자치분권재설계와 지방의회 역량 강화방안 = Re-design of Autonomous Decentralization and Strengthening the Capacity of Local Councils

국문 초록 (Abstract)

국민주권정부의 태동은 국정운영의 근본적인 틀을 전환할 필요성이 있다. 기존의 국가중심의 국정운영이나 대통령중심, 그리고 국회정당중심의 국정운영은 주권재민의 국정운영을 위해서는 재설계되어야 한다. 국정구조의 재설계를 위해서는 먼저 헌법개정이 이루어져야 하고, 지역대표형상원, 국민발안, 읍면동 직접자치 등의 의회중심의 국정운영철학이 반영된 제도재설계가 필요하다. 자치분권재설계에는 의회중심의 국정운영철학이 도입되어야 하는데, 총회제 의회, 고유권설에 입각한 지방정부형성, 중앙-지방정부의 대등한 역할분담, 정당공천권폐지, 근린계층에 자치공동체형성 등이 도입되어야 한다. 또 지방자치도 단체장중심에서 의회중심자치로 전환되어야 하고, 지방의회법제정과 지방정부 기관구성다양화, 지방재정자립도 상향, 지방의원역량강화를 위한 연수시설 혹은 지방의회전담연구원의 설치도 필요하다. 여기서 제기되는 논의가 지방의회법 제정시에 분법형식이 아니라, 실질적인 지방의회 중심의 지방자치시스템이 설계될 수 있는 토대가 되길 기대한다.

다국어 초록 (Multilingual Abstract)

The birth of a national sovereign government needs to change the fundamental framework of state administration. Existing state-centered administration, presidential-centered, and parliamentary party-centered state administration should be redesigned for sovereign residents. To redesign the state structure, the constitution must be revised first, and an institutional redesign that reflects the philosophy of state administration centered on parliament, such as regional representative members, people’s initiative, and direct autonomy in Eup, Myeon, Dong, is necessary. The reorganization of autonomy should introduce a parliamentary-centered philosophy of state administration, such as a general assembly, formation of local governments based on the theory of proprietary rights, equal division of roles between central and local governments, abolition of political party nomination rights, and formation of a community autonomous community in the neighborhood. Local autonomy should also be converted from the head of the organization to parliament-centered autonomy, and it is necessary to enact local council laws, diversify the composition of local government institutions, increase local financial independence, and establish training facilities or local council research institutes to strengthen local council capabilities.
