이 논문은 노사간 핵심쟁점으로 부각된 시간급 통상임금과 관련하여 선원법상 월의 소정근로시간의 산정에 관한 해석론적 연구를 통하여 문제의 해결방안을 제시하는 것을 목적으로 한다. 이 논문의 주요 결론은 다음과 같다. 첫째, 노사간 합의 하에 일정한 금액을 시간외근로수당을 지급하는 이른바 포괄임금제가 실시되고 있으나, 본래 포괄임금제의 취지나 목적에 부합되게 운용되지 못한 사례가 많았던 것으로 보인다. 만약 실제로 발생한 시간외근로시간에 비하여 일정액을 시간외근로수당으로 지급하는 제도상의 시간외근로시간이 현저하게 적다면 이는 유효한 것으로 인정될 수 없을 것이다. 둘째, 기존의 학설이 휴일에 대한 명시적 규정의 삭제를 선원에게 부여되었던 유급휴일이 없어진 것으로 보고 있는 점에 대하여 법률상 명시적 규정이 없을 경우에도 해석론을 통하여 법률이 의도하는 바를 보충하여 선원에게 부여되고 있는 휴일이 무급인지 유급인지를 밝힐 필요가 있다고 보았다. 셋째, 선원법의 연혁적 검토 결과 종전 선원법 제128조에 따라 준용되었던 근로기준법상의 주 1일 유급휴일은 1984년 선원법의 개정으로 누락되었으나, 당시 선원법이나 그 후의 법령상 임금의 하향이 없었으므로 개정 선원법에도 계수되었다고 봄이 타당하다. 넷째, 1일 8시간, 1주 40시간 근로제 검토 결과 1일 8시간 월요일부터 금요일까지 근로한 경우 주 2일의 주휴일이 부여된다는 의미하며, 주 2일의 휴일 중 1일은 유급휴일이 되고, 나머지 휴일은 당사자의 약정에 따라 유급 또는 무급의 휴일이 된다. 선원법의 경우, 동법 제71조에 따라 공휴일인 일요일을 유급휴일로 보는 것이 타당할 것이며, 선원법상 토요일은 당사자 간의 약정휴일에 해당하고 당사자가 유급휴일로 한다는 특약이 없는 한 무급휴일이 된다고 보아야 한다. 다섯째, 공휴일의 무급 또는 유급 여부 검토 결과 우리 선원법이 유급휴가에 포함된 공휴일은 유급휴가 사용일수에 포함하지 하도록 하여 이를 추가하여 휴가를 부여하도록 하고 전체 기간에 대하여 유급휴가급을 지급하도록 명시하고 있는 것에서 공휴일 등은 무급휴일이 아니라 유급휴일임이 명확하게 드러난다고 할 수 있다. 여섯째, 선원법상 월의 소정근로시간수는 월의 소정근로일수에 1일의 소정근로시간을 곱한 시간으로 명정하고 있다. 따라서, 월의 소정근로일수는 주당근로일수 6일[(주40시간 ÷ 8시간/일) + 주휴1일]에 1년의 주수(52.142주)를 곱하고 그 값을 12월로 나누어서 계산하여야 하는 바, 그 결과는 26.07로 계산된다. 여기에 1일의 소정근로시간(8시간)을 곱하면 약 209시간으로 산정된다. 이 논문에서 연구한 내용이 노사간 큰 쟁점으로 부각된 월의 소정근로시간수와 포괄임금제와 관련한 우리 선원법에 대한 노사정의 이해를 증진하고 나아가 노사간에 타협과 협상을 통하여 해결을 하는데 있어 일조할 수 있기를 기대한다.
더보기This paper intends to suggest a resolution of crucial issues through making interpretative study on the calculation of monthly standard hours under the Seafarers`` Act in relation to monthly ordinary wages which has recently been raised as a key issue. The main results of this study are as follows. First, the comprehensive wage system in which fixed amount of money is paid as overtime allowances under a collective bargaining agreement between social partners has been widely applied. However, it is considered that there have been many cases where the system has not been operated in a way to commensurate with its intent or purpose. It would not be acceptable to be valid if the fixed overtime hours are remarkably less than those of actual overtime working hours. Second, against the existing theory in which the deletion of the express provisions of a day off per week was regarded as elimination of paid day off having been granted to seafarers, the author considers that even if the express provisions are not provided in the Seafarers`` Act, it is necessary to reveal whether the day off per week granted to seafarers is paid or unpaid by supplementing the intent of the Seafarers`` Act through making interpretative study. Third, as a result of historical study on the Seafarers`` Act, a paid day off per week under the Labour Standard Act which was made applicable mutatis mutandis to seafarers by the Article 128 of the past Seafarers`` Act was deleted by the amendment to the Act in 1984 but it is resonable to say that the paid day off per week was impliedly remained and embodied in the amended Act since seafarers`` wages was not reduced under the then and thereafter Seafarers`` Act. Fourth, as a result of study on the system of 8 hours per day and 40 hours per week, 2 days off per week would be granted to the seafarers when they have worked 8 hours day from Monday to Friday. Of 2 days off per week, 1 day is paid and the rest day would be either paid or unpaid according to the contract concluded by both parties. In case of the Seafarers`` Act, it is resonable to say that Sunday as a public holiday is the paid day off under the Article 71 of the same Act and Saturday is the day off under the contract of both parties and should be regarded as unpaid day off unless they expressly concluded it as paid day off. Fifth, as a result of study on whether public holidays are paid or unpaid, one can say that it becomes apparent that the public holidays, etc. are not unpaid but paid days considering the fact that the relevant provisions stipulate the public holidays included in paid leave shall not be counted as used paid leave and be added up to the original paid leave and the total leave period shall be paid. Sixth, the Seafarers`` Act expressly stipulates that the monthly standard hours is monthly standard days times daily standard hours. Thus, monthly standard hours is weekly working days - 6 days[(40 hours week ÷ 8 hours day) + a day off per week] times the average number of weeks of 1 year(52.142) and then the value of this multiplication is to be divided by 12 months in which case the result is calculated as 26.07. Again if the value is to be multiplied by daily standard hours(8 hours) then about 209 hours can be obtained. It is hoped that this study would contribute to promote better understanding of seafarers, shipowners and Government about the Seafarers`` Act in relation to monthly ordinary wages and the comprehensive wage system which have recently been raised as major issues between social partners and moreover to help them to resolve the issues through compromising and negotiating between them.
