인터넷이 발달하면서 이를 통한 저작물의 불법적 배포가 용이한 방법으로 대량으로 이루어지게 되었다. 이에 대해 이러한 인터넷을 통한 저작물의 배포에 관여하는 온라인 서비스 제공자는 저작권 침해 책임과 관련하여 어떤 위치에 서게 되느냐가 문제되었다.
온라인 서비스 제공자는 불법복제물을 인터넷이 올린 가입자가 사업적 관계를 맺고 있으며, 그들의 신원 및 행위를 알 수 있을 뿐만 아니라 불법적 행위를 멈추게 할 수 있는 위치에 있다는 것이 책임을 긍정하는 견해의 이유이다. 반면에 이를 부정하는 견해는 서비스 제공자의 시스템상의 컨텐츠의 양은 이를 모니터하거나 스크린하기에는 너무 방대하고, 서비스 제공자에게 이러한 책임을 지우는 것은 통신과 정보의 이용 가능성을 손상할 뿐만 아니라 서비스 제공자를 사업에서 내몰게 되고 말 것이라는 이유를 들고 있다.
이러한 문제에 대하여 여러 판례를 통해 해결책이 제시되었는데 직접책임, 기여책임 및 대위책임 사이에서 일관된 접근을 보여주지 못했다. 독일의 전자적 정보·통신 서비스법 제5조는 이의 해결을 위해 시도된 최초의 입법이었다. 미국도 Religious Technology Center v. Net com 사건의 판례를 계기로 Digital Millennium Copyright Act에 온라인 저작권 침해 책임제한법을 포함시켜서 입법으로 이를 해결하였다. DMCA는 온라인 서비스 제공자의 서비스를 경과적인 디지털 네트워크 통신, 시스템 캐싱, 이용자가 시스템 또는 네트워크에 저장한 정보, 정보소재 확인 도구 등의 네 가지로 구분하고 각각의 경우에 책임을 제한받을 수 있는 조건을 규정하고 있다. 모든 경우에 반복적인 침해자에 대한 서비스 종결과 표준적인 기술조치의 수용을 공통요건으로 하고, 저작권자 등의 침해통지에 따라 즉시 침해된다고 또는 침해행위의 대상이라고 주장되는 자료를 제거하거나 접근을 불가능하게 하기 위하여 신속하게 대응한 경우에는 책임을 면하는 절차 규정을 두고 있다.
EU의 전자상거래 지침도 이와 관련한 규정을 두고 있는데 온라인 서비스 제공자에게 모니터링 의무가 없음을 명백히 규정하는 반면 DMCA에는 규정되어 있는 정보소재 확인 도구에 대한 규정을 두고 있지 않은 것과 교육기관에 대한 책임 제한을 규정하지 않은 것 등이 단점으로 지적된다.
한편 정보소재 확인 도구 제공자의 책임과 관련하여 링크의 저작권 침해 여부가 문제된다. 링크에 사용된 기술에 따라 단순링크, 직접링크, 프레이밍(Framing), 인라이닝(INlining) 등으로 구분할 수 있는데, 단순링크의 경우에는 링크에 대한 묵시적 승낙이 있다고 볼 수 있는데 반해 직접링크나 특히 프레이밍과 인라이닝에 대해서는 이를 인정하기 어렵고 동일성 유지권의 침해와 전송권(인라이닝의 경우)의 침해 소지가 있다. 불법물에로의 링크인 경우에는, 링크의 제공자가 침해에 대한 실제 지식을 가지고 있거나, 그러한 인식을 하는 즉시 그 자료를 제거하거나 접근을 불가능하게 하기 위해 신속하게 행동하지 않았을 때, 또는 침해행위를 통제할 수 있는 권리와 능력을 가지고 있는 경우 그러한 행위로부터 직접적으로 재정적 편익을 얻었다면 책임을 면제받지 못한다고 규정하고 있는 DMCA 제512조(d)를 통해 해결할 수 있을 것이다.
우리 법상 온라인 서비스 제공자에게 적용될 수 있는 규정으로는 사용자 책임 과 공동불법행위책임 이 있는데, 적용 범위가 한정되고 불명확하여 서비스 제공자의 책임 여부가 불분명하다. 따라서 입법이 요구되는데 최근 문화관광부는 이에 대한 규정을 담은 저작권개정안을 내놓았다.
인터넷 상에서 저작권을 보호하기 위해서는 온라인 서비스 제공자의 책임 제한을 명확히 규정하는 것 외에 기술조치와 저작권관리정보에 대한 보호 및 이를 무력화시키는 행위를 엄격히 처벌하는 규정을 두는 것이 보다 실효성있는 방법이라고 본다.
As internet is widely popularized, a quantity of copyrighted contents on the web have been illegally disseminated without difficulty. The copyright infringement liability of the online service providers for their users' illegal distribution of the copyrighted contents by others is at issue.
The opinion that the online service providers are responsible for the copyright infringement activity conducted by their users is based on the fact that they tied up business partner ship with the users who illegally distributed the contents copyrighted by other s on the internet, knew the users' indemnification and behavior, had power to prevent the users from infringing the copyright. On the other hand, the opposite view is based on the fact that the quantity of the contents in their systems is too large for the providers to monitor completely. In addition, the information and communication industries will be damaged by blaming the online service providers for the copyright infringement activity conducted by their users, and accordingly the online service providers will be urged to give up their business.
Although many precedents were already established to resolve this problem, there is not a clear regulation relating to this problem. They are usually classified into three types as follows ; direct infringement, contributory infringement and vicarious liability. Title 5 of the Information and Communication Services Act in Germany was the first law in association with the copyright infringement liability on the internet. In US, with the precedent of the case of Religious Technology Center v. Net com, the title of Online Copyright Infringement Liability Limitation was added into Digital Millennium Copyright Act (DMCA). According to the DMCA, limitations on liability relating to material online were classified into the four types as follows ; Transitory Digital Network Communications, System Caching, Storage of Information on system or network at direction of users and Information Location Tools. Safe Harbor is regulated in each of this type. All of them include service termination to repeating infringer and accommodation of technical measures. Online service providers shall not be liable for the copyright infringement if the online service providers respond expeditiously to remove, or block access to, the material that is claimed to be infringing upon notification of claimed infringement from the copyright owner.
The regulations in accordance with this are established in E-commerce Directive in EU. While it was clearly regulated that online service providers are not responsible for monitoring their contents, the Information Location tools and Limitation on Liability of Education Institutes, which are included in DMCA, are not added in E-commerce Directive in EU.
In connection with using information location tools, the online service providers linking users to an online location containing infringing material are liable for infringement of copyright. The linking is classified into four types, in terms of the technology used, as follows ; surface link, direct link, framing and inlining. While surface linking reflects implicit authorization, using other types of links is the infringement of right to the integrity of the work. Especially, the inlining is related with the infringement of right of communication to the public. According to the section 512(d) in DMCA, if the online service provider has actual knowledge that the material or activity is infringing, does not acts expeditiously to remove, or block access to, the material even upon obtaining such knowledge or awareness, or receives a financial benefit directly attributable to the infringing activity when the online service provider has the right and ability to control such infringement activity, the online service provider are liable for the copyright infringement.
The regulations in law in Korea, which is applicable to the case of the online service provider at the present time, are 'user liability' and 'common illegal activity liability'. However these regulations are not clear. As a result, Ministry of Culture and Tourism recently proposed revised copyright act relating to the online service provider.
To protect copyright of the contents on the internet, online copyright infringement liability limitation must be regulated in copyright act. In addition, the regulations to protect the copyright management information and to punish the activity infringing this are to be established.
