韓國政黨의 立法機能에 關한 硏究 : With Special Reference to the Legislatives of the Ruling and Opposition Parties 與ㆍ野黨의 立法活動을 中心으로 = A Study of the Legislative Function of the Korean Political Parties

다국어 초록 (Multilingual Abstract)

The function of a politcal party ofa free democratic state has two aspects, one of the activities within the Assembly and the other of the activities outside the Assembly. Besides the role of check and balance, the legislative activities are an especially important part of the function that a political party should perform on the floor, for legislation belongs to the peculiar function of the Assembly, which consists of members of ruling and opposition parties.
It does not, however, follow that the roles played by the opposing parties are identical, and it can be, therefore, assumed that there will be a difference in legislative performance between the majority and minority parties. The aim of this thesis is to find the difference between the two in respect to their performance of legislative function, by studying the legislative resorts of the National Assembly ranging from the third to tenth sessions.
The total number of the bills introduced to the Assembly during the period is 3,121, of which 16 percent was introduced by the ruling parties and 14 percent by the opposition parties. This shows that there is little difference between opposing parties as to their bill-introducing activities themselves. A big difference is, however, found in the actual passage ratio, which is 11 to 3 in favor of the ruling party.
It is thus revealed that the legislative activities of the Korean political parties were neither well balanced nor very effective, and it follows from this that complete public opinion was not gathered to be matcrialized in legislation
The findings of this study make it clear that the National Assembly, as the representa-tive body of the people, should move toward an effective operation of the principle of majority decision by switching from the rule of majority of number to the rule of 'majority of quality.'
