다세대주택과 다가구주택의 세제상 문제점과 개선방안에 대한 연구 ― 양도소득 과세상 문제를 중심으로 ― = A Study on the Tax Problems and Improvements of Multi-Household House and Multi-unit house ― Focusing on taxation issues with capital gains ―

최근 몇 년의 부동산 정책을 살펴보면 옥탑방을 중심으로 중과세율 적용 등으로 징벌적 규제를 실시하여 다가구주택 보유자들의 과도한 세 부담으로 사회적 혼란을 가져왔으며 특히 다가구주택의 저소득층의 세입자들의 불안은 더욱 크다고 할 수 있다. 이에 다세대주택과 다가구주택의 세법의 개념과 세법상 관련 규정 등을 검토함으로써 그 문제점을 알아보고 개선방안 등을 제안하고자 한다. 연구방법에 있어서는 질적 방법론인 문헌조사방법을 채택하였으며 연구발표서, 보고서 등을 참고하였다.
제1장 연구의 목적과 방법을 제시하고 제2장 다세대주택과 다가구주택 세법상의 규정과 세제 운영에 대해 살펴보고 제3장 외국의 주택 과세 제도에서 얻은 시사점을 바탕으로 제4장 다가구주택의 과세 제도에 대한 문제점과 개선방안을 제안하였다. 제5장 결론에서는 연구 내용의 요약하고 연구의 한계점과 앞으로의 연구 과제를 제시해 보았다.
첫째 건축법상 2³분의1로 규정은 옥탑에 물건을 적재할 수 있는 면적의 기준일 뿐이므로 별도의 주거용으로 판단하기 위해서는 최소한 최소한 2²분의 1이상으로 기준평수를 상향시키고 옥탑방 층에 대해서는 단일세율에 의한 분리과세 규정을 마련하는 것이다. 둘째 옥탑방 등의 원인으로 한 중과세를 바로 적용하는 것보다 과세 단계를 완화하여 1세대 2주택 개념을 차용하여 단계별로 과세하는 것이다. 이와는 별도로 다가구주택의 현실을 반영하여 장기보유특별공제 등 공제・감면 규정 등을 신설할 것을 제안하고자 한다. 셋째 다가구주택에서 저소득층의 세입자 임대보증금 보호와 전입신고 동시에 정액 보험에 가입할 수 있도록 임차인별 전입신고 확정일자 제도 및 공익보험 제도를 도입할 수 있도록 입법적으로 보완하는 것이다.
이러한 제안의 배경은 보통 1인 가구의 옥탑방의 임대료가 최저한의 임대료로서 저가이면서 대부분 독방으로써 저소득층에 안정적 주거지로 제공하고 있다는 긍정적인 측면과 옥탑방으로 인해 거액에 조세부담이 발생하여 저소득계층의 조세저항이 크기 때문에 이를 해소하는데 그 목적이 있다.
본 연구는 현행 세법이 다세대주택과 다가구주택의 현실을 반영하지 못하는 문제점이 있어 이를 개선하고자 하였으므로 앞으로 저 소득층의 주거안정의 기여도와 조세 부담의 완화도 등을 반영한 연구를 통해 신뢰받을 수 있는 조세 정책이 이루어지기를 바란다.
According to real estate policies in recent years, punitive regulations such as the application of heavy tax rates have been implemented around the rooftop room, causing social confusion due to excessive tax burdens on multi-family homeowners, and in particular, low-income tenants of Multi-unit houses are more anxious. By reviewing the concept of tax laws and related regulations under the tax laws of Multi-Household Houses and Multi-unit houses, we intend to find out the problems and propose improvement measures. As for the research method, the literature research method, which is a qualitative methodology, was adopted, and research presentations and reports were referenced.
The purpose and method of Chapter 1 study were presented, the regulations and tax operation of Chapter 2 Multi-Household housing and Multi-unit housing tax laws were examined, and based on the implications obtained from foreign housing taxation systems, Chapter 4 problems and improvement measures for the taxation system of Multi-unit housing were proposed. Chapter 5 summarizes the research contents and presents the limitations of the research and future research tasks.
The first is to legislatively supplement the introduction of the date of confirmed move-in system and a public interest insurance system for each tenant so that low-income families can purchase flat-rate insurance at the same time as protecting the tenant's rental deposit and reporting their move-in in Multi-unit houses. Second, since the 1/2³ regulation under the Building Act is only the standard of the area where goods can be loaded on the rooftop, the “standard floor space” should be raised to at least 1/2² and the “separate taxation based on a single tax rate” regulation should be established for rooftop floors to determine separate residential use. Third, rather than immediately applying heavy taxation due to reasons such as rooftop rooms, the taxation stage is relaxed, borrowing the concept of one-family two-house and taxing it step by step. Separately, it is proposed to establish new deductions and reductions, such as the “Special Credit for Long-term Ownership”, reflecting the reality of Multi-unit housing.
The background of this proposal is the positive aspect that the rent of a rooftop room of a single household is a low rent and is mostly solitary, providing a stable residence for low-income families, and the purpose is to resolve the tax resistance of low-income families due to the large tax burden caused by the rooftop room.
As the current tax law does not reflect the reality of Multi-Household housing and Multi-unit housing, this study attempted to improve it, so it is hoped that reliable tax policies will be implemented through studies that reflect the degree of housing stability and easing the tax burden for low-income families.
