독도에 대한 일본의 영역권원주장에 관한 一考 = 고유영토론과 선점론

일본은 독도를 자국의 영토라고 주장하고 있다. 그 근거로 일본 정부가 제시하는 것은 독도가 일본의 고유영토라고 하는 것과 일본이 무주지인 독도를 선점하였다고 하는 것의 두 가지이다. 일본에 의하여 주장되는 이들 두 영역권원은 상호배제적인 것이다. 왜냐하면 고유영토인 자국 영토를 ‘무주지’로 선점할 수는 없기 때문이다. 따라서 논리적인 관점에서 볼 때 일본이 독도에 대한 영유를 주장하는 경우에도 영역권원으로서는 고유영토와 선점 중에서 하나를 선택하여 제시하지 않으면 안 된다.
이들 두 영역권원을 모순 없이 설명하기 위하여 일본 정부나 학자들은 선점이 근대국가로서 독도를 영유하는 의사를 재확인 한 것이라고 하거나 아니면 이미 유효하게 성립한 역사적 권원을 현대적인 요청에 따라 대체한 것 또는 原始的 權原을 確定的 權原으로 대체한 것이라고 주장하는 일이 있다. 이러한 주장은 근대 국제법이 역사적 권원을 선점으로 대체할 것을 요구하는 일이 없고, 또 독도를 제외한 다른 많은 섬들에 대하여 일본이 역사적 권원을 선점으로 대체한 사례도 없다는 점에서 타당하지 않다. 무엇보다도 이른바 일본의 ‘독도 선점’과정을 살펴보면 일본은 명확하게 독도를 무주지로서 취급하였다는 것이 확인된다. 이 점에서는 일본의 여러 도서 선점 사례와 ‘독도의 선점’ 사이에 차이가 없다. 그러므로, 1905년의 독도편입조치의 과정과 그 밖의 일본의 도서 선점의 선례에 비추어 볼 때, 일본이 독도를 자국의 영토로 주장하는 경우에는 영역권원으로서는 선점을 제시하는 것이 사리에 맞는 것으로 생각된다.
일본의 독도 선점 주장과 관련하여 주목되는 자료로 1933년 일본 외무성에서 편찬한 『國際法先例彙輯』제2권이 있다. 이 자료에는 “島嶼先占”이라는 제목이 붙어 있으며 당시까지 일본이 행한 도서편입의 사례가 모두 수록되어 있지만, 독도는 포함되어 있지 않다. 비슷한 시기에 집필된 타치(立)의 논문이나 그밖의 일본 학자의 논문에서도 독도는 일본에 의하여 선점된 도서의 사례에서 누락된 경우가 보인다. 그 이유는 명확하게 밝혀진 바가 없지만, 가능한 추측의 하나로는 독도가 일본의 선점의 대상이 아니었다는 인식이 일본 정부 내부에 존재하였기 때문일 수도 있다.
The territorial titles over Dokdo (Liancourt Rocks,), on the basis of which Japanese government argues its territorial possession of it, are two: so-called original or historic title and occupation of terra nullius. However, these two territorial titles are mutually exclusive as no State can acquire new territory by occupying its own original territory. Therefore, it may be said that the Japanese government's argument of territorial title over Dokdo includes a contradiction in itself and it seems reasonable that Japan must choose only one title for its argument of territorial possession.
Japanese government and scholars sometimes try to reconcile these two titles in relation with Dokdo. Japanese government explains that occupation of it has the meaning of reaffirming its intention to possess Dokdo. Japanese scholars explain that occupation substituted validly established historical title according to requirement of modern international law, or that occupation had the meaning of substituting solid title (occupation) for inchoate title (historic title). These explanation for the reconciliation of occupation and historic title lacks persuasive power because modern international law does not demand the substitution of occupation for historic title. In addition. Japan have never substituted occupation for historic title in relation with many islands possessed by it except Dokdo. Above all, when we review the process of Dokdo s incorporation into Japanese territory it is beyond any doubt that Japanese government treated Dokdo as terra nullius. In that, we cannot find any difference between the incorporation of Dokdo and that of other islands. Japanese government treated all islands, including Dokdo, as terra nullius before their incorporations. Therefore, it is the author's conclusion that if Japan want to claim its territorial sovereignty over Dokdo, it must choose occupation as its legal basis of the claim.
There is one notable material concerning the Japanese government's argument of occupation of Dokdo. The volume 2 of Kokusaihosenreiishu (Collection of International Law Precedents), which contains the international legal precedents related with Japan and was published in 1933, is titled 'Occupation of Islands'. In this second volume, all precedents of incorporation of islands by Japan through occupation are collected. However, Dokdo is omitted from those precedents. An article concerning Japanese incorporation of islands, published at the similar time of Kokusaihosenreiishu and written by Tach, one of the most representative international law scholar at the time, also shows that Dokdo is not referred in it as a precedent of island incorporation by Japan. The reason for this ommission is not clear yet. One possible inference is that the knowledge that Dokdo could not be an object of incorporation through occupation existed within the Japanese government through the times.
