이 연구는 크게 세 부분으로 구성된다. 첫째, 헌법상 혐오표현의 법적 제한은 ‘표현의 자유’ 기본권과 ‘인간의 존엄성 및 평등’의 기본권이 충돌하는 것에 대하여 헌법상의 기본권 제한 원칙 및 표현의 자유의 특별한 심사원칙으로 균형·조화적인 입법방안을 찾는 문제이다. 따라서 이 연구는 관련된 기본권과 기본권 제한 원칙 및 표현의 자유 심사원칙에 관하여 살펴본다. 둘째, 혐오표현은 인종차별, 미국의독립혁명, 독일의 홀로코스트 등의 역사적 배경에 따라 서양에서 일찍부터 논의된 주제로서 입법 제정 및 폐지 등의 과정을 살펴보는 것은 우리나라 혐오표현 법제를 정비하는데 있어서 큰 틀의 시사점을 발견하게 해주므로 해외 법제 동향을 살펴본다. 셋째, 우리나라 헌법상 표현의 자유 제한 원칙과 해외 법제 동향에 비추어 혐오표현에 관한 법제 정비 방안을 마련하는 것이다.
구체적으로 이 논문에서는 표현의 자유의 기본권과 제한 원칙에 관하여 언론·출판의 자유, 집회·결사의 자유, 온라인상의 표현의 자유, 인간의 존엄성, 평등권, 사전 제한금지의 원칙, 명확성의 원칙, 과잉금지원칙 등을 검토하였고, 우리나라의 표현의 자유 기본권과 제한에 관한 일련의 판례를 검토함으로써 혐오표현 제한 법제에 대한 시사점을 얻었다. 또한 미국의 수정헌법 제1조, 사상의 자유시장 이론, 엄격심사의 원칙, 명백하고 현존하는 위험의 원칙과 도발적 언사에 관한 이론과 판례, 독일 기본법과 「형법」, 「네트워크집행법」과 판례, 영국·캐나다·일본의 입법사항과 판례를 고찰하여서 함의와 시사점을 발견하였다.
미국이 수정헌법 제1조에서 표현의 자유를 우월적 권리로 두었다면, 독일은 기본법 제1조에서 인간의 존엄성을 불가침·불가양의 권리로 천명하면서, 특정 인종의 우월성이나 차등성에 관한 언급의 사회적 경계가 특별히 높은 국가이며, 이는 역사적 배경으로 인한 충분한 사회적 합의를 거친 내용이라고 평가할 수 있다. 한편, 우리나라는 언론의 자유에 대한 헌법 제21조 제4항의 헌법유보와 헌법 제37조 제2항의 일반적 법률유보를 둔 점에서 표현의 자유와 인간의 존엄성의 ‘균형’을 추구하는 헌법의 기조를 유지하여왔다고 할 수 있다. 인간의 존엄성을 형성하고 유지하기 위해서는 표현의 자유가 필수적이며, 표현의 자유의 해악을 제한하기 위해서는 인간의 존엄성의 가치가 필수적인 제한 근거로 작동하기 때문에, 두 기본권 중 어느 하나가 절대적 우위에 있다고 선언하는 것은 다른 부작용이 발생할 수 있다고 생각된다. 즉, ‘인간의 존엄성’은 어떤 국가에서든 최우선이자 근간이 되는 가치이자 기본권임은 분명하지만, 현대사회에서는 ‘표현의 자유’를 통해서 ‘인간의 존엄성’이 유지될 수 있는 상황도 많이 발생한다고 할 수 있으므로 ‘표현의 자유’의 기본권을 ‘인간의 존엄성’과 별개의 상충하는 기본권으로 볼 수 없다.
혐오표현은 기본적으로 인간의 존엄과 가치의 권리에서 파생되는 ‘명예권’과 ‘평등권’을 침해하는 것으로 보이지만, 기존의 우리 법제가 집단명예훼손 또는 집단모욕을 규율하지 않았고, 명예훼손 또는 모욕의 해악이 집단에 대해서 가해졌을 때 개인에 대한 피해는 희석된다는 논리를 적용하고 있었다. 따라서 이와 같은 논리를 변경하기 보다는 혐오표현 제한 법리를 ‘평등권’ 침해로서 접근하는 것이 더욱 바람직하다고 생각하였다. 즉, 얼마나 혐오에 찬 표현이든 ‘혐오감정’을 규제할 근거는 어디에서도 찾을 수 없지만, 혐오표현 관련 법제 마련과 헌법적 고찰의 핵심은 ‘혐오표현이 차별행위의 효과를 나타내었을 때, 국가가 그 차별적 태도를 용인할 것인가의 문제’라 할 수 있다.
이 글에서는 우리 사회가 여전히 표현의 자유를 민주주의 사회의 근본에 해당하는 기본권으로서 굳건하게 받들어야 하지만, 소위 혐오표현이라고 칭해지는 표현들이 특정 집단에 대해 수인할 수 없는 정도의 인격권의 침해, 정신적 고통 등의 신체의 훼손, 소외와 차별을 야기하는 사회적 문제점임을 이해하고 인식하기 시작해야 한다는 것에 동의하며, 집단을 대상으로 하는 혐오표현의 해악성이 추상적이어서 인격권 및 정신·신체 건강의 훼손에 대한 개연성을 입증할 수 없다고 하더라도 평등권 침해의 개연성은 비교적 입증할 수 있다고 생각된다.
혐오표현 규제와 관련해서는 언제나 혐오표현의 법적 개념의 정의가 매우 중요한 출발점인데, 혐오표현에 대한 법적 정의가 매우 다양한 이유는 혐오표현의 법적정의가 그 사회에서 문제되는 혐오표현의 실질이 무엇인지, 사회적 합의가 된 내용은 어디까지인지, 어떤 성격의 법률에 내용을 두는지에 따라서 달라질 수 있는 특성이 있기 때문이다. 따라서 혐오표현의 법적 정의는 해당 국가의 특성과 규율하는 법률의 성격에 따라 내용의 차이도 필연적으로 발생한다고 할 수 있다.
이 연구에서는 두 가지의 주요 목표가 있는데, 하나는 혐오표현의 범주를 어디까지로 정해야하고, 따라서 그 법적 정의는 어떻게 되는 것이 바람직한가와 두 번째는 그 법적 정의는 어느 법률의 조항으로 편입되어야 하는가이다. 결론적으로는 혐오표현의 주요 제한 근거를 차별, 즉 평등권 침해에서 찾는 것이 바람직하다고 생각하였으므로 혐오표현도 차별행위의 한 종류로 간주하고, 차별금지법의 형태로 규율되는 것이 바람직하다고 보았다. 또한 혐오표현을 단순히 표현에 그치는 내용으로서 해당성 여부를 판단하기에는 가치관 또는 사상 등에 따라 개인의 이해 차이가 크기 때문에 판단자에 따른 자의적 판단이 개입될 수 있는 여지가 높다. 따라서 표현을 규제하는 것이 아니라 그 표현이 행동으로 나타날 수 있는 시점을 규제가능한 ‘선’으로 파악하는 것이 바람직하고, “적어도 선동이 있어야 하며 물리적 폭력 등의 위험으로 나아갈 개연성이 있을 때”가 규제 가능한 범위라고 생각하였다. 따라서 이 연구에서는 혐오표현을 다음과 같이 정의하였다. “혐오표현이란 학교, 시설, 직장, 지역사회 등에서 민족, 인종, 종교의 집단적 정체성을 사유로 모욕, 비하 등의 적대적 표현을 선동하는 차별행위로서 물리적 폭력 등의 위험으로 연계될 개연성이 높은 표현을 뜻한다. 단, 공론에 기여할 목적이거나 진실인 경우 또는 진실이라고 믿을 상당한 이유가 있는 경우, 학문·예술적 표현 등은 이에 해당하지 않는다.”라고 정의하였다. 혐오표현의 대상에 대하여 민족, 인종, 종교로 정의한 이유는 우리나라 혐오표현 법제에 대한 논의가 초기적 수준임을 감안할 때, 적용 대상 범위를 과도하게 넓힌다면 표현의 자유 위축이 더욱 심각한 사회적 해악이라고 평가될 수 있기 때문이다. 국가의 문화적 상이성을 불문하고, 인류는 민족, 인종, 종교를 원인으로 하는 전쟁 또는 폭력 상황을 경험한 역사적 공통분모를 가지고 있고, 현대사회에서도 여전히 민족, 인종, 종교 갈등이 테러 등의 원인이 된다고 할 수 있으므로 적어도 국제 보편적인 관점에서 민족, 인종, 종교에 대한 차별이 금지되어야 한다는 합의는 우리사회에서도 공통적으로 수긍할 수 있는 범위라 할 수 있다.
「장애인차별금지법」상의 혐오표현 제한 법제가 사회적 저항을 덜 받은 이유는 장애인을 특별히 보호해야한다는 사회적 합의가 형성되어 있기 때문에 가능하듯이, 민족, 인종, 종교에 따른 혐오표현을 금지하도록 하되, 요건을 엄격한 수준으로 하고, 다만, 형사적 처벌규정은 지양하도록 하였다. 왜냐하면, 내국인에 대한 역차별 논란이 나올 수 있고, 부득불 이러한 혐오표현 제한 법률의 제정이 필요하다고 하는 이유는 국제적으로 승인한 조약의 이행의 차원이기도 하지만, 국가가 생각하는 혐오표현 제한의 가이드라인을 전혀 제시하지 않았을 때, 민간의 자율규제가 전혀 다른 방향으로 흘러갈 것을 예방하기 위함도 있기 때문이다. 따라서 일본의 입법사례를 통해 알 수 있듯이 혐오표현 제한 법률을 형사처벌 규정 없이 제정한다고하여 법적·사회적 실효성이 낮다고만 볼 수 없고, 그만큼 신중하게 균형적 관점을 가져야 하는 사안이라는 태도를 보여줄 수 있을 것이라 생각된다.
한편, 대상을 소수자로 하여야 하는가에 대해서 필자는 혐오표현의 피해가 소수자에게 더 크더라도 다수자에게 적용되지 않는 것은 아니므로 대상에서 소수자로 한정하기 보다는 향후에 처벌 조항을 둔다면, 처벌 수위 또는 양형 판단의 기준으로서 ‘발화자의 영향력’, ‘표현이 발화된 공간 또는 수용자의 크기’, ‘대상의 소수자성’ 등을 고려할 수 있을 것이라고 하였다.
이 연구에서는 구체적인 입법의 방향성으로 영국, 캐나다, 독일, 미국, 일본의 입법과정을 참고한 바, 피해대상 집단에 관한 개별법적인 입법으로 시작하여 시간을 충분히 두고, 사회적 논의를 충분히 거쳐서 합의에 이를 수 있다고 판단되는 사회적 분위기일 때 포괄적 입법으로 나아가야 한다고 제시하였다. 또한「형법」상의 사실적시 명예훼손죄와 모욕죄, 「국가보안법」상의 찬양·고무죄가 표현의 자유의 본질에 해당하는 권력자에 대한 비판을 제한하고 있다는 점에서 개정이 필요하다고 하였으며, 이 개정이 선행되지 않으면 혐오표현 제한에 관한 형사법을 제정하기에는 부담이 크다고 언급하였다.
「정보통신망법」상에 혐오표현에 관한 삭제요청권을 신설하는 것은 효율적인 방법이기는 하나 표현의 자유 제한이 큰 방식이어서 우리나라에 도입하기에는 무리가 있다고 평가하였다. 또한 혐오표현과 관련된 기사에서 지나치게 자극적인 헤드라인으로 조회수를 높이고, 경제적 이득을 취하려고 의도한다면, 다른 혐오표현 제한에 관한 법령이 마련되었을 때, 그 법령을 근거로 「언론중재법」을 적용하여 구제방안을 찾을 수 있을 것이므로 다른 법령상에 혐오표현 제한에 관한 입법이 필요하다고 하였다.
우리나라의 민주화운동 등의 역사가 매우 숭고하고 폄훼되어서는 안 되는 것은 분명하지만 정부의 정치적 성격에 따라서 역사적 사실에 대한 해석의 다양성이 존중되지 못할 수 있고, 다소 극우·극좌로 치우친 해석들의 발언자들을 모두 형사 처벌하는 국가의 정치탄압 기능으로 남용될 수 있으며, 해당 여부에 대한 자의적 판단 가능성도 배제할 수 없음에도 불구하고 해당 표현을 법률과 과도한 형사처벌로서 금지하려는 시도는 바람직하지 않다고 생각한다.
「국가인권위원회법」상 혐오표현 제한에 관한 법률을 추가하는 것이 가능하지만 「국가인권위원회법」의 성격상 인권적 고려로서 피해자 관점에 더욱 치우칠 수 있기 때문에 균형적 관점의 혐오표현 법령을 둘 수 있는가에 대한 의문이 있다. 따라서 「국가인권위원회법」보다는 「재한외국인 처우 기본법」상에 「장애인차별금지법」상의 혐오표현 금지규정과 같은 규정을 두는 방안을 제안하였다.
혐오표현에 관한 특별법안과 차별금지법안에 대하여 검토를 하였으나, 혐오표현 제한 법령을 차별금지법으로 해결하려 하는 것은 차별금지법 제정에 이르기까지 사회적으로 논의하여야 할 사항이 너무 많은 관계로 시간이 소요될 것은 충분히 예측 가능하기 때문에 우선 개별 법령에 법제를 마련하는 것이 바람직하다고 하였다.
마지막으로는 미디어, 인터넷 등에서 표현에 관한 교육과 홍보가 부족하므로 디지털 리터러시 교육 및 홍보 정책이 절실하며, 특히 서울시 학생인권조례상의 혐오표현 제한에 관한 조항이 합헌 판결을 받은데 비추어 청소년들을 혐오표현으로부터 보호하기 위한 지방자치단체의 조례 제정 등으로 확산되도록 하는 정책의 마련이 필요하다고 하였다.
This study consists of three main parts. First, the legal restriction of hate speech under the Constitution is a matter of finding balanced and harmonious legislative measures with the principle of limiting basic rights in the Constitution and the principle of special examination of freedom of expression for the conflict between the basic rights of ‘freedom of expression’ and the basic rights of ‘human dignity and equality’. Therefore, this study looks at the principles of limiting basic rights and fundamental rights involved and the principle of reviewing freedom of expression. Second, looking at the process of enacting and abolishing legislation as a subject discussed early in the West based on historical background such as racism, the American Revolution, and Germany's Holocaust allows us to find out the implications of a big framework in overhauling the nation’s hate speech legislation, so we look at overseas legal trends. Third, it is to come up with legislation reform measures on hate speech in light of the principle of limiting freedom of expression under the Constitution of our country and the trends of overseas legislation.
Specifically, in this paper, freedom of speech and publication, freedom of assembly and association, freedom of expression online, right of human dignity, right of equality, principle of prohibition of prior restriction, principle of clarity, and a series of precedents concerning the basic rights and restrictions of freedom of expression in Korea were reviewed to obtain suggestions on the law limiting hate expression. It also found implications and implications by examining the First Amendment of the U.S. Constitution, the free market theory of ideas, the principle of strict examination, the theory and precedent of clear and existing risk principles and fighting words, the ‘Grundgesetz’ and ‘Strafgesetzbuch’ of Germany, the ‘Gesetz zur Vervesserung der Rechsdurchsetzung in sozialen Netzwerken’ and precedents, and the legislation and precedents of the U.K., Canada, and Japan.
If the U.S. had placed freedom of expression as a superior right in The First Amendment, Germany declared human dignity as inviolable right in ‘Grundgesetz’, and the social boundaries of the mention of superiority of certain races were particularly high, which can be assessed as having undergone sufficient social consensus due to historical background. On the other hand, it can be said that Korea has maintained the constitutional principle of seeking a “balance” of freedom of expression and human dignity, given that it has a constitutional reservation under Article 21-4 of the Constitution on freedom of speech and a general legal reservation under Article 37-2 of the Constitution.
Freedom of expression is essential to form and maintain human dignity, and the value of human dignity works on the basis of essential limitations to limit the harm of freedom of expression. Therefore, declaring that either of the two basic rights has an absolute advantage is thought to have other side effects. In other words, human dignity is the first and fundamental right in any country, but in modern society, there are many situations in which human dignity can be maintained through freedom of expression. Therefore, the basic right of “freedom of expression” cannot be seen as a fundamental right separate from “human dignity.”
The expression of disgust appears to basically violate the “right of honor” and “right of equality” derived from the rights of human dignity and value. The existing Korean legislation applied the logic that damage to individuals is diluted when the harm of defamation or insult is inflicted on the group. Therefore, it was more desirable to approach the law limiting hate speech as an infringement of ‘equal rights’ rather than to change this logic. In other words, no matter how abhorrent an expression may be, there is no evidence anywhere to regulate ‘disgusting feelings.’ The core of the legislation and constitutional consideration related to hate speech is the question of whether the state will tolerate the discriminatory attitude when hate speech shows the effect of discrimination.
In this article, we agree that our society should still firmly uphold freedom of expression as the fundamental right of a democratic society, but we must begin to understand and recognize that expressions called hate speech are social problems that cause unacceptable degree of personal rights infringement, mental distress, etc. of the body, alienation and discrimination against certain groups. It is also believed that the probability of infringement of equality rights can be relatively proven even if the malice of hate speech targeting groups is abstract and the probability of damage to personal rights and mental and physical health cannot be proved.
The definition of the legal concept of hate speech is always a very important starting point for hate speech regulation. The legal definition of hate speech is very diverse because the legal definition of hate speech has characteristics that can vary depending on what the substance of hate expression is in question in the society, how far the social consensus is, and what type of law it is in. Thus, the legal definition of hate speech can inevitably lead to differences in content depending on the characteristics of the country and the nature of the laws governing it.
In this study, there are two main objectives, one to what extent the category of hate speech should be set, so what is the legal definition desirable and the second is which legal definition should be incorporated into the provisions of which law. In conclusion, it was considered desirable to find the main limiting basis for hate speech in discrimination, i.e. infringement of the right to equality, so it was considered desirable to consider hate speech as a kind of discrimination act and to be disciplined in the form of anti-discrimination laws.
In addition, there is a high possibility that arbitrary judgments based on judges can be involved in determining whether or not hate speech is merely an expression, as there are large differences in individual interests depending on values or ideas. Therefore, it was considered to be within the regulatory scope that it would be desirable to identify the timing of the expression as a regulated ‘good’ rather than regulating the act, and that “when at least there should be propaganda and there is a probability of moving towards the risk of physical violence, etc.”
Therefore, in this study, hate speech was defined as follows: “Hate expression is an act of discrimination that instigates hostile expressions such as insults, demeaning, etc. on the grounds of the collective identity of ethnicity, race, and religion in schools, facilities, work places, and local communities, and is highly likely to be linked to the risk of physical violence, etc. However, academic and artistic expressions, etc. do not apply to cases where there is a purpose or truth to contribute to public opinion, or where there is considerable reason to believe that it is true.”
The reason why we defined the object of hate speech as ethnic, racial, and religious is because, given the initial level of discussion on the nation's hate speech legislation, if the scope of the application is excessively expanded, the contraction of freedom of expression can be considered a more serious social harm. Regardless of the cultural differences of the state, mankind has a historical common denominator of experiencing war or violence caused by ethnic, racial, or religious causes. Since ethnic, racial and religious conflicts can still be said to be the cause of terrorism in modern society, the agreement that discrimination against ethnic, racial, and religious groups should be banned from an international universal perspective is a common acceptable range in our society.
The reason why the Act on the Restriction of Disability Expression under the Act on the Prevention of Discrimination against Persons with Disabilities received less social resistance was because of the social consensus that people with disabilities should be specially protected, so the expression of abhorrence by ethnicity, race, and religion was prohibited, but the requirements were strictly enforced, and the provisions of criminal punishment were avoided.
Because the reason for the controversy of reverse discrimination against Koreans and the inevitable need for the enactment of these hate speech restrictions is the implementation of internationally approved treaties. It is also to prevent the private sector's self-regulation from flowing in a completely different direction when the government has not provided any guidelines for limiting hate speech. Therefore, it is believed that the enactment of the law limiting hate speech without the provision of criminal punishment does not mean that the legal and social effectiveness is low, as shown by Japan's legislative case, and that it is an issue that requires a careful and balanced perspective.
On the other hand, as to whether the subject should be a minority, I said that even if the damage of hate speech is greater to the minority, it does not apply to the majority, so if the provision of punishment is placed in the future rather than limited to the minority, it could consider ‘the influence of the speaker’, ‘the space or the size of the receptor’ and so on as a criterion for determining the level of punishment or the type.
The study referred to the legislative process of Britain, Canada, Germany, the United States and Japan for the specific direction of legislation and suggested that the legislation should begin with individual legal legislation on the affected group and move toward comprehensive legislation in a social atmosphere in which it is deemed possible to reach an agreement through sufficient social discussions. It was also said that the revision was necessary in that the crime of defamation and insult in fact under the Criminal Act and the crime of praise and instigation under the National Security Act limited criticism of those in power who were in the essence of freedom of expression, and that if the amendment was not preceded, it would be burdensome to enact a criminal law on restricting hate speech.
Although it is an efficient method to establish a request for deletion of hate speech under the Information and Communication Network Act, it was assessed that it was too much to introduce in Korea because of the large restriction on freedom of expression. In addition, an article on hate discrimination said that legislation on hate speech restrictions is needed under other statutes because if the government intends to increase the number of views with overly provocative headlines and make economic gains, it can be found by applying the Press Arbitration Act on the basis of other hate speech restrictions It is clear that the history of the nation's democratic movement and others is very noble and should not be disparaged, but the diversity of interpretations of historical facts may not be respected depending on the political nature of the government. Also, I think it is undesirable to attempt to ban the expression as a law and excessive criminal punishment, even though the possibility of arbitrary judgment on the issue cannot be ruled out.
Although it is possible to add a law on restrictions on hate speech under the National Human Rights Commission Act, there is a question of whether an act of hate expression from a balanced perspective can be placed because it can be more biased in terms of human rights in the nature of the National Human Rights Commission Act. Therefore, it was proposed that the Framework Act on Treatment of Foreigners in Korea, rather than the National Human Rights Commission Act, would have the similar provisions as the prohibition of hate speech under the Act on the Prevention of Discrimination against Persons with Disabilities.
Although the special bill on hate speech and the anti-discrimination bill were reviewed, it was desirable to prepare legislation in individual statutes first because it would take time because there were too many social issues to discuss until the enactment of the anti-discrimination law.
Lastly, the education and public relations policies for digital literacy are urgently needed as there is a lack of education and publicity on expression in the media and the Internet. In particular, it is necessary to prepare a policy to spread to local governments to protect teenagers from hate speech in light of the Seoul Government's constitutional ruling.
