An Evaluation of Role of Power in Financial Statement Fraud Collusion Between Pre-Sox and Post-Sox.

This study reviewed the Sarbanes-Oxley Act of 2002 (SOX) internal control provisions and evaluated the fraud cases before and after SOX and investigated whether SOX internal control provisions are useful on diminishing the fraud collusions due to power influence. In both fraud cases, financial statement frauds were carried out by a small group of top executives and resulted in the Security and Exchange Commission (SEC) investigation. Both fraud cases were carried out with a motive to achieve the desired accounting results in which all three elements of the fraud triangle, as well as power influence, existed. In both fraud cases, both firms did restate the financial statement, and both firms filed false and misleading financial statements and financial disclosures. Both firms involved in the fraud cases were not required to file bankruptcy. Both fraud cases existed the five types of fraudulent transactions (sham transactions, improper accounting, manipulation of transactions, failed to notify the independent auditors, and failed to disclose the material information in the financial statements). The result suggested that the role of power is inversely proportional to pressure and inversely proportional to opportunity and rationalization. Furthermore, this study evaluated the role of internal control on the elements of the fraud triangle and found that internal control is directly proportional to the pressure and inversely proportional to the opportunity and rationalization. The relationship of power with the three elements of the fraud triangle and the relationship of internal control with three elements of the fraud triangle has an inverse relationship that concluded having the internal control compliance provision will diminish the role of power influence in financial statement fraud cases. That was evidenced by the change in behavior on the elements of the fraud triangle and the role of power influence on before and after SOX fraud cases.
