In 1980s, it is expected that the most appropriate country for foreign investment in ASIA is Korea.
However each overseas films will have to devise effective strategies to establish and maintain successful business operations in the complex and often frustrating Korean environment.
Korean government has pursued an “open door” policy for foreign investment in recent years.
As clearly stated in the Foreign Capital Inducement Act(FCIA), the Government`s fundamental policy regarding foreign capital is “to effectively induce and protect foreign capital conducive to the sound development of the national economy and the improvement of the international balance of payments, and to properly manage such foreign capital.”
Based on this policy, the Government has aimed to further open the door to foreign countries who intend to invest in Korea.
Foreign investment has been and will continue to be vital to the Korean economy in that it contributes not only to the promotion of economic cooperation with foreign countries but also to the strengthening of the international competitiveness of the nation`s industries and to the inducement of advanced technology.
Recently, a wide variety of policy measures have been taken to actively induce foreign investment to protect foreign-invested enterprises, and to facilitate the smooth operation of foreign-invested enterprises.
Various incentives and guarantees are included in these measures, such as tax benefits and guarantees on the remittances of dividends and principal.
In addition, the Government has newly introduced an automatic approval system and moved to a negative list system through revision of the FCIA and other related regulations, effective from July 1, 1984.
With the implementation of such a system, the range of projects eligible for foreign investment has become substantially widened and the authorization procedure for some projects has become further simplified.
As part of its ongoing effort to actively induce foreign investment, the Government has recently eased the restritions on foreign investment through revision of the related regulations.
The highlights of the revision, as mentioned above, are the introduction of an automatic approval system and the shift to a negative list system.
Under the automatic approval system, investment projects meeting certain conditions are to be immediately and automatically approved by the Minister of Finance.
In addition, where as the previous positive list system specified projects eligible for foreign investment, the current negative list system specifies prohibited or restricted projects, thus allowing all subjects that do not appear on the negative list.
The foreign investment ratio is, in principle, determined according to the agreement between a foreign investor and his Korean partner.
A foreign investment with the ratio less than 50% can be approved immediately if the rest of conditions for automatic approval are met, while approval is subject to review in case the ratio is 50% or more.
Based on the experiences of foreign companies already operating in Korea, this study identifies the opportunities and problems that confront joint venture in Korea.
