中國의 腐敗犯罪와 國家發展 = The Prevention and Punishment of Bribery and Corruption for National Development in China

다국어 초록 (Multilingual Abstract)

Corruption is not only common, pervasive and social phenomenon of most countries including China in the world, but also it is difficult to define the concrete conception because there are many different standard and much divided culture.
Nevertheless, some countries have high national income and their people enjoy good welfare, on the other hand, some countries have low national income and their people suffer lack of basic living essentials. It is very much related to its government and officials.
China has very long history of corruption crime including bribery. Recently chinese president Hu Jin-tao emphasized on the policy of anti-corruption like severe punishment, supervising central division of chinese government, surveillance from the people for protecting the interests of the public and the national development.
Especially the reconstruct of anti-corruption legislation is basic approach to prevent bribery and corruption in respond to the demand of United Nations Convention against corruption, some detailed provisons about public institution and concept of legal term in the Chapter 201 PREVENTION OF BRIBERY ORDINANCE from Hong Kong can be considered.
Custom and Culture is very much difficult to change people affected by those in short period time, but the transparency of government and government-related business is crucial to credibility and stability from the people in the country because it is directly connected to national development.
The crime of corruption has the difficulty of discovery, investigation caused by external pressure, taking of evidence, absence of the system of trial by default, international judicial assistance for confiscation.
In dealing with these problem, It is necessary to establish independent organ, system for investigation, witness exemption system. Furthermore it is demanded to prepare procedure for trans-national co-investigation and property recovery through convention, the system of inspection etc.
In addition, China has a plan to abolish death penalty for nonviolent crime including corruption and bribery by 2050. I hope that the plan is put forward earlier through successful anti-corruption strategy and action.
