사회불평등의 구조 평등의 이념과 규범 = Structure of Social Inequality, Idea and Norm of Equality

다국어 초록 (Multilingual Abstract)

Social inequality has been globally aggravated especially since 1990s. In accordance the expectation to the constitutional norm concerning equality and anti-discrimination increased. This article aims to analyse the possibility and limitation of the constitutional norm to contribute to overcome or reduce social inequality of this time in our society. The problem is twofold. First, the idea of social equality conflicts with that of freedom. That means that the social equality orients itself to the universal dimension, whereas its implementation is more or less selective. Second, State action of implementation should be coordinated with the freedom of others in relevant legal relations as well as financial affordability, and policy choice and preference should be justified in relation with other policies. Yet social equality is an unevitable target of the constitution to work as an universal norm. Without guarantee of social participation the individuals would be isolated to the peripheral, and the communities would lose or reduce the openness and dynamics. The minimum standard of equality of opportunity constitutes the base of further fulfillment of freedom. In case that the relation between majority and minority stays fossilized the democracy itself cannot work. The decision of the majority could not be accepted as ‘our (as time goes changeable) decision’. In this article it is diagnosed that the di-polar devision of capital and labor has developed into the muti-polar stages. The instruments of equality policies have been widened to the social security law and labor law, which leads to the complex structure of quality policies. Accordingly the idea of equality was differentiated into the various dimensions; equality before the law and factual equality, equality of opportunity and equality of outcome etc. In addition the latent tension between freedom and equality has become a actual agenda nowadays. This article aims to analyse these various dimension of the equality policies to understand and enhance the normative effects of equality.
