다국어 초록 (Multilingual Abstract)

The Seoul Bankruptcy Court (hereinafter SBCourt), founded on March 1st, 2017 as the first specialized insolvency court in Korea, hosted 2017 Judicial Conference on Insolvency, Seoul Bankruptcy Court from September 14th to 15th, 2017, to commemorate its establishment, to enhance the court’s judicial expertise and to make extraordinary advancements in insolvency law.
32 pre-eminent legal experts including judges from the U.S., U.K., Netherlands, Australia, Japan, China, Korea, the principal legal officer of the UNCITRAL and a U.S. chapter 13 standing trustee took part in this conference as moderators and panels.
In the pre-Conference, we dealt with recent trend of U.S. insolvency system, especially focusing on corporation insolvency proceedings (Seminar 1) and individual rehabilitation proceedings (Seminar 2). In the main-Conference, a wide variety of topics, including cross-border insolvency system (Session 1), individual insolvency system (Session 2) and corporation insolvency system (Session 3, 4, 5) were discussed among the participants from the above-mentioned countries and the UNCITRAL.
SBCourt made questionnaire and collected distinguished opinions of the top legal experts on them, through which we were able to assemble the advanced data ensuring quality discussions and select the main topics of the Judicial Conference.
This article is the outcome of the Judicial Conference and also the compilation of our efforts on it.
This Judicial Conference can be deemed one of good examples of successful international cooperation to promote the relationship among diverse jurisdictions as well as to enhance the efficiency of the cross-border insolvency area. Also, while preparing the conference, SBCourt came to realize that it strengthened the capabilities of legal experts on insolvency including judges and lawyers, which ultimately has raised up Korean Insolvency system to the next level.
