프랑스, 독일, 일본 상고심의 민사 판결서 작성 방식

국문 초록 (Abstract)

최고법원의 판결서는 소송사건에 대한 최종 결론으로서 소송당사자에게 중요한 의미를 지닐 뿐만 아니라, 사법제도의 전통·역사 및 현황, 최고법원의 위상과 권위, 일반 국민의 법의식 및 사법부에 대한 신뢰도 등을 그대로 반영하는 상징적 존재이기도 하다. 이 논문에서는 프랑스 파기원, 독일 연방일반법원, 일본 최고재판소의 민사 판결서 작성 방식을 실제 판결을 통하여 확인함으로써, 우리나라 상고제도 및 대법원의 판결서 작성 방식을 개선하기 위한 구체적이고도 실천적인 시사점을 얻고자 하였다.
각국의 상고심 판결서 작성 실무는 그 나라 사법제도에서 상고심이 차지하는 위상, 상고제한 제도의 채택 여부와 그 내용, 상고심 재판부의 규모와 인적구성, 재판보조인력의 규모와 역할 등의 요소와 밀접하게 관련되어 있으므로, ‘판결서 작성 방식’이라는 이 논문의 주제와 관련된 범위에서 위 요소를 우선 개관하였다. 그다음 민사 상고사건에 대한 실제 판결례를 검토하여 그 나라 판결서만의 고유한 특징을 파악하고 그러한 특징을 갖게 된 이유를 살펴보았다. 또한 사건 통계를 통하여 상고심 법관의 업무 부담과 판결서 작성 방식 사이의 상관관계도 살펴보았다.
그 결과, 프랑스 파기원, 독일 연방일반법원, 일본 최고재판소의 판결서는 다른 나라와 뚜렷이 구분되는 고유한 특징을 갖고 있다는 점 및 그 특징은 그 나라 사법제도와 상고제도, 사법전통, 상고심의 업무부담 및 법조인 양성제도 등과 깊이 관련되어 있음을 확인하였다. 검토 결과를 토대로 이 논문은 우리나라 대법원의 판결서 작성 실무를 개선하기 위한 실천적 방안으로 항소법원의 상고이유 검토 및 의견제시, 소수의 사건에 대한 예외적 심리 속행, 심리불속행 이유의 예외적 설시를 제안하였다

The final written judgment rendered by the highest court is not only of importance to the litigants as an ultimate conclusion of the case, but of symbolic significance that reflects the tradition, history and current state of the judicial system, the status and authority of the highest court, and legal consciousness and confidence in the judiciary of the public. This paper looks into the method of judgment writing in civil cases of Cour de Cassation(France), Bundesgerichtshof(Germany) and Supreme Court of Japan reviewing the actual written judgments thereof, and thereby draws concrete and practical suggestions to improve the method of judgment writing of the Supreme Court of Korea as well as the Korean final appeal system.
The practice of judgment writing of the highest court in each country is closely related to the factors such as the status of the highest court in the judicial system, the adoption and content of restrictions on final appeals, the size and personnel composition of the judicial panel in the highest court, and the size and role of trial assistants. Thus, those factors are first examined within the scope of the subject of this paper. Next, this paper reviews the actual written judgments in civil cases of respective highest courts and identifies the unique characteristics of the judgments and the reasons why such characteristics have been formed. In addition, this paper examines the correlation between the workload of the judges in the highest court and the method of judgment writing by going through the caseload statistics of the highest court.
In so doing, this paper figures out that the highest courts of France, Germany and Japan each retains special characteristics which are clearly distinguished from those of other countries, and those characteristics are deeply correlated with the judicial system, the final appeal system, the judicial tradition, and the training of legal professionals in each country. Based on the examination, in terms of practical measures to improve the method of judgment writing of the Supreme Court of Korea, this paper makes a number of practical suggestions, such as review of grounds for the final appeal and presentation of opinion thereto by the court of appeal, continuance of trial on an exceptional basis, and explanation of reasons for discontinuance of the trial provided on exceptional grounds.
