파두아의 마르실리우스는 아직 가톨릭 교황과 주요국 황제 또는 국왕들 사이의권력 다툼이 치열하던 중세 후반에 후자의 세속권력이 전자의 교회권력을 지배해야한다고 주장함으로써 정치사상적으로 근대적 성향을 드러내었다. 그는 교황, 황제, 신민이라는 정치 주체들의 권한이 교황으로 수렴되어야 한다는 교황지상주의를배격하면서, 교황이 독점하는 권력과 권위를 황제에게 이관해야 한다고 주장하였다.
당시는 황제가 교황에 맞서서 독자적 통치권을 행사하려는 도전을 점차 강화하고, 이를 방어하려는 교황의 서슬도 아직 시퍼런 때였다. 따라서 교황과 황제 양측을모두 의식하지 않으면 안 되던 미묘한 당시 상황에서 마르실리우스가 황권 우위론을들고 나온 것은 분명히 진보적이고 용기 있는 처신이었다.
마르실리우스는 이처럼 교권 우위를 속권 우위로 전환해야 한다고 강조하기 때문에 정치사상 면에서 황권 또는 왕권 절대주의자라는 평가를 받기도 하지만, 그는1324년 파리대학에서 저술했다는 대표작 평화의 수호자(Defensor Pacis, DP)를통하여 황제 주권주의를 넘어 국민주권주의를 지향하였다. 요컨대 그는 교황뿐 아니라 황제를 포함하는 칼의 양날에 맞서서 국민 주권론을 폈던 것이다.
평화의 수호자는 세 강의(Dictatio, Discourse)로 되어 있는데, 제I강은 아리스토텔레스의 원리에 따라 국가의 기원, 명분, 구성, 통치 수단, 국가와 통치부분의 관계등을 다룬다. 그에 따르면, 정부는 평화를 유지하는 국가의 한 부분이며, 국가의평화를 유지하는 데 필요한 권위를 사적으로 악용하지 않도록 법률의 통제를 받아야하고, 법은 국민 전체에 의하여 제정되어야 한다. 제II강은 성직자의 세속적 정치권력, 성직자와 종교조직, 교황의 전권, 반론 등으로 구성되어 있는데, 교황과 교회를직접 자극한 부분이다. 주요 내용을 보면, 사제는 스스로 강제적 권위를 가지지않으며, 세속적 법률과 정부의 권위에 예속되어야 한다는 것이다. 교황의 절대권요구가 제I강의 평화를 파괴하고, 권위의 단일성을 파괴함으로써 사회의 투쟁을초래한다. 세속 통치자들은 국민의 선출뿐 아니라, 신이 내려준 권리에 의해서 통치하는 것이므로 신법이 허용하는 범위 안에서 전권을 가진다. 성사 집행과 구원의길 안내를 본업으로 하는 사제는 강제적 권위까지 수반하지 못한다. 영적 영역도세속적 영역에 포함되므로, 파문과 사제 보직 선임과 같은 비본질적인 권위와 관련된 문제들은 신도전체의 통제를 받아야 한다. 당시 신도전체는 세속적 입법권자인국민전체와 같은 것이므로, 세속업무와 종교적 업무에 대한 제도적 관리도 동일한기구(국민전체)에게 주어진다는 것이다. 제III강은 앞의 두 강의 내용들을 개관한것이다. 평화의 수호자의 저자가 알려지자 마르실리우스는 장당의 장(Jean de Jandun)과 함께 독일 바이에른 황제 루드비히(Ludwig von Bayern)에게 피신하여사망(1342/3) 때가지 서로 협력관계를 유지하였다.
마르실리우스는 교황과 황제라는 양대 세력을 의식하여 평화의 수호자제I강과 제II강에서 국민이 속세와 교회 모두에 우월하다는 국민 주권론을 조심스럽게피력하였다. 그러나 그의 국민 주권론은 국민 또는 시민 개개인의 자유와 인권을보장하는 근대적 의미의 개인기본권까지 나아가지 못하고 아직 집단주의적 티를벗지 못한 한계를 지녔다.
Marsilius of Padua revealed a modern disposition in political thought by advocating the dominance of the secular power over the ecclesiastical authority late in the Middle Ages when struggles for hegemony between the Catholic Pope and the emperors or princes of major European powers were still going on fiercely. He insisted on it that the power and authority monopolized by the Pope should be transferred to emperors, denying the ultramontanism that all the powers of the Pope, emperors and subjects have to converge on the hands of the Pope. That was a time when the blade of the ecclesiastical authority by the Pope was still sharp, while emperors had been escalating their challenge to secure their independent rule against the Pope. If one considers the then delicate situation in which one had no choice but to concern oneself about both the Pope and emperors, it must have been progressive and courageous of him to have come up with the superiority of the power of emperors.
Marsilius had been sometimes judged to be an imperialistic or monarchistic absolutist in terms of political thought, since he emphasized that precedence of the ecclesiastical power ought to be converted to that of the secular. Furthermore, he went so far as to orient not only toward the imperial sovereignty, but toward the popular through Defensor Pacis, one of his major works, which he wrote at University of Paris in 1324. In other words, he developed the popular sovereignty against the twin blades of the Pope and of emperors.
Defensor Pacis consists of three discourses. In accordance with the Aristotelian principles, Discourse one deals with the origin, cause and parts of the state; toolsof sovereignty; and the relations between the state and its parts. He states that the government constitutes a part of the state which keeps peace, and has to be controlled by laws lest the authority necessary to keep peace should be misused for personal purposes. Laws must be legislated by the people as a whole. Discourse two, which gave a direct shock to the Pope and the church, involves the secular political power of the clergy, clergymen and religious institutes, plenary power of the Pope, and refutation. Marsilius describes in this part of the discourse: clergymen have themselves no compelling power and should be subjected to secular laws and governments; Pope’s claim to absolute power triggers social conflicts by destroying the peace of Discourse one and breaking the unity of authority; secular rulers hold plenary power as far as the divine law permits, since they rule based on the election by the people and on the power bestowed by the God; priests, whose main missions are to hold sacraments and to direct people to salvation, cannot be blessed with any coercive authority. As the spiritual domain is also included in the secular one, issues related to extrinsic authority such as excommunication and investiture of the clergy have to be controlled by the faithful. As the latter were identical to the people as a whole, secular legislators, at that time, the institutional management of secular and religious affairs also belongs to the same institution, the people as a whole.
Discourse three reviews the contents of the preceeding two discourses. When who wrote Defensor Pacis came to be known, the two authors of the book escaped to Bayern of Germany to be protected by Emperor Ludwig, where Marsilius and Ludwig had cooperated each other until the former’s death.
Minding the twin powers of the Pope and emperors, Marsilius brought to light very carefully the popular sovereignty, which means the priority of the people over the temporal and ecclesiastical powers, in the first and second Discourses.
His sovereignty of the people did not, however, cross the line of collectivism by failing in having a hand in the individual basic rights in a modern sense which guarantee the freedom and human rights of each person.
