기술적 보호조치와 접근권의 문제점 = A Study on the Issues of Technological Protection Measures and Access Right

국문 초록 (Abstract)

본 논문은 기술적 보호조치와 관련된 문제점을 분석·연구하는 것을 목적으로 하였다. 이를 위하여 본 논문은 기술적 보호조치에 관한 미국, 유럽연합 및 한국의 입법을 간략하게 고찰하였다. 기술적 보호조치에 관해서는 아직 한국에서는 판결이 없는 상태이지만, 미국에서는 몇 개의 판결이 나와 있는 상태이므로, 본 논문은 이를 상세하게 고찰·분석하고 미국의 판례의 경향 및 이러한 경향에 따라 실제로 발생되어 온 기술적 보호조치에 관한 문제점을 분석하였다.
기술적 보호조치에 대해서는 여러 가지의 문제점이 지적되고 있는데 본 논문은 기술적 보호조치에 관하여 가장 큰 문제점은 접근권(right to access, access right)의 인정여부와 접근권의 인정에 따른 문제점을 상세히 고찰하였다. 또한 접근권과 관련하여 접근권의 인정에 따른 공정이용의 제한가능성을 분석하였다. 기술적 보호조치의 사용에 의하여 최초판매원칙이 무력화될 수 있으므로, 본 논문은 기술적 보호조치와 최초판매원칙간의 관계를 논의하였다. 미국은 기술적 보호조치에 관한 권리를 저작권에 유사한 권리(paracopyright)로 파악하여 저작권과 기술적 보호조치를 별개의 것으로 보고 있는데, 본 논문은 저작권과 기술적 보호조치간의 연관관계의 중요성을 강조하면서 저작권법과 컴퓨터프로그랩보호법에서의 연관관계에 관한 개별적인 규정틀을 고찰하였다.
본 논문은 기술적 보호조치에 관한 한국의 입법 중에서 컴퓨터프로그램보호법이 기존의 저작권 이외에 새로운 권리를 인정하였을 가능성, 예외사유의 문제점, 구제수단 등에 있어서 저작권과 기술적 보호조치의 연관관계를 논의하면서 연관관계를 강 력하게 규정하는 것을 제안하였다.

다국어 초록 (Multilingual Abstract)

While the US anticircumvention provisions of the Digital Millennium Copyright Act penalize both the circumvention of technical protection measures, the Korean provisions of both the Copyright Act and the Computer Program Protection Act regulates only the use control. According to the WIPO Copyright Treaty(WCT, 1996), contracting parties are required to only to provide adequate legal protection and effective legal remedies against circumvention of technological controls(§11). Clearly it appears that signatory states are not required to recognize a new and unprecedented right to control access to copyrighted work, so-called access right. However, the US copyright outlaws the act of circumventing a technological measure that effectively controls access to a work protected under the Copyright Act of 1976 [§ 1201(a)(1)(A)]. It may be hotly debated whether or not to recognize the access right under the Korean copyright system. Its recognition has become even the trade issue between the US and Korea. This paper deals with the technological protection measures and the access right, and analyzes the strength and weakness of the access right. It suggests that there be limitations or exceptions to the access right, if recognized under the Korean copyright system.
The US scholars and courts views the anticircumvention right as paracopyright, meaning that it is entirely separate from the exclusive rights under copyright. According to this view, the anticircumvention right effectively grants copyright holders sweeping new ability to impose terms of access on content users. It appears that the paracopyright norm of the anticircumvention right is rejected under the Korean Copyright Act(§92). It is not clear, however, whether such a norm is accepted or rejected under the Korean Computer Program Protection Act. While the Korean copyright system does not recognize the access right, the relationship between the exclusive rights under copyright and anticircumvention right is very important. Therefore, this paper also deals with the relationship between copyright and anticircumvention right in detail, and it suggest that there be some relationship between them in respect of the infringement, remedy, and exceptions to the right.
