의료행위와 특허보호체제에 관한 연구 = A Study on the Medical Practice and Patent Protection System

헌법상 보장된 환자의 생명권을 보장하기 위해 일정한 면허를 가진 의료인의 「의료행위」에 대하여 특허를 부여하여 독점권을 인정할 것인가의 문제는 오래전부터 제기되어온 특허법상의 과제이다. 의료행위에 대한 특허부여의 문제는 의료행위는 모든 사람들이 제한 없이 수혜를 입어야 한다는 윤리적 측면과 특허제도내에서의 독점적 보호를 통한 의료기술의 연구 및 개발 촉진이라는 어느 하나도 소홀히 할 수 없는 다소 모순되는 듯 보이는 두 가지 명제를 조화시키는 방향으로 해결해야 할 것이다. 각 국에서도 이러한 방향으로 의료행위에 대한 특허성문제를 해결하고 있는 바, 의료행위의 특허성을 윤리적 관점에서 어느 정도 제한하고 있는가 하면, 기술 개발의 촉진을 강조하여 원칙적으로 그 특허성을 인정하면서 그에 대한 침해책임을 면제함으로써 양자의 조화를 꾀하고 있다. 최근 생명공학기술의 발전에 따라 게놈분석 및 배아줄기세포 (embryonic stem cell)의 연구가 활발히 진행되었고, 이러한 연구 성과를 응용하여 유전자치료 및 재생치료 등의 의료기술도 괄목할만한 성과를 이루었다. 피부의 배양방법, 세포의 처리방법 등과 같은 새로운 기술개발을 촉진하기 위하여 특허법에 있어서의 취급을 명확히 할 필요성이 있다. 특허법의 목적이 발명을 보호·장려하고 그 이용을 도모함으로써 기술의 발전을 촉진하여 산업발전에 이바지함을 목적으로 하는 것을 고려하면 급속도로 발전하고 있는 의료행위관련 기술을 특허에 의하여 보호하는 것을 고려할 수 있지만, 의사가 행하는 치료 및 수술행위는 인간의 생명에 관한 것이므로 종래부터 특허에 의한 보호는 그러나 의료방법 발명의 특허성 배제에 대한 특허법상 명문의 규정은 없고, 다만 특허청은 연구개발 정책적 및 인도적 이유에서 의료행위에 대하여 특허권을 부여하지 않고 있다. 그래서 현재 우리나라의 특허청의 의료행위 발명에 대한 심사 실무는 기본적으로 인체를 기본구성요소로 포함하고 있는 치료, 진단 및 수술방법은 제29조 제1항의 적용하여 모두 거절되고 있다. 한편 특허법의 목적을 감안하여 특허권의 효력을 그대로 인정하는 것보다도 이것에 제한을 가하는 것이 산업발전과 공공이익에 타당하다고 생각되는 경우에는 제한을 가할 필요가 있다. 한편 미국에서는 의료행위를 특허의 보호대상에 포함시키고 있지만, 1996년 9월 30일 의료행위에 관한 특허권의 효력은 원칙적으로 의사의 치료행위에 미치지 않는다는 취지의 규정(미국특허법 제287조(c))를 포함하는 법률이 제정되었다. EU에서는 유럽특허조약(EPC) 제52조 제4항에서 외과수술 또는 치료에 의하여 인간 또는 동물의 신체를 처리하는 방법 및 인간 또는 동물의 신체에 실시하는 진단방법은, 이것을 유럽특허조약 제52조 제1항에 해당하는 산업상 이용할 수 없는 발명으로 규정하였지만, 2000년 11월 유럽특허조약의 개정에 의하여 외과수술 또는 치료에 의하여 인간 또는 동물의 신체를 처리하는 방법 및 인간 또는 동물의 신체에 실시하는 진단방법은 유럽특허조약 제53조(c)에 있어서 불특허 사유로 되었다. 또한 TRIPs협정 제27조에는 특허의 보호대상을 규정하고, 제3항에는 “회원국이 인간 또는 동물을 치료하기 위한, 진단, 치료 및 외과적 방법을 포함하는 발명을 특허대상에서 제외시킬 수 있다”고 규정하고 있다. 최근, 국내에서도 생명공학기술의 급속한 발전 ...
더보기The question of whether to grant a patent for medical practice of a medical practitioner with a certain license to ensure the life rights of a patient with a constitutionally guaranteed license is a long-standing patent law challenge. The issue of patenting medical practice should be addressed in a way that harmonizes the ethical aspects of medical practice with the seemingly contradictory proposition of promoting research and development of medical technology through exclusive protection within the patent system. Countries are solving the patentability problem for medical practice in this direction, limiting the patentability of medical practice to some extent from an ethical point of view, and trying to harmonize the two parties by emphasizing the promotion of technological development, recognizing its patentability in principle and exempting it from infringement liability. Recent advances in biotechnology led to active genome analysis and research of embryonic stem cells, and by applying these findings, medical technologies such as gene therapy and regenerative therapy have also achieved remarkable results. It is necessary to clarify the treatment in patent law to promote new technology development, such as how to grow the skin, how to treat cells, etc. Considering that the purpose of the Patent Act is to protect and promote invention and contribute to industrial development by promoting the development of technology, it can be considered to protect rapidly developing medical practice-related technologies by patenting them, but since treatment and surgical activities performed by doctors are about human life, the patent protection by doctors is traditionally based on human life, but the patent document on patent exclusion of medical method invention is not stipulated in the patent act, but the R&D and R&D policy for the reason for humanitarian policy. Thus, the current examination practice of medical practice invention by the Korean Patent and Trademark Office has been rejected by the application of Article 29 paragraph 1., which basically includes the human body as a basic component. On the other hand, in view of the purposes of the Patent Act, restrictions need to be imposed if it is deemed appropriate for industrial development and public interest to impose restrictions on patent rights rather than to accept them as they are. Meanwhile, US patent law was enacted on September 30, 1996, which included provisions to the effect that while medical practice was included in the patent protection list, the patent right on medical practice was not, in principle, a doctor's treatment. In the EU, in Article 52 para 4 of the European Patent Treaty (EPC), the method of treating human or animal bodies by surgery or treatment and the method of diagnosing human or animal bodies by surgery or treatment, defined this as an industrial invention under Article 52 para 1 of the European Patent Treaty, but in November 2000 the method of treating human or animal body by surgery or treatment is the European Patent Treaty. In addition, Article 27 of the TRIPs Agreement defines the protection targets of patents, while paragraph 3 states that "an invention involving diagnostic, therapeutic and surgical methods for treating humans or animals may be excluded from the patent list." Recently, there has been a growing need to review patent protection methods in medical practice in the wake of the rapid development of biotechnology in Korea. Whether the patent law treatment of medical practice is valid needs to be reviewed, including legislation, not just in the interpretation framework of the current law. These discussions are intended to contribute to active discussions on how patent protection measures for future invention of medical practice and how the constitutional right of the patient's right to life can be reasonably adjusted to resolve conflicts.
