No forensic evidence proves all the facts. So do fingerprints and DNA evidence, which have strong evidential value in forensic science area. These evidences have more solid power when interpreted together with other evidence. Through holistic interpretation, the fact that we found comes closer to the truth.
The features observed in fingerprints have been used as evidence without question for over a hundred years on the premise that they are very unique and persist a lifetime. If two whole different fingerprints are examined, the chance of accidentally having the same characteristics and fusion arrangement converge at zero. However, most of the fingerprints left on the scene have been partially or distorted. It has never been proven that the fingerprints left in part or distorted are unique. Forensic scientists are discussing the reliability and validity of fingerprint examination. Through continuous research, forensic scientists are trying to make fingerprint examination methodology scientifically.
The question “Is the fingerprint examination result reliable forensic evidence?” is the starting point of this study, and the author followed the footsteps left by the fingerprint community to answer these questions.
The reliability of fingerprint examination result has been accepted in the court where fingerprint evidence has been an issue, and based on this, fingerprint evidence has solidified legal stability so far. On the other hand, scientists believe that it is difficult to regard it as science because the reproducibility, reliability and feasibility of fingerprinting have not been properly verified.
This study reviews the validity and reliability of fingerprint evidence through surveying literatures and theoretically and practically examines ACE-V, which is fingerprint examination methodology. This study suggested countermeasures.
In Korea, the number of feature points needed to determine that two fingerprint images have the same origin should be 12. This numerical standard is strict compared to other countries. According to this standard, no error in fingerprint identification has been reported in South Korea so far. However, the empirical fact does not guarantee that such an identification error will not happen in the future. For now, it is most desirable to jump on the bandwagon to ensure the accuracy of fingerprint examination results by making the methods as scientific as possible.
Most importantly, the expertise of the fingerprint examiners should be strengthened. This requires continuous professional education and training programs and a strict certification system.
Next, it is necessary to develop the ability of the fingerprint examiners to testify, to provide the basis for the results they have determined in court, and to improve their examination reports and reporting methods so that they can explain the degree of certainty of the decision.
Finally, financial support is needed. Through this, academics can carry out probabilistic studies to verify the reliability of fingerprint examination or to scientifically explain the results of fingerprint examination, and fingerprint examiners can be provided continuous education.
The ability to interpret the source of fingerprint evidence is more important. The better fingerprint examiner interprets, the higher the evidential value.
Even without mentioning the history of fingerprint, fingerprint evidence is used as generally accepted evidence. But there is always the possibility of errors occurring in the process of fingerprint examination. Rather than not being able to exist the same two fingerprints in the world, it would be more appropriate to apply a methodology that minimizes the possibility of errors in determining whether the fingerprints originated from someone's fingers. This is why we should continue to study scientific methodologies and make efforts to verify their validity, instead of claiming that we are 100 percent sure of fingerprint examination.
This study expects that further studies follow and fingerprint examination in South Korea gets more reliable.
어떤 법과학 증거도 모든 사실을 전적으로 증명해주지 않는다. 강력한 개인식별 수단으로 인식된 지문이나 DNA도 마찬가지다. 이러한 증거들은 다른 증거들과 함께 해석될 때 더 견고한 힘을 갖게 된다. 그리고 그렇게 알아낸 사실은 진실에 가까워진다.
지문에서 관찰되는 특징은 매우 독특하고 평생 지속한다는 전제하에 100여 년이 넘는 긴 시간 동안 의문 없이 증거로 사용되어왔다. 온전한 두 개의 서로 다른 지문이라면 우연히 같은 특징과 융선 배열을 가질 가능성은 0에 수렴한다. 하지만 현장에 남겨진 지문은 대부분 부분적이거나 왜곡이 발생한 상태이다. 부분적으로 남겨진 지문이 독특하다는 것은 증명된 적이 없다. 외국에서는 이렇듯 부분적이거나 왜곡이 발생한 상태의 지문을 감정한 결과가 과학적 증거로 사용되기 위해서 갖춰야 할 자격에 대해 활발한 논의를 하고 있고, 지속적인 연구를 통해 지문 감정 방법론에 과학성을 채워 넣는 노력을 하고 있다.
“지문 감정 결과는 믿을 수 있는 법과학 증거인가?”라는 의문이 본 연구의 출발점이며, 이러한 물음에 응답하기 위해 법과학계가 지금까지 지나온 발자취를 따라가 보았다. 지문 증거가 쟁점이 되었던 판결에서 지문 감정 결과의 신뢰성은 받아들여졌으며, 이를 바탕으로 지문은 지금까지 법적 안정성을 견고하게 다져왔다. 반면 과학성을 매우 엄격하게 따지는 일부 과학자들은 지문 감정의 재현가능성(reproducibility), 신뢰성(reliability), 타당성(validity) 검증이 제대로 이루어지지 못했기 때문에 과학이라고 보기 어렵다는 견해를 갖고 있다.
먼저 본 연구에서는 지문 감정의 타당성과 신뢰성을 고찰해보고 지문 감정 방법론인 ACE-V를 이론적·실무적으로 정립한 후, 우리나라에서도 발생할 수 있는 지문 증거에 대한 도전을 극복할 방안과 지문 감정 제도를 더 견고하게 만드는 데 필요한 제도적 개선방안에 대해 제언하고자 하였다.
우리나라는 지문 일치 판정을 하는데 특징점이 최소 12개가 일치해야 한다는 수량적 기준을 사용해오고 있으며, 이 기준은 다른 나라와 비교하면 매우 엄격한 기준이다. 이러한 기준을 택하고 있는 덕분에 우리나라에서는 지금까지 한 번도 오류 사례가 보고된 적 없이 지문 증거를 안전하게 사용해올 수 있었다. 그러나 지금까지 오류가 없었다는 경험적 사실이 앞으로도 그러한 일이 없으리라는 것을 보장해주는 것은 아니다.
외국의 지문 연구자들이 감정 방법을 최대한 과학적으로 하여 지문 감정 결과의 정확성을 확보하고 신뢰할 수 있는 증거로 사용하려는 노력에 우리도 동참할 필요가 있다. 지문 감정 제도를 완전히 뒤집는 방식의 개선보다는 지금의 것을 안정적으로 유지하면서 부족한 부분을 채워나가는 방법을 사용하는 것이 바람직하다.
본 연구에서 검토한 다양한 지문 관련 연구 및 보고서와 판례를 토대로 우리나라 지문 감정의 증거가치를 강화하는 방안은 다음과 같다.
무엇보다 가장 중요한 것은 지문을 다루는 사람의 전문성이 강화되어야 한다. 이를 위해서는 지속적인 전문 교육 및 훈련 프로그램과 엄격한 자격인증제도가 마련되어야 한다.
다음으로는 감정관들의 증언 능력을 키워서 법정에서 자신이 판정한 결과에 대한 근거를 제시하고, 그 결정의 확실성의 정도를 설명할 수 있도록 감정 보고서와 보고방식을 개선해야 한다.
마지막으로, 충분한 재정적 지원이 이루어져야 한다. 이를 통해 학계에서는 지문의 신뢰성 확보를 위한 연구나 지문 감정 결과를 과학적으로 설명하기 위한 확률적 연구를 수행할 수 있으며 실무에서는 지문 감정관에게 지속적인 교육을 제공할 수 있고, 지문 감정관의 역량에 영향을 미치는 요인을 파악할 수 있다.
법과학적 증거 중에서 가장 안정적으로 사용되어온 지문의 역사를 언급하지 않더라도 지문은 일반적으로 승인된 신뢰할 수 있는 증거로 사용되고 있다. 증거와 증명방법이 과학적인가를 판단하는 어떤 기준에 비추어보더라도 지문 감정 결과는 법정에서 충분히 수용되는 증거임에는 이론(異論)의 여지가 없다. 하지만 감정 과정에서 일어날 수 있는 오류의 가능성은 언제나 존재한다. 지문증거에 대한 질문으로는 “이 세상에 똑같은 두 개의 지문은 존재할 수 없는가?”보다는 “이 지문이 누군가의 손가락에서 유래된 것임을 결정하는 과정에서 오류의 가능성을 최소화하는 방법론을 적용했는가?”가 더 적절할 것이다. 우리가 지문 감정을 100% 확신한다는 주장을 하는 대신 과학적 방법론을 지속적으로 연구하고 그 타당성을 검증하는 노력을 해야 하는 이유가 여기에 있다.
지문은 현출 및 증강에서 끝나는 것이 아니라 이 지문이 왜 그 사람의 것인지를 해석할 수 있는 능력이 더 중요하다. 지문이 갖는 의미를 해석하고 그것이 언어로 표현되어야 증거로서의 가치를 갖게 된다. 그러한 점에서 본 연구가 토대가 되어 지문 감정과 관련된 후속 연구가 활발하게 진행되기를 바란다.
