지하수에 대한 권리의 검토 - 민법상 용수권과 지하수법상 지하수 개발·이용권을 중심으로 - = Review of rights to groundwater - Focusing on water rights under the Civil Act and groundwater development and use rights under Groundwater Act -

Water is an indispensable element for human survival. However, due to climate change and overuse of water, water shortages are appearing all over the world. Among these water resources, groundwater is increasing in value as the last bastion. In recent years, even the use of groundwater is facing a crisis due to indiscriminate development, drought caused by climate change, and pollution. Therefore, in order to effectively manage groundwater and resolve disputes, it is necessary to review the legal principles for groundwater. The legal nature of the right to groundwater will be an issue in relation to whether groundwater is subject to private ownership. In the event of a conflict between those who have rights to groundwater, the solution is also important.
The legal nature of groundwater are reviewed by dividing them into different types of groundwater. First, groundwater used as a source(springwell) and water pump without a mechanical device is an object of property right(things) under Article 98 of the Civil Act. In other words, it satisfies the requirements of ① corporeal matter ② manageability ③ independence ④ impersonality. It also belongs to the upper and lower scopes of land ownership rights under Article 212 of the Civil Act. Therefore, such groundwater should be regarded as being included in land ownership.
The second is groundwater as public water subject to Articles 235 and 236 of the Civil Act. This must meet the requirements of ① public ② springwell or water supply ③ right to use. Here, the springwell or water supply should be seen as referring to spring water, wells, and pumps commonly used by villagers from the past. The scope of groundwater subject to water rights is the same as that of groundwater within the scope of the first land ownership. However, the right to use public water under Articles 235 and 236 of the Civil Act is a form in which the legal principle of neighborhood relations is applied by adding the requirement that it is public. Legal character should be regarded as a right similar to easement or personal easement right in custom. However, these water rights cannot be equated with complete real rights. The easement as such a real right is governed by the water easement under Article 297 of the Civil Act.
Finally, groundwater that does not fall under the above two categories should be regarded as a natural tribute as a public property. Under the Groundwater Act, the right to develop and use groundwater is granted. The right to develop and use groundwater is a patent for public property, and its legal nature is similar to that of easement, but it is difficult to recognize an exclusive right due to the nature of public property.
If the right to such groundwater conflicts with a third party or other right holder, the solution becomes a problem. In the case of groundwater belonging to ownership, it will be possible to claim for damages based on tort and real rights claims based on ownership. Infringement of the right to groundwater corresponding to the water rights under Articles 235 and 236 of the Civil Act can be resolved with the relevant provisions. However, since this water right is limited to public use, it will be possible to exercise limited property rights or claim damages based on tort. The most problematic case is when conflicts arise between holders of rights to groundwater. If there is a person with the right to use water under the Civil Act, the relevant provisions of the Civil Act may be used to seek a solution. However, in the case of a conflict of rights between the holders of the right to develop and use groundwater, a solution must be sought. 물은 인류의 생존에 필수 불가결한 요소이다. 그런데 기후변화와 물의 남용으로 인하여 세계적으로 물부족 현상이 나타나고 있다. 이러한 수자원 중에 지하수는 최후의 보루로서 그 가치가 높아지고 있으나 최근 무분별한 개발과 기후변화로 인한 가뭄, 오염 등으로 지하수의 이용마저 위기를 겪고 있다. 따라서 효율적인 지하수 관리와 분쟁을 해결하기 위하여는 지하수에 대한 법리를 검토할 필요가 있다. 지하수가 사적 소유권의 대상이 되는지와 관련한 지하수에 대한 권리의 법적 성질이 문제가 될 것이다. 또한 지하수에 대한 권리를 가진 자들 간에 충돌이 발생할 경우 그 해결책도 문제가 될 것이다.
지하수의 법적 성질을 지하수의 형태별로 나누어 검토한다. 첫 번째로 원천·수도 등을 통하여 기계적 장치 없이 이용하는 지하수는 민법 제98조의 물권의 객체로서의 물건에 해당한다. 즉 물건으로서 가져야 할 요건인 ① 유체물 ② 관리가능성 ③ 독립성 ④ 비인격성의 요건을 충족한다. 또한 민법 제212조의 정당한 이익이 미치는 토지소유권의 상하 범위에도 속하므로 이러한 지하수는 토지소유권에 포함되는 것으로 보아야 한다.
두 번째로 민법 제235조와 제236조의 적용을 받는 공용수로서의 지하수이다. 이것은 ① 공용 ② 원천 또는 수도 ③ 이용할 권리라는 요건을 충족하여야 한다. 여기서 원천 또는 수도는 과거부터 마을 주민들이 공동으로 이용하는 샘물, 우물, 펌프 등을 말하는 것으로 보아야 한다. 용수권의 대상이 되는 지하수의 범위는 첫 번째 유형의 토지소유권 범위에 속하는 지하수와 그 범위가 일치한다. 다만 민법 제235조와 제236조의 공용수 용수권은 공용이라는 요건이 추가되어 상린관계의 법리가 적용되는 형태로 보아야 할 것이다. 그 법적 성격은 이용 형태에 따라 관습상 지역권 내지 인역권 유사의 권리라고 보아야 할 것이다. 다만 이러한 용수권은 물권법정주의의 적용을 받는 물권과 동일시할 수는 없다. 그 권리는 공용이라는 목적 때문에 물권적 청구권은 제한을 받을 수 밖에 없을 것이다. 그러한 물권으로서의 지역권은 민법 제297조의 용수지역권으로 규율된다.
마지막으로 위의 두 유형에 해당하지 않는 지하수는 공공재산으로서 자연공물로 보아야 할 것이다. 「지하수법」에 의하여 지하수 개발·이용권이 부여되는 것이다. 이러한 지하수 개발·이용권은 공공재산인 공물에 대한 특허를 준 것으로 그 법적 성질은 지역권에 유사한 권리이지만 공공재산이라는 성격상 배타적인 권리성을 인정하기는 어렵다.
이러한 지하수에 대한 권리가 제3자나 다른 권리자와 충돌을 일으키는 경우 그 해결 방법이 문제가 된다. 소유권에 속하는 지하수의 경우 소유권에 기한 물권적 청구권과 불법행위에 기한 손해배상청구를 할 수 있을 것이다. 민법 제235조·제236조의 용수권에 해당하는 지하수에 대한 권리의 침해는 해당 조항으로 해결을 할 수 있을 것이다. 다만 본 용수권은 공동사용(공용)이라는 제한을 받으므로 제한된 물권적 청구권을 행사하거나 불법행위에 기한 손해배상청구를 할 수 있을 것이다. 지하수 개발·이용권자와 제235조·제236조 용수권자 등 지하수에 대한 권리자 상호간에 충돌을 일으키는 경우가 가장 문제이다. 이 중에 용수권자가 있는 경우에는 민법의 해당 규정으로 해결을 모색할 수 있다. 그러나 지하수 개발·이용권자 간에 권리가 충돌하는 경우는...
