메타버스 내에서의 디지털 성범죄 유형과 입법적 대응 = Legislative challenges and Types of Digital sex crimes within the Metaverse

국문 초록 (Abstract)

최근 메타버스 플랫폼이 다양해지고 가상세계로 사람의 활동무대가 확대되면서 메타버스에서의 디지털성범죄가 주목을 받고 있다. 해외에서는 대체로 범죄예방적인 관점에서 사업자의 기술적 조치 등을 통한 자발적 위험완화방안을 추구한다. 그 필요성에 공감하면서도 비법적 조치가 가지는 규범통제의 한계로 인해 디지털 성범죄를 현실규범을 통해 직접 규율할 필요성이 제기되었다. 따라서 이 글에서는 특정 아바타를 대상으로 하는 비접촉성범죄에 대해 형법이나 성폭력범죄처벌법 등 현행법을 적용할 수 있는가를 검토하였다. 검토 결과 현행법을 디지털성범죄에 적용하는 것은 죄형법정주의의 원칙에 반할 우려가 있고, 가상공간의 표현의 자유를 과도하게 제한할 수 있다는 점 등을 근거로 새로운 입법의 필요성을 제기하였다. 이 글에서는 대법원이 성적자유의 외연을 확대하고 있고 일반적 인격권개념이 보호법익의 흠결을 보완할 수 있다는 점에 착안하여 정부의 성적 인격권개념의 도입에 실익이 없다는 점도 논증하였다.
한편 메타버스 공간에서의 비접촉 성범죄는 대체로 성적괴롭힘의 형태로 전개된다는 점에서 성폭력범죄처벌법에 성적괴롭힘 구성요건을 신설할 필요성을 제기하였다. 이후 법무부 권고안을 토대로 문제점을 분석하고 대안을 제시하였다. 이 글에서는 대안으로 피해자의 의사에 반하여 성적 자유를 침해한다는 성범죄의 본질을 살리면서도 성적 언동을 규범적으로 제한하는 불법표지를 제시하고, 행위자의 성행에 대한 주관적 경향성을 표상할 만한 별도의 불법표지를 설시하였다. 아울러 메타버스 공간에서 발생할 수 있는 디지털 성범죄를 효율적으로 규제하기 위해서는 정보통신망법에 특화된 구성요건을 제시하면서도 특히 미성년자 등 사회적 약자를 두텁게 보호하는 별도의 대안을 제시하였다.

Recently, as the Metaverse platform has become more diverse and people's activities have expanded into the virtual world, digital sex crimes in the Metaverse have been attracting attention. According to foreign cases, voluntary risk mitigation measures are generally pursued through technical measures of OPS from a crime prevention perspective. I agree with the need. However, due to the limitations of non-legal measures in controlling reality, the need to directly regulate digital sex crimes with efficient norms has been raised. Therefore, in this article, the author reviewed whether current laws, such as the Criminal Act or Act on Special Cases Concerning the Punishment of Sexual Crimes, can be applied to non-contact sexual crimes targeting avatars.
As a result of the review, there is a concern that applying the current law to digital sex crimes may violate “Nullum crimen, nulla poena sine lege”. In addition, the need for new legislation was raised based on the fact that freedom of expression in virtual space could be excessively restricted. In this article, it was argued that the government's introduction of the concept of sexual personality rights is of no practical benefit, based on the fact that the Supreme Court is expanding the scope of sexual freedom and that the general concept of personality rights can supplement the shortcomings of legal interests.
Meanwhile, based on the fact that non-contact sexual crimes in the metaverse generally occur in the form of sexual harassment, the need to criminalize sexual harassment in the Act on Special Cases Concerning the Punishment of Sexual Crimes was raised. Next, problems with the Ministry of Justice's recommendations were analyzed and alternatives were presented. In this article, after confirming that a sexual crime is a crime that violates sexual freedom against the victim's will, an illegal sign was presented that normatively restricts the requirement of sexual speech and behavior in the Ministry of Justice's recommendations. And a separate illegal sign was set up to represent the criminal's subjective tendency in sexual activity. In addition, as a way to efficiently regulate digital sex crimes that may occur in the metaverse, new punishment provisions were proposed in the Act on Promotion of Information And Communications Network Utilization And Information Protection, and a separate alternative was proposed that specifically protects the socially vulnerable, such as minors.
