일본 배우자공제 제도에 관한 고찰 - 일하는 여성의 중립적 세제 및 이전형기초공제의 도입을 중심으로- = A Study on Spouse Deduction System in Japan - With focus on the neutral tax system for working women and transferable allowances -

Lately, the National Tax Agency in Japan has changed the application condition of deduction for spouse, and expanded its object range through the revision of tax system on deduction for spouse.
This recent revision of tax system has aimed at construction of the neutral individual income system for the choice of working methods. Contrary to general expectations, the 2016 tax revision contents ended within narrow limits, but for the medium and long term, Japan is continuing discussions for abolishing deduction for spouse, and introducing transferable allowances instead.
The examination of the deduction for spouse system like this has its significance in that such an examination process has become a starting point of construction of the individual income tax system suited for social changes such as the decrease in population, change in family form, diversification of working methods, and widening of income disparity, etc.
This paper used the recent discussions about the deduction for spouse system in Japan as a tool for getting a woman as a spouse, and a working woman to be established in the income tax system of Korea, and deducted implications as follows: First, the deduction for spouse, and special deduction for spouse in Japan have been established as a system assessing a housewife’s credit in her assistance to a taxpayer’s income earning by tax law. On the contrary, the Korean income tax system allows deduction for spouse, but the amount deductible is small; moreover, there are no considerations about getting a woman and a female spouse to be established, or assessment of a working housewife’s credit in assistance to a taxpayer by the income tax system, and in that sense, the income tax system in Korea forms a contrast with that in Japan.
Second, the deduction for spouse system in Japan has great implication to Korea in that the deduction for spouse system has examined over the general income tax system to construct a new tax system by reflecting the fact that the number of two-income households overtook the number of housewife households unlike the time when this system was created, and social changes over working methods and a family form. In comparison with this, in case of Korea, the role by the tax system for working women is mostly on a restricted range like tax benefits for social participation of a career-interrupted woman after childbirth, etc.
Third, the 5 sorts of plans proposed by the Japanese government committee of inquiry into tax system are showing the future direction of the income tax system for neutral tax system construction for a double-income family, together with dual deductions, and high tax benefits for a high-income earner. Particularly, it is worthwhile to refer to the point that all the five sorts of plans include the contents to the effect that the tax revenue secured by the revision of deduction for spouse should be appropriated for child-care support.
On the basis of consideration about the Japanese deduction for spouse system like this, this writer proposed introduction of transferable allowances, but preferably introduction of the tax deduction method like that of Canada pertaining to personal deduction. It’s because people’s tax burden might be small as there was a case of the conversion of special income deduction to tax deduction by the income tax law in 2014. This writer judged that conversion of persona deduction to tax deduction might be an effective means in that such a measure serves to relatively increase the tax burden of a high income earner whose marginal tax rate is high while expanding the taxation bases, and at the same time, such a measure could be linked to the strengthening of the income redistribution function by making the lightening effect of the tax burden larger for a low income bracket whose marginal tax rate is low.
일본에서는 최근에 배우자공제에 관한 세제개정을 통해서 배우자공제의 적용조건을 변경하고 대상범위를 확대시켰다. 이번 세제개정은 일하는 방식에 대한 중립적 세제를 구축하는 것을 통해 안심하고 결혼해서 아이를 낳고 기르는 젊은 세대를 지원하기 위한 것을 목표로 했다. 기대했던 것과 달리 2016년 개정은 소폭에 그쳤지만 앞으로 단계적으로 배우자공제를 폐지하고 이전형기초공제를 도입하고자 검토 중이다. 이번 배우자공제제도에 관한 검토는 인구감소, 가족형태의 변화, 일하는 방식의 다양화, 소득격차의 확대 등 사회적 변화를 반영해서 소득세제를 구축하는 출발점이 되었다는 점에서 그 의의를 찾을 수 있다.
본 논문에서는 우리나라 소득세제에서 배우자로서 여성과 일하는 여성에 대한 자리매김을 위해서 일본의 배우자공제제도에 관한 최근 논의를 비교법적 검토수단으로 가져왔고 다음과 같은 시사점을 얻었다. 첫째 일본의 배우자공제 및 배우자특별공제는 납세자가 소득을 벌어들임에 있어서 전업주부의 내조의 공을 세법상 평가한 제도로서 역할을 해 왔으나, 최근에는 맞벌이가구가 증가함에 따라 중립적 세제를 위해서 전업주부의 귀속소득을 고려한 재검토작업의 대상이 되고 있다. 반면에 우리나라는 배우자공제를 허용함에도 그 공제금액도 작아서인지 아니면 논의의 실익이 없어서인지 세제상 여성 및 배우자에 대한 자리매김이 그동안 없었다는 점에서 대비된다.
둘째, 일본에서는 배우자공제제도가 신설 당시와 달리 맞벌이가구가 전업주부가구를 대신하여 주류가 되면서 일하는 방식과 가족형태를 둘러싼 사회변화를 반영한 세제를 구축하기 위해서 소득세제 전반에 관한 검토로 이어지고 있다는 점은 시사해 주는 바가 크다. 이에 비하여 우리나라는 일하는 여성에 대한 세제상 인식은 출산 후 경력단절여성의 사회참여에 대한 세제상 지원 등 조세특례에 해당하는 것으로 적용범위가 제한적이다.
본 논문에서는 일본에서 배우자공제를 둘러싼 쟁점들을 검토한 결과를 가지고 우리나라 인적공제・배우자공제 관하여 검토를 했다. 그 결과 인적공제를 폐지하고 이전형기초공제의 도입을 제안했다. 네덜란드와 캐나다의 입법례, 일본의 정부세제조사회에서 제안한 5가지 선택방안 등이 구체적 방안이 될 수 있다. 인적공제를 세액공제로 전환하는 것은 과세기반을 확대하면서 한계세율이 높은 고소득자의 부담을 상대적으로 늘리는 한편 한계세율이 낮은 저소득층에게 세금부담 경감효과를 크게 함으로써 소득재분배기능의 강화로 이어질 수 있다는 점에서 유효한 수단이 되리라 기대한다.
