관습국제인도법의 고찰 : ICRC의 연구보고서를 중심으로 = Review of Customary International Humanitarian Law - with special reference to the ICRC Study Report

제26차국제적십자 및 적신월회의(1995, Geneva)는 “ICRC는 다양한 지역과 상이한 법체계를 대표하는 국제인도법 분야의 전문가들의 원조 그리고 또한 각국정부 및 국제기구 출신 전문가들과의 협의하에, 국제적 및 비(非)국제적 무력충돌에 적용되는 국제인도법의 관습적 규칙들에 관한 보고서를 작성할 것, 그리고 동 보고서를 국가들과 권한있는 국제기구들에게 배부할 것.”을 요청하는 결의를 채택하게 되고 ICRC는 이를 수락하여 그 이후 10년간의 작업 끝에 드디어 2005년 〈관습국제인도법〉이라는 표제의 방대한 연구성과물을 간행, 세계적으로 배포하기에 이르렀다.
국제인도법의 법전화(法典化)에 있어서 눈부신 발전은 조약의 절적 · 양적 증가로 나타나고 있다 하더라도 그것이 우리들로 하여금 관습국제인도법을 무시하게 하는 원인이 되어서는 절대로 안 된다. 관습국제인도법이라고 하는 또 하나의 법체계는 지극히 중요한 것으로 남아 있어야 하는데 첫째로, 오늘날 제네바 제협약은 범세계적인 체약국망을 달성하고 있는데도, 추가의정서를 포함하는 여타의 주요조약들의 경우는 그렇지가 않다. 이들 조약들은 그것들을 비준한 국가간에만 적용되는 것이다. 반면에 때때로 “일반”국제법이라고 언급되는 관습국제법의 규칙들은 모든 국가들을 구속하는 것이므로 필요시에는 공식적 가입절차없이 모든 충돌당사자를 구속하는 것이다.
둘째로, 비국제적 무력충돌에 적용되는 국제인도법의 경우에는 아직도 그러한 충돌에서부터 발생하는 보호의 욕구를 충족시키지 못하는 취약성을 지니고 있는 실정이다. 그러한 조약들을 채택한 외교회의(外交會議)에서도 인정되었던바와 같이, 제네바 4개협약의 공통조항 제3조(비국제적 무력충돌)와 동 협약에 추가된 제Ⅱ의정서는 가장 기본적인 규칙들의 묶음을 제시하고 있을 뿐이다.
국가관행을 보면, 동일한 국가들이 외교회의에서 수락한 성문조약의 내용을 훨씬 넘어서고 있다. 대부분의 국가들은 적대행위에 관한 관습적 규칙들의 요체(要諦)가 국제적이든 비국제적이든 불문하고 “모든” 무력충돌에 적용된다는데 동의하고 있기 때문이다.
끝으로, 관습국제법은 조약법의 해석에 도움이 될 수가 있다. 조약은 성실하게(in good faith) 그리고 모든 관련있는 국제법규에 대한 고려를 가지고 해석하지 않으면 안 된다는 것은 확고한 원칙이기 때문이다.
이 논문에서는 관습국제인도법을 1) 국제적 무력충돌 2) 비국제적 무력충돌 3) 더 조사가 요구되는 부분 4) 적대행위와 관련된 이슈들 5) 무기 6) 이행으로 분류하여 제네바 제협약 및 추가의정서와의 공통점을 나타내는 부분과 상이한 점을 구분하여 소개하였다.
After the 26th International Conference of the Red Cross and Red Crescent(1995, Geneva), International Committee of the Red Cross (ICRC) accepted the mandate to prepare a report on customary rules of international humanitarian law applicable in international and non-international armed conflicts.
In 2005, after 10 years of hard work and extensive research, a huge report on customary international humanitarian law, has been published and world-widely circulated.
The reason why this study on customary international humanitarian law is necessary is that treaties apply only to those States which have ratified them. Their efficacy today prove to be limited. The ICRC's research is focused on the actual state practice. Two elements for customary international law to be found is state practice and opinio juris. By finding state practice, by collecting information regarding actual state practice, we can now arrange customary humanitarian law, which now makes applicable to all parties to a conflict, regardless of whether or not they have ratified the treaties containing the same or similar rules.
Many rules of customary international law show the extent to which state practice has gone beyond existing treaty law and expanded the rules applicable to non-international armed conflicts. Although great majority of the provisions of the 1949 Geneva Conventions, including common Article 3, are considered to be part of customary international law, issues like protection of cultural property and a number of specific conventions regulating the use of weapons are not the ones universally ratified. This report is focus on the latter.
Authors of this paper try to comprehend the subject-matter by underlining the importance of customary rules in the formation of treaties concerning laws of war as well as achieving wider compliance of international humanitarian law both in international and non-international armed conflicts, and by evaluating major points of the 161 Rules within the ICRC's report.
The Korean Red Cross Humanitarian Law Institute has been playing very important role in disseminating IHL in Korea for 30 years since 1976. The Institute makes teaching materials and booklets on the IHL for various target groups. Further, it organizes an annual seminar on IHL as well as training session for instructors.
However, the Korean Red Cross's pioneering role could be more inspired by replenishing dissemination of customary rules of humanitarian law. It is also desirable to reinforcing the education in this field among armed forces. The authors expect the Korean Red Cross Humanitarian Law Institute's 30th anniversary, which falls in this year(2006), can be a starting point for research and dissemination of customary IHL in Korea.
