2차 세계대전 이후 UN의 세계인권선언과 아동권리선언이 만들어지던 시기에 한국에서 어린이 인권 인식과 문화가 있었다. 1957년에 제정된 <대한민국 어린이헌장>은 분단과 한국전쟁의 폐허를 통과하고 있던 1950년대 한국의 어린이 인권 문화의 중요한 지점이 된다. 그것은 세계 인권사상의 영향과 일제시기 한국 어린이 인권운동 역사의 토양 위에서 1950년대 한국의 어린이 인권문화를 보여주었다.
대한민국 어린이헌장은 한국의 역사적 경험과 세계사적인 어린이 인권인식을 반영하고 있다. 본 논문에서는 그것을 3가지 키워드로 분석하였다. 첫째는 국민 어린이로서 권리이다. 국민으로서 어린이의 인격과 인권을 존중하는 것은 일제시기 어린이 인권에 대한 인식과 활동 경험과 연계되었다. 둘째는 생존과 보호의 권리이다. 어린이는 성인에 비해 신체적 사회적으로 약하기 때문에 인간으로서 생존과 보호를 위한 권리는 중요하다. 특히 굶주리고 아픈 어린이를 보호하는 것은 어린이의 생존 보호권리를 보장하는 가장 중요한 사항이다. 어린이헌장은 전쟁 이후 늘어난 고아나 부랑아 등 생존과 보호의 인권이 심각하게 취약한 어린이를 무조건적인 구호의 대상으로만 보지 않았다. 생존과 보호의 권리를 교화와 구호라는 양 측면으로 인식하고 있었다. 셋째는 발달의 권리이다. 발달의 권리는 일제시기 어린이 운동에서도 강조되었던 사안이다. 해방후 한국 정부는 의무교육 실시에 주력하면서 발달의 권리로서 교육받을 권리를 확장시키려 했다. 대한민국 어린이헌장은 교육이 어린이를 공부의 노예로 만드는 것을 비판하였다. 정서교육을강조하는 일제시기 동심 천사주의의 어린이 문화와 동화작가들의 인식이 반영된 것이었다.
그러나 대한민국 어린이헌장은 어린이를 국민 어린이로 표상하며 어린이는 국가의 보호를 받는 국민이기도 하지만 국가의 통제를 받는 국민이라는 양면성을 보인다. 민주주의가 미비한 시대 상황에서 동원과 통제의 문화와 결합하여 사회적 약자인 어린이인권의 현실 개선을 충분히 담아내지는 못했다. 어린이의 참여 권리는 전혀 고려되지 않았다. 대한민국 어린이헌장의 어린이 인권 담론은 세계사와 한국사의 어린이 인권인식을 반영하면서 반성적으로 성찰해야 과제를 안은 채, 분단과 냉전시대 1950년대 한국의 어린이 인권에 대한 국가적 사회적 지향을 표상하였다.
After World War II, when the UN’s Universal Declaration of Human Rights and the Rights of the Child were created, there was awareness and culture of children’s human rights in Korea. Established in 1957, <Children’s Charter of the Republic of Korea> becomes an important point in the children’s human rights culture in Korea in the 1950s, when it was passing through the ruins of division and the Korean War. It showed the children human rights culture of in Korea in the 1950s on the basis of the influence of world human rights thought and the history of the Korean children’s human rights movement from Japanese colonial era.
In this paper, it was analyzed with three keywords. The first is the right of children as a nation. It was to recognize and respect children as the subjects of the nation-state. Respect for children’s personality and human rights as a citizen was linked to awareness of children’s human rights and experience of activities during the Japanese colonial era.
The second is the right to survival and protection. As a human being, survival and protection are the most basic rights that human beings should enjoy in society, and especially in the case of children, it is more important because they are physically and socially weaker than adults. In particular, protecting hungry and sick children is the most important issue to guarantee children’s right to live and protect. In particular, in the reality that there are many children of disasters who need social protection, such as orphans and vagrants after experiencing the Korean War, these provisions were the most necessary children’s human rights in Korea at the time. However, the Children’s Charter showed an awareness of separating and treating orphans and vagrants as beings out of the ‘normal’ family as objects of management, supervision and control.
Third is the right to development. The right to development was already recognized as a basic provision of the children’s movement during the Japanese colonial era. After liberation, the Korean government focused on implementing compulsory education and attempted to expand the right to education. The Children’s Charter criticized children’s right to education as turning them into slaves to study. It reflected the children’s culture of childlike angelism during the Japanese colonial period, which emphasized emotional education, and the perceptions of children’s story writers.
The enactment of the Children’s Charter of the Republic of Korea spread speech and representation about rights of children in the 1950s, but combined with the culture of mobilization and control in a time when democracy was insufficient, it failed to capture fully the reality of improving the human rights of socially disadvantaged children. Although children were recognized as subjects of human rights protection, their right to participate in matters that affect their lives and to have their opinions respected was not considered at all. The children’s human rights discourse of the Children’s Charter of the Republic of Korea represents the national and social orientation toward children’s human rights in Korea in the 1950s during the division and Cold War era, with the task of reflecting on the recognition of children’s human rights in world history and Korean history.
