion in the management systems in case where the underlying laws for each planned location are applied in a duplicate manner. Problems brought by duplicate designation of a planned location include duplicate occupancy examinations conducted by diverse management institutions and concomitant inefficiency, confusion due to dissimilar regulations, as well as the resulting restrictions on the exercise of property rights. In order to secure the legitimacy of the systems of management legislation due to duplicate designation of a planned location, basically, it is required to find a clue from acknowledgment of the independence of management legislation for each planned location. Since each planned location in the management systems forms a unique management unit, there is no room for the management legislation of other planned locations to be applied here, and it cannot be argued that a certain management law in the relationship with another management law encounters in the relationship of a special law with respect to the general law. Once the independence of the management legislation is acknowledged, no confusion will arise in the application of the laws due to the duplicate designation of a planned location. In addition, in order to secure the legitimacy of the systems of management legislation, it is vital to not only establish a cooperative occupancy management system between planned locations, but also clearly stipulate the regulations at the legal level regarding ex post facto management, which can seriously restrict the exercise of property rights of the people. Moreover, it is important to differentiate the management system according to the zone for each purpose of use, and set the period of disposal restrictions not excessively long in consideration of equity with other planned locations.

국문 초록 (Abstract)

계획입지의 중복지정에 따라 관리체계에 어떠한 문제가 발생할 수 있는지, 이러한 문제를 해결하고 관리법제의 체계 정당성을 확보하기 위해 어떠한 방안이 강구될 수 있는지에 대하여, 산업단지 또는 혁신도시에 입지한 두 곳의 첨단의료복합단지 사례를 중심으로 살펴보았다. 계획입지의 중복지정 자체가 문제되는 것은 아니지만, 각 계획입지의 근거가 되는 법률이 중첩적으로 적용되는 경우 관리체계에 상당한 혼란을 야기할 수 있다. 계획입지의 중복지정으로 인한 문제로는 여러 관리기관에 의한 중복적 입주심사와 그로 인한 비효율, 서로 상이한 규제 내용으로 인한 혼란과 그로 인한 재산권 행사의 제한 등을 들 수 있다. 계획입지의 중복지정으로 인한 관리법제의 체계 정당성을 확보하기 위해서는 기본적으로 각 계획입지에 관한 관리법제의 독자성을 인정하는 데서 그 실마리를 찾아야 한다. 관리체계에 있어서 각 계획입지는 고유한 관리단위를 형성하게 되어 다른 계획입지의 관리법제가 여기에 적용될 여지는 없고, 어느 관리법제가 다른 관리법제와의 관계에서 일반법에 대한 특별법의 관계에 있다고 할 수도 없다. 관리법제의 독자성을 인정하게 되면 계획입지의 중복 지정으로 인한 법 적용상의 혼란은 존재하지 않게 된다. 이와 더불어 관리법제의 체계 정당성을 확보하기 위해서는 계획입지 간 협력적 입주관리 체계를 구축하고, 국민의 재산권 행사에 중대한 제약이 될 수 있는 사후관리에 관한 규정을 법률적 차원에서 명확하게 규정해야 한다. 그리고 용도별 구역에 따라 관리체계를 차별화하며, 처분제한의 기간도 다른 계획입지와의 형평성을 고려하여 지나치게 장기로 설정하지 않도록 해야 한다.
