이 논문은 최근 한국의 사회복지공간에서 나타난 종교자유의 정치학을 미국과비교하면서 살피는 것을 목적으로 한다. 1990년대 이후 미국에서는 신앙기반복지정책의 도입을 계기로 종교자유를 둘러싸고 열띤 논쟁이 전개되었다. 이때 핵심 쟁점은 사회복지시설 직원의 채용 문제였다. 보수 개신교 진영은 국가의 재정지원을 받는 사회복지시설에서 직원 채용시 종교를 심사기준으로 삼는 것은 정당한 권리라고 주장하였다. 이는 기관의 정체성 유지를 위해 필수불가결한 조치라는 논리였다. 반면 인권운동 진영은 이러한 채용 원칙을 명백한 종교차별로 규정하였다. 사회복지시설이 국가의 기금을 받으면 공공재가 된다는 논리에 근거한것이다. 요컨대 사회복지시설을 운영하고자 하는 신앙기반단체들은 국가의 지원을 포기하고 자기 종교의 신자만 채용하든지 국가 지원을 받고 모든 자격자에게문호를 개방하든지 양자택일을 해야 한다는 논리였다.
한국에서는 2008년 사회복지사업법 개정안 발의를 계기로 사회복지시설 종사자의 종교자유와 종교차별 문제가 쟁점으로 부상하였다. 이 법안은 종교계 사회복지시설에 만연한 종교강요를 예방하고자 하는 취지로 발의되었다. 그런데 보수개신교 진영은 이 법안이 기독교를 탄압하는 법안이라고 반발하였다. 그러면서기독교의 사회복지시설이 종사자의 종교자유를 침해하는 것이 아니라 오히려이 법안이 기독교의 종교자유를 침해한다는 논리를 펼쳤다. 사회복지시설의 직원채용 및 해고와 관련해서는 미국 보수 개신교 진영의 논리와 미국의 판례를 활용하였다. 그런데 한국 개신교 보수 진영은 자신들이 운영하는 사회복지시설이 국가의 지원을 받고 있다는 사실을 은폐하는 경향이 있다. 한편 인권운동 진영은사회복지공간에서의 종교강요를 ‘종교적 적폐’로 규정하고 종교자유가 인류의보편적 가치임을 역설했다. 사회복지기관의 종교와 동일한 신앙을 지닌 자만 직원으로 채용하는 것에 대해서도 명백한 종교차별로 간주하면서 사회복지공간의공공성을 강조했다.
이처럼 최근 미국과 한국의 사회복지공간에서는 종교자유를 둘러싸고 치열한논쟁이 벌어지고 있지만 종교집단의 자유가 개인의 종교자유를 압도하고 있다는인상을 준다. 역사적으로 종교의 자유는 국가권력과 종교권력으로부터 개인의양심의 자유를 수호하기 위한 투쟁의 산물로 등장했지만 오늘날은 종교자유가약자의 권리를 보호하기 위한 ‘방패’가 아니라 강자가 약자를 해치는 ‘창’으로존재하고 있는 것으로 보인다. 이는 종교의 자유가 자명한 본질을 가지고 있는것이 아니라 다양한 주체에 의해 전유되고 변주될 수 있음을 의미한다. ‘종교자유의 정치학’에 주목해야 하는 이유다.
This paper aims to explore the politics of religious freedom in the social welfare space in recent Korea by comparison with the case of the United States. Since the 1990s, heated debates have occurred in the United States over religious freedom with the introduction of Faith-Based and Community Initiative(FBCI). At this time, the key issue was recruiting employees for social welfare facilities. The Protestant conservatives argued that it was a legitimate right to staff on a religious basis in social welfare facilities supported by the state. The logic was that this was an indispensable measure to maintain the religious identity of the social welfare facilities. On the other hand, human rights activists regarded religious staffing as religious discrimination. It is based on the logic that social welfare facilities become public goods when they receive state funds. Therefore, according to them, faith-based organizations that want to operate social welfare facilities should give up state support and hire only believers of their religion or open the door to all qualified people with state support.
In Korea, with the proposal for a revision to the Social Welfare Services Act in 2008, the issue of religious freedom and religious discrimination in social welfare facilities emerged as a problem. The bill was proposed to prevent religious coercion prevalent in religious social welfare facilities.
However, the Protestant conservatives protested that this bill aimed to suppress Korean Protestantism. At the same time, they argued that Protestant social welfare facilities do not infringe on social workers' religious freedom, but rather that the bill violates Protestant social welfare facilities’ religious freedom. Regarding the religious staffing in social welfare facilities, the U.S. Protestant conservatives’ strategies and U.S. precedents were used.
However, Korean Protestant conservatives tend to cover up the fact that their social welfare facilities are supported by the state. Meanwhile, human rights activists defined religious coercion in the social welfare space as a “religious deep-rooted evil” and stressed that religious freedom is a universal value of humankind. The religious staffing was also regarded as clear religious discrimination, emphasizing the publicity of social welfare spaces.
As such, there have been fierce debates over religious freedom in social welfare spaces in the United States and Korea. However, but it seems that institutional religious freedom is overwhelming individual religious freedom.
Historically, religious freedom has emerged as a product of a struggle to protect personal freedom of conscience from state power and religious power, but today, religious f reedom seems to exist as a “sword” for the strong to harm the weak, not as a “shield” to protect the weak. This means that religious freedom does not have a self-evident essence, but can be appropriated by various subjects. This is why we should pay attention to the politics of religious freedom.
