In this knowledge-information-based society, intellectual property has emerged as a source of added value in international trade. In other words, the economic value of intellectual property rights (IPR) has increased. Recognizing IPR as a core element of creating national wealth, countries around the world are finding ways of reinforcing protection of IPR, such as recognizing intellectual property and promoting its use.
Under the circumstances, there is a growing interest in traditional knowledge, which remained out of protection, because it is commercialized and used as intellectual property by Western industries. Traditional knowledge, which covers all inherited knowledge, includes traditional medicine, food, and arts. There is renewed interest in the economic value of traditional knowledge, and its commercialization has been increasingly successful. Behind this trend, however, lies misuse and abuse of traditional knowledge by Western industries who do not seek consent from natives with traditional knowledge.
As a result, the personality and identity of traditional knowledge holders is undermined, and they are ignored in the cultural and religious aspects. Moreover, a problem has emerged in that Western industries refuse to share profits created by the commercial use of traditional knowledge. Owing to advances in IT technology and international trade, the rights of traditional knowledge holders have been violated. This problem is not limited to a single country but is an international issue. India, for instance, has used an ingredient from the Neem tree for home remedies. However, a US pharmaceutical company acquired an international patent using this method, which eventually ended in patent cancellation due to protests by the Indian government. As the traditional knowledge or of a country become more and more commercially used, developing countries with such knowledge are demanding a firm establishment of international norms under which relevant profits are shared. To discuss international legal protection of traditional knowledge and mediate conflicts of interest between advanced countries (the powerhouses of technological innovation) and developing countries (the genetic resources holders), WIPO established an intergovernmental committee in 2000. Since 2001, the committee has held conferences, up until December 2012 (when the 22nd conference was hosted). The process of past conferences can be summed up in four stages. The first five conferences, in Stage1, emphasized the importance of developing a toolkit with which to document traditional knowledge. To this end, countries directly involved agreed on a measure that includes traditional knowledge in searchable prior technology-an establishment of DB. They agreed on the need to unify natives’various languages that are used in the toolkit to a single language. However, all parties could not come to an agreement, as the developing countries insisted on stronger protection through a sui generis system. In the sixth to tenth conferences, in Stage 2, developing countries demanded legally binding international norms(e.g.,reorganizing legislation in each country while establishing DB). In contrast, advanced countries argued that it was premature to discuss norms, and that the purpose of traditional knowledge protection and consensus on principles should be first discussed. In the eleventh to nineteenth conferences, in Stage 3, both sides addressed ten issues proposed in the tenth conference. From the nineteenth to the present conference, in Stage 4, they created the unified draft on traditional knowledge, genetic resources and traditional cultural expressions. Still, both sides are failing to find common ground. Developing countries such as India and Brazil are strongly demanding protection of traditional knowledge and the introduction of a sui generis system, a legally binding system of its own. Although advanced countries such as the US and Japan agree on the basic concept of traditional knowledge protection, they argue that the knowledge should be protected within the frame of existing intellectual property. Korea, with relatively less genetic resources and traditional knowledge, takes the same position as the advanced countries in the WIPO intergovernmental committee. This study aims to clarify the concept of traditional knowledge, and examine its scope. That is because definition of traditional knowledge is closely connected to what is the protection directed to and the scope of the protection. This study will identify patent-related problems with the existing IPR system by analyzing the trend of international discussions and the WIPO protection system. Also, it aims to present a defensive measure that sticks to the existing IPR protection system and a more aggressive measure (four models) that is proposed by the new system of its own. Although some traditional knowledge and intangible cultural assets can be protected by the existing IPR protection system, it is insufficient to meet all demands and expectations. For this reason, it is desirable to take various approaches to protecting traditional knowledge, because such protection cannot be achieved by one legal system alone, but by a flexible response to the characteristics of each ethnic group and culture. Under the circumstances, Korea needs to review relevant IPR law that is in accord with international discussions, in order to prepare for possible enactment of international law on the sharing profits from genetic resources, and protection of traditional knowledge. Particularly, the country should continuously work on a DB establishment of traditional knowledge so as to meet requirements of PCT minimum documentation. Moreover, Korea should not remain passive, saying that it does not contain sufficient genetic resources and traditional knowledge. 지식정보화 시대를 살아가는 요즘, 지식재산은 세계 무역 경제에 있어서 부가가치의 원천으로 부상하고 있다. 다시 말해, 지식재산권의 경제적 가치가 더욱 커지고 있다. 이에 따라 세계 각국은 지식재산권을 국부창출의 핵심요소로 인식하여 지식재산 창출 및 활용촉진 등 지식재산권 보호를 대폭 강화하고 있다. 이러한 가운데 지금까지 지식재산권의 사각지대에 놓여 보호되지 않던 전통지식이 서구산업계에 의해 이용되어 상업화가 되고 지식재산권화 되면서 전통지식에 대한 관심이 증가하고 있다. 전통지식이란, 전통적으로 계승되어온 모든 지식을 총망라하는 개념으로서 전통의약, 전통식품, 전통예술 등을 포함한다. 전통지식의 경제적 가치의 재발견과 상업화 성공사례의 증가는 전통지식에 대한 관심과 상업화를 활발하게 추진시키고 있지만, 그 이면에는 서구산업계가 전통지식을 보유한 개인 또는 토착민의 동의를 얻지 않고 무분별한 전통지식의 사용과 오·남용을 하고 있었던 것이다. 그로인해 전통지식 보유자들의 인격 및 정체성이 훼손되고, 문화적·종교적으로도 무시당하고 있다. 그리고 서구산업계가 전통지식의 상업적 사용으로 인해 창출된 이익을 공유하지 않아 문제가 되고 있다. 정보통신기술의 발달과 국제무역의 활성화로 인하여 전통지식의 보유자들의 권리와 이익이 침해되는 문제는 단순히 한 국가 내에서 뿐만이 아니라 여러 나라에 걸쳐 발생하는 국제적인 문제로 확산되어 가고 있다. 예를 들면, 인도에서 민간요법으로 Neem 나무에서 추출한 성분을 약제로 활용하여 왔음에도 불구하고, 미국의 한 제약회사가 이를 이용한 국제특허를 취득하였다. 하지만 인도 정부의 노력으로 그 특허는 취소가 된 사례가 있다. 이처럼 특정 국가의 전통지식이나 유전자원을 상업적으로 활용하는 사례가 많아지게 됨에 따라, 전통지식을 보유한 개발도상국들은 전통지식이나 유전자원의 활용과 관련한 이익을 공유하는 국제적인 규범의 확립을 요구하고 있다. 이에 기술 혁신 강국(선진국)과 전통지식 및 유전자원 보유 강국(개발도상국) 간에 이를 둘러싼 이해관계 조정과 전통지식의 국제적 법적 보호 논의를 위하여 2000년 세계지식재산권기구WIPO에서 정부간위원회를 설치하여 2001년부터 2012년 12월 22차 회의까지 계속 회의를 진행하고 있다. 지금까지 회의의 과정을 간단히 4단계로 요약된다. 1단계는 1차부터 5차 회의이며, 전통지식을 검색 가능한 선행기술에 포함시킬 수 있는 방안, 즉 DB구축을 하자는 데에 양자가 합의를 한 것이다. 그 내용은 전통 지식의 문헌화를 위한 툴킷Toolkit 개발의 중요성을 강조하고, 그 툴킷에 사용되는 원주민의 다양한 언어를 단순한 하나의 언어의 필요성을 강조하였다. 하지만 개발도상국은 추가로 독자적 제도sui generis system을 통한 적극적 보호 방안을 주장하여 여전히 대립점이 남아 있었다. 2단계는 6차부터 10차 회의이다. 이 단계는 합의된 사항에 대한 개발도상국과 선진국의 입장차가 드러났다. 곧 개발도상국은 DB구축을 실행화하면서 각 국가별 독자적 법령을 정비하는 등 법적 구속력을 갖는 국제 규범의 논의 진행을 주장하였다. 반면 선진국은 실질적인 규정의 논의는 시기상조이며 전통지식 보호의 목적 및 원칙 합의 도출이 우선시 돼야한다고 주장하였다. 3단계는 11차부터 19차 회의이며, 10차 회의에서 상정된 10가지 이슈를 규정하고 문안 협상을 진행하였지만 양자의 충돌은 계속되었다. 4단계는 20차 회의부터 현재까지의 전통지식, 유전자원, 전통문화표현물에 대한 문안을 단일화했다. 하지만 여전히 양자간의 합의점을 찾지 못하고 있다. 즉 개발도상국에 해당되는 인도, 브라질 등은 전통지식의 보호를 강력히 주장하며, 구속력있는 새로운 독자적 제도sui generis system의 도입을 주장하고 있다. 반면 선진국에 해당되는 미국, 일본 등은 전통지식을 보호한다는 기본 취지에는 동의하나 기존 지식재산권의 틀을 벗어나지 않는 범위 내에서 보호되어야 한다는 입장이다. 우리나라는 유전자원 및 전통지식이 상대적으로 풍부하지 않기 때문에, 현재까지는 WIPO 정부간위원회에서 개발도상국의 입장보다는 선진국과 입장을 같이 하고 있는 상황이다. 본고는 먼저, 전통지식과 무형문화유산의 지식재산권 보호를 하는데 있어서 전통지식의 개념 정립 및 범위를 살펴보았다. 전통지식의 개념 정의는 지식재산권 제도의 보호 대상과 범위 문제와 밀접하게 연관되어 있기 때문이다. 이에 대한 국제적 논의 동향 및 보호제도를 분석하기 위해 WIPO 회의의 진행 추이와 현행 지식재산권 제도의 특허요건이 가지는 문제점을 밝히고, 기존의 지식재산권 제도를 고수하자는 방어적 방안과 새로운 독자적 제도가 제안하는 4가지 모델, 적극적 방안을 제시하였다. 현행 지식재산권 제도는 전통지식과 무형문화유산을 제대로 보호하기 어렵다. 전통지식의 보호는 한 가지의 법체계로 달성될 수 있는 것이 아니라, 각국의 민족과 문화의 특성에 따라 유연하게 대응할 수 있는 것이기 때문에, 다양한 접근법이 인정되는 것이 바람직하다고 생각한다. 이에 우리나라는
