항공분야에서는 인적오류로 인하여 대부분의 사고나 사건이 발생하는 것을 인
식하고, 사전 예방적 안전관리방식을 통하여 위험의 발생요인을 사전에 차단하는
것이 사고나 사건의 발생을 감소시킬 수 있는 방안이라고 판단하고 있다. 「국제
민간항공협약」 Annex 19에서 강조하고 있는 사전 예방적 안전관리의 초점은 자
율적 안전보고를 활성화함으로써 수집된 안전정보를 활용 및 공유하여 위험요인
의 발생을 사전에 인지하고 억제하는 것에 있으며, 이를 위한 핵심 요소는 항공
실무자들의 자율적 보고임을 강조하고 있다. 그러나 항공실무자들의 자율적 보고
가 활성화되지 않는 문제점이 제기되어 왔고, 그러한 장애 요소로는 첫째, 사고나
사건이 발생했을 때 항공실무자들의 과실을 원인으로 추정하고 관련 당사자를 처
벌하는 문화, 둘째, 항공실무자들의 자율적 안전보고 내용 및 사고조사의 과정에
서 진술한 내용을 법원이나 규제기관에서 그들을 처벌하기 위한 증거로 남용하고
있는 문제점이 거론되었다.
ICAO는 국제적으로 발생하고 있는 처벌 중심의 항공규제와 정보남용의 문제점
을 인식하고, 「국제민간항공협약」 Annex 19의 SARPs를 통하여 자율적 안전보
고를 활성화할 수 있는 안전보고제도의 구축과 안전정보를 보호할 수 있는 법규
정 및 정책을 국내법으로 마련할 것을 강조하고 있다. 이처럼 항공실무자들이 신
뢰를 통하여 자율적으로 보고할 수 있는 환경을 마련하는 것이 공정문화이며, 항
공분야에서는 안전정보의 활용 및 공유를 통한 사전 예방적 안전관리 방식을 위
해서 공정문화가 기반이 되어야 함을 강조하고 있다. 또한, 공정문화를 실현하는
데 있어서, ‘비공개’, ‘비처벌’의 요소는 자율적 안전보고를 활성화시킬 수 있는 핵
심요소로 작용하고 있다. 이에 본 논문은 공정문화의 핵심 요소인 비공개 및 비처
벌 관련 쟁점을 검토하고 국내에 적용하기 위한 실효적 방안을 제시하고자 한다.
공정문화의 ‘비공개’는 정보의 기밀성에 근거한 안전정보 및 사고조사와 관련된
민감한 정보를 법원이나 규제기관에서 처벌의 증거로 사용하는 것을 제한하여야
함을 강조하고 있다. 특히, 사고조사보고서 및 조종실음성기록장치(CVR)의 데이
터는 민감한 정보로 보호되어야 함을 「국제민간항공협약」 Annex 13의 SARPs
에서도 강조하고 있으며, 이미 미국과 호주 등 주요국가에서는 해당 정보가 법원
에서 증거로써 채택될 수 없도록 법규정을 통하여 제한하고 있다.
공정문화의 ‘비처벌’은 용인의 범주에 있는 위반행위에 대한 비처벌을 의미한다.
ICAO, EU, 미국의 공정문화 정의에 따르면 고의, 중과실, 파괴적인 행위는 처벌
해야 하는 행위로 분류되며, 실무자의 경험과 훈련에 상응한 작위, 부작위, 결정에
대하여는 용인(tolerance)해야 함을 명시하고 있다. 여기서 ‘실무자의 경험과 훈련
에 상응한 작위, 부작위, 결정’은 이른바 경과실을 가리키나, 우리 형법 체계에서
도 경과실과 중과실 행위를 구분하는 어려움이 상존하고 있다. 이러한 이유로 본
논문에서는 용인의 경계를 판단할 수 있는 판단절차를 제시함으로써 항공분야의
위반행위를 판단함에 있어, 단순히 객관적 주의의무 및 규정위반 해당 여부만으로
판단하는 것이 아니라, 주관적 요소와 비난가능성을 판단하여야 함을 제시하였다.
이것은 항공의 특성상, 개별 사안에 따른 행위자의 당시 상황 및 사정 등을 종합
적으로 고려하여 책임 여부를 결정하여야 함을 의미하며, 법령 및 규정위반 해당
여부만으로 판단하는 것은 공정성이 결여될 소지가 있고, 안전보고를 위축시킴으
로써 항공안전에 부정적 영향을 끼칠 수 있다는 데 근거한 것이다.
이러한 내용을 바탕으로, 본 논문은 공정문화의 실효성 제고를 위해 마련되어
야 할 구체적이고 실질적인 방안을 제시하였으며, 그 내용은 다음의 네 가지로
요약할 수 있다. 첫째, 항공규제에서 처벌 또는 용인의 경계를 위한 판단절차를
적용하며, 용인할 수 있는 행위의 경우 처벌보다는 시정조치를 통한 재발방지에
초점을 두도록 한다. 둘째, 정보의 남용으로 부정적 영향을 줄 수 있는 민감 데이
터인 사고조사보고서와 조종실음성기록장치(CVR) 데이터는 법원 및 규제기관에
서 처벌의 증거로 사용을 제한할 수 있도록 법규정을 보완한다. 셋째, 현재 항공
규제에 있어서 규제기관이 독자적으로 행정집행과 조치방안을 결정하는 방식에서
벗어나, 규제당국과 규제대상기관이 협의하여 문제를 해결하고 규제방식을 결정
할 수 있도록 한다. 넷째, 이러한 법과 정책을 마련하더라도 법을 집행하는 기관
및 항공분야의 관련 조직과 실무자가 공정문화에 대한 인식이 부족하다면 구현되
기 어려우므로 항공분야의 모든 관련자가 공정문화를 인식할 수 있는 교육과 제
도를 마련한다.
항공분야에서 공정문화를 기반으로 한 안전관리방식의 중요성을 부정할 수는
없을 것이다. 그러나 실질적 이행은 관련 법규정과 세부 정책을 마련함으로써 실
효성을 제고할 수 있다. 구체적 이행방안을 통하여 항공실무자들이 신뢰하고 안
전의 위험을 보고할 수 있는 환경을 만드는 것은 그러한 정보의 활용을 통하여
인적오류를 감소시킴으로써 궁극적으로 항공안전을 확보하는 데 기여할 수 있을
것이다.
In aviation, recognizing that accidents or incidents primarily occur due to
human error and, thus, using proactive safety management measures to
reduce risk factors is regarded as the best way to reduce the number of
accidents. Annex 19 of the International Civil Aviation Organization (ICAO)
emphasizes proactive safety management, which focuses on predicting and
suppressing risk factors by utilizing and sharing safety-related information
collected through voluntary reports. It further stresses that the primary means
to achieve this is through the voluntary safety reports by hands-on aviation
employees and operational personnel. However, the issue of these staff
members’ inactive voluntary reporting has been raised due to the culture of
presuming that the staff’s negligence is the cause of the accident and
punishing the relevant personnel and the details of the voluntary reports
written by hands-on aviation staff and their statements made during the
investigation process being abused as evidence toward punishing them by the
court or regulatory agencies.
ICAO recognizes the international problem of punishment-centered aviation
regulations and the abuse of safety information. Thus, they strongly advise
setting up a safety reporting system that can encourage voluntary safety
reports and establish domestic laws that incorporate ordinances and policies
for protecting safety information through the Standards and Recommended
Practices (SARPs) proposed by Annex 19. As such, just culture is establishing an environment of trust where hands-on aviation staff can
voluntarily report issues by ensuring “non-disclosure” and “non-punishment.”
The aviation field underlines that just culture should be the foundation for
practicing proactive safety management by utilizing and sharing safety
information. Moreover, with regard to realizing just culture, “non-disclosure”
and “non-punishment” act as key elements that incentivize voluntary safety
reports. This paper suggests effective measures to apply in South Korea
based on the critical aspects of just culture: non-disclosure and
non-punishment.
“Non-disclosure” highlights that limits should be set when using safety
information as evidence for punishment based on the confidentiality of the
sensitive information related to investigations of accidents. In particular, the
SARPs stress that accident investigation reports and cockpit voice recorders
(CVRs) should be safeguarded as sensitive information providers; countries
such as the U.S.A and Australia already restrict such information from being
recognized as evidence at courts through ordinances.
“Non-punishment” refers to not punishing offenses that are within the
scope of tolerance. According to the definition of just culture followed by
ICAO, the European Union, and the U.S.A., intentional gross negligence and
destructive behaviors are classified as acts that must be punished, while
tolerance should be exercised toward actions, omissions, and decisions that
correspond to the hands-on staff’s experience and training. While actions,
omissions, and decisions that correspond to the hands-on staff’s experience
and training are classified as acts of slight negligence, South Korea’s criminal
law system faces difficulties in distinguishing between negligence and gross
negligence. Therefore, this paper proposes a judgment procedure to determine
the boundary of tolerance, suggesting that when judging acts of violation in
the field of aviation, subjective components and the possibility of criticism
should be identified beyond merely judging the objective violations of duties
of care and regulations. This involves determining accountability by
comprehensively analyzing the concerned person’s situation and circumstances
at the relevant time based on a case-by-case basis as per aviation
characteristics. This is based on the grounds that judging a matter merely
based on whether ordinances and regulations have been violated may lack
justice and consequently discourage safety reports, thereby negatively impacting aviation safety.
This paper presents four concrete and practical measures that can be used
to improve the effectiveness of just culture. First, a judgment procedure for
the boundary of tolerance must be established in aviation regulation, and for
tolerable acts, the focus should be on preventing the recurrence of negligence
via corrective measures rather than on punishment. Second, laws and
regulations should be established to limit the use of accident investigation
reports and CVRs, which hold sensitive information that can have negative
effects if misused as evidence for punishment in regulatory agencies and
courts. Third, regulatory agencies should not be allowed to determine
administrative execution and measures to be taken independently as per the
current aviation regulations, and private and public sectors should cooperate to
determine the regulatory methods to resolve an issue. Fourth, these laws and
policies will be challenging to implement if law enforcement agencies and
organizations related to the aviation field lack awareness of just culture.
Thus, educational systems must be newly established to enable all concerned
personnel in the aviation field to recognize just culture.
The importance of safety management methods based on just culture in the
aviation field cannot be denied. However, effective practical implementation
can only be initiated by devising laws, regulations, and policies through
domestic law. Creating an environment where hands-on aviation staff can
report safety risks with trust through specific implementation measures can
contribute to ensuring aviation safety by utilizing such information to reduce
human error.
