가족돌봄 등을 위한 근로시간 단축제도 개선방안 연구 — 근로시간 단축 허용 사유에 관한 논의를 중심으로 —

「남녀고용평등과 일・가정 양립 지원에 관한 법률」 제22조의3에 따른 가족돌봄 등을 위한 근로시간 단축제도는 근로자에게 근로의 시간을 자신의 필요에 따라 단축할 수 있는 권리를 부여한다. 이로써 사용자가 일방적으로 결정하는 근로시간제도에서 벗어나, 근로시간에 관한 한 일정한 범위 내이기는 하지만 근로자의 주도권을 인정하게 되었다는 점에서 그 의의가 있다. 이에 따라 근로자는 가족돌봄, 학업, 건강 그리고 은퇴준비에 이르기까지 생애주기에 따라 단기간 근로시간을 단축할 수 있다. 가족 돌봄 등 근로시간 단축제도는 종래 규격적이고 획일적인 전일제 근로 관행이 초래한 다양한 문제점을 해소할 것으로 기대된다. 무엇보다도 일・가정양립과 장시간 근로 관행의 개선을 위한 제도적 장치로 평가된다. 현재로서는 가족돌봄 등 근로시간 단축 사유를 가족돌봄・ 본인건강・은퇴준비・학업 4가지로 정하고 있지만, 이는 향후 ‘보편적인 근로시간 단축 청구권’ 형태로의 개편을 향한 초기적 제도체계로 파악된다. 그럼에도 불구하고 가족돌봄 등 근로시간 단축 사용을 위한 허용 사유들을 둘러싸고 많은 법리적・실무적 논쟁이 남아 있다. 단축 사용이 어려운 근무유형이나 업종별 특성도 있음을 부인할 수 없는 현실을 감안할 때 개별 단축 사유의 추후 수정과 보완이 시급해 보인다. 나아가 이 제도의 장점에도 불구하고 여전히 근로자와 사용자 모두 상당한 부담을 가질 수밖에 없다. 사용자는 대체인력 운용의 어려움을 호소하고 있으며, 근로자들은 임금감소에 대한 부담감을 가질 수밖에 없다. 특히 소규모 사업장의 경우, 임금 민감도가 상대적으로 높고 인력 조달의 어려움이 크다. 이러한 점에서 소규모 사업장에서는 가족돌봄 등 근로시간 단축제도를 적용하기에 적지 않은 어려움이 있을 것으로 평가된다. 자칫 가족돌봄 등 근로시간 단축이 근로시간 및 근로자의 근로조건 결정권에 관한 업종・규모별 격차를 심화시킬 우려가 있다. 이를 개선하기 위하여 소규모 사업장 및 취약업종 지원방안 마련이 시급하게 요구된다. 대체인력 충원 문제도 시스템적인 개선이 모색되어야 한다. 가족돌봄 등 근로시간 단축은 변화된 노동환경 및 일・생활 균형에 대한 인식변화를 반영하여 근로자에게 근로시간 결정의 자율권・주도권을 부여하는 제도임을 고려할 때 그 실효성을 높이는 노력은 매우 중요하기 때문이다.
더보기The Reduction of Working Hours for Family Care under the 「EQUAL EMPLOYMENT OPPORTUNITY AND WORK-FAMILY BALANCE ASSISTANCE ACT」grants workers the right to request a reduction of working hours. This should be distinguished from the standardized working hours system where the employer unilaterally sets working hours. Reduction of working hours for family Care is a system that gives individual workers the right to request a temporary reduction in working hours according to their needs of the stage in their life cycle. The newly enacted system of granting a reduction of working hours for Family Care is expected to reduce the burden of full-time work borne by workers and address the issue of long working hours. Under the Korea’s current law, reasons for a reduction of working hours are confined to family care, personal health issues, preparation for retirement, the pursuit of academic studies. In the future, the right to request a reduction of working hours is expected to improve and develop into a universal right to claim reduced working hours. A review of the survey and previous studies on actual usage of the right to request a reduction of working hours finds that among the use cases, “family care” was the most common reason for requesting a reduction of working hours while personal health issues, preparation for retirement, and the pursuit of academic studies accounted for much fewer cases. Analyzing the cases of applying for a reduction of working hours, it has been confirmed that there exist employment types or industries where workers find it difficult to use the right of requesting a reduction of working hours, and that revising and supplementing grounds and reasons for requesting reduced working hours was needed. Employers generally expressed that they face a difficulty in hiring and managing alternative human resources to fill the gaps caused by reduced working hours, and workers expressed worries about wage cuts. In particular, small businesses have challenges in implementing the workers’ right to request a reduction of working hours for reasons such as caring family members. Therefore, there are concerns that the system of a reduction of working hours could potentially widen the gaps in working conditions which vary by industry and size of the business. In order to address this issue, it is necessary to reorganize the system and discover new reasons to be accepted to allow reduced working hours that are suitable for the circumstances of each workplace. In particular, there is a need for measures to support small businesses and vulnerable industries. Also, the need for enough resources to substitute for the workers who have reduced their working hours for reasons like family care should be addressed urgently. Reduction of working hours guaranteed by Equal Employment Opportunity And Work-Family Balance Assistance Act can be evaluated as a system that gives workers the autonomy and initiative in determining working hours, in consideration of the changes in working environments and changes in the perception of the balance between work and life. In order for this system to be successfully implemented, proactive efforts need to be made after the system is applied to workplaces with 30 or more employees on January 1, 2021.
