건강가정기본법 개정안에 스며있는 페미니즘에 대한 비판적 고찰 = A Critical Review of Underlying Feminism in the Amendment of Healthy Family Act Bill

The Amendments of Healthy Family Act Bill proposed by Rep. Nam, In-soon and Rep. Chung, Chun-sook in September 2020 and November 2020, respectively, are intended to completely revise the framework of the existing Healthy Family Act. The definition of family, the expression of fetal health (Article 8 (2)), and the regulations for the prevention of family dissolution (Article 9) were deleted in the amendment bills.
They also emphasize the relationship of democratic and equal family members, completely changing the direction of the Act from being family-oriented to being feminist-oriented. In other words, underneath the attempt for the amendments lie a radical feminist resistance to the family system that supports this society. Korean feminists, rooted in Western radical feminism, who regard the family as the source of women's oppression and exploitation, are trying to break down the patriarchy through the amendment of the Act.
Two strategies to break down the patriarchy system in the Amendments can be summed as follows. The first strategy is to completely eliminate gender inequalities in the home and realize the absolute equity, ignoring biological differences and order, and the second is to embrace the communities(such as cohabiting couples, same-sex couples, single-sex families, etc.) that run counter to moral values and universal norms in the name of embracing diverse types of families. This feminist idea is also evident through the removal of the definition of family in the Amendments. The deletion of the definition of family means much more than a simple deletion; firstly, it denotes a call to undermine the basic social order and moral norms in response to the rapid changes in the society, and secondly, to realize the radical feminist ideology that seek to undermine the boundaries of traditional families.
However, the health and importance of families should be emphasized even more at a time when society is moving toward disorder and chaos. Families that provide stability with consideration, love, commitment and responsibility are more desperately needed than ever, and the Healthy Family Act originally established in order to address these social needs should never be reduced to a site of biased ideological realization.
