캐나다 헌법상 언론의 자유와 방송ㆍ통신 심의기구의 내용 규제에 대한 비교법적 연구 = A Comparative Study on the Freedom of Speech and the Content Regulation of Broadcasting and Communications under the Canadian Constitution
최근 캐나다에서는 캐나다 연방 하원이 OTT를 통한 스트리밍 서비스의 컨텐츠를 규제하는 법안을 발의하였다. 그러나 OTT 서비스의 컨텐츠 규제의 취지가 아무리 좋다고 하더라도 그것이 언론의 자유를 침해하고 통제하는 수단으로 악용될 여지가 있다는 점에서 큰 우려를 낳고 있다. 선진국의 법제와 마찬가지로 캐나다도 언론의 자유를 강력하게 보호하고 있으므로 위와 같은 규제가 사회적 반향을 불러 일으키고 있는 것이다. 특히 언론의 자유는 캐나다 헌법 제1장 캐나다 국민의 권리와 자유의 장전 중 근본적인 권리에 관한 제2조 제b항에 명시적으로 규정되어 있다. 따라서 캐나다에서 방송ㆍ통신의 내용 규제가 어떻게 이루어지고 있는지를 파악하기 위하여 캐나다 방송ㆍ통신 심의기구의 내용 규제 현황을 살펴보고 나아가 실제로 어떠한 내용 규제적인 조치가 이루어졌는지 사례를 검토해 필요가 있다.
캐나다는 방송법과 통신법이 나누어져 있고, 방송과 통신의 규제는 라디오ㆍ텔레비전 통신위원회가 담당하고 있으며, 정부부처인 문화부가 방송 콘텐츠진흥과 방송 산업 지원정책을 담당하고 있고, 산업부가 방송기술 및 통신정책을 담당하고 있기 때문에 기능분리형으로 분류된다. 라디오ㆍ텔레비전 통신위원회는 방송의 공정성에 있어서 캐나다는 관점과 의견의 다양성을 보장하기 위한 정책 목표를 추구하고 있으며, 내용규제에 있어서는 자율규제 시스템을 기반으로 한 민관공동규제 제도를 운영하고 있다.
라디오ㆍ텔레비전 통신위원회 연간 보고서에 따르면, 모든 사전적인 정보를 공표, 법에 따른 청구의 접수 및 처리, 위원회 내에서 정보 공개 및 프라이버시에 대한 인식 촉진, 의회에 제출하는 연간 보고서, 연간 통계 보고서 작성 및 부처의 정보 출처 유지, 위원회의 준법 여부 모니터링 등 다양하고 실질적인 활동을 통하여 전반적인 방송 및 통신의 내용에 대한 일정한 가이드라인을 제시하고 있으며, 민간 자율기구인 방송심의위원회의 결정에 대한 항소심으로서의 역할도 수행하고 있다. 방송심의위원회는 민간자율규제기구이면서도 매우 활발하게 방송 및 통신 내용에 대한 개별적이고도 구체적인 부분에 대한 불만 사건으로 접수된 소청을 심사하여 각 패널별로 세부적인 방송 및 통신 규정을 바탕으로 구체적인 결정을 내리고 있다. 방송심의위원회는 2개의 전국 패널과 여러 개의 지역 패널을 두고 있다.
요컨대 캐나다의 방송ㆍ통신 컨텐츠의 내용규제는 민간 자율기구를 통해서 이루지는 것으로 시청자를 비롯한 다양한 OTT서비스 수요자의 요청에 따라 적절한 수준의 내용 민간 규제를 통해 캐나다 헌법이 보장하는 언론의 자유에 대한 존중을 하면서도 유효적절하게 방송ㆍ통신 컨텐츠의 내용에 대한 심의를 할 수 있다는 점에서 주목할 만 하다.
Recently, Canada's Federal House of Representatives proposed a bill to regulate the content of streaming services through OTT. Canada's freedom of speech is explicitly stipulated in Article 2(b) of Chapter 1 of the Canadian Constitution on the rights of the Canadian people and the fundamental rights of the bill of freedom. Therefore, no matter how good the purpose of OTT service content regulation is, it is necessary to get the implications we need by examining the current status of the Canadian Broadcasting and Communication Content Regulatory Organization and reviewing examples of what content regulatory measures have actually been taken. In Canada, the Broadcasting Act and the Communication Act are divided, the Radio and Television Communications Commission is in charge of regulating broadcasting content and the broadcasting industry, the Ministry of Culture is in charge of policies to promote broadcasting content and support the broadcasting industry, and the Ministry of Industry is in charge of broadcasting technology and communication policies, so it is classified as functional separation. The Radio and Television Communications Commission is pursuing policy goals to ensure diversity of perspectives and opinions in broadcasting fairness, and operates a public-private joint regulation system based on a self-regulatory system for content regulation. The Broadcasting Deliberation Committee has two national panels and several regional panels. According to the CRTC annual report, it presents certain guidelines for the overall content of broadcasting and communications through various and practical activities, including publicizing all prior information, receiving and processing claims under the law, promoting awareness of information disclosure and privacy within the committee, annual reports submitted to Congress, preparing annual statistical reports and maintaining information sources by ministries, and monitoring compliance by the committee. It also serves as an appeal trial for the decision of the Broadcasting Deliberation Committee, a private autonomous organization. Although the Broadcasting Deliberation Committee is a private self-regulatory organization, it actively examines appeals received in complaints about individual and specific aspects of broadcasting and communication content and makes specific decisions based on detailed broadcasting and communication regulations for each panel. In short, it is noteworthy that the content regulation of broadcasting and communication content in Canada is achieved through civil autonomous regulation organizations, and at the request of viewers and various OTT service consumers, it is possible to effectively deliberate on the content of broadcasting and communication content while respecting the freedom of speech guaranteed by the Canadian Constitution through private regulations at the appropriate level.
