시민민주주의와 보편적 법체계의 발전: 헌법과 국제법을 대체하는 세계법의 수사학 = Democracy and Evolution of Global Law: New Discourse and Rhetoric on the Constitutionalism and International Law

국문 초록 (Abstract)

헌법은 국가의 최고법이고 국제법은 국가간 권리와 의무관계를 다루는 법학분야이다. 국제사회의 본질은 분권화된 사회이고 주권평등의 원칙에 따라 법질서가 형성되어있다. 그러나 국제사회와 국제법을 보편주의적·이상주의적 관점에서 접근하는 시각이없지 않다. 환언하면 실증주의적·의사주의적 국제법관이 국제사회와 국제법의 현실이라면 보편주의적·이상주의적 국제법관은 국제사회와 국제법의 지향점이라 할 수 있다. 국제사회와 국제법을 바라보는 이러한 두가지 관점은 복잡하게 얽혀 있는 것이 사실이다.
공법의 두 축이라 할 수 있는 헌법과 국제법은 근대 절대국가, 근대 시민국가의 형성과 밀접하게 관련되어 있다. 국가권력의 절대성과 시민민주주의는 우리의 현재이자우리의 미래이기도 하다. 이는 정치적 근본질서이기도 하지만 근현대법 발전의 토양이되어 왔다. 그리고 정치와 법이라는 두차원의 질서는 상호 변증법적으로 발전해 가고있다. 이러한 배경 하에 본고는 헌법과 국제법 담론의 여러 인접개념들에 관하여 그본질과 공통점 및 차이점을 검토 분석함으로써, 국제사회와 국내사회를 관통하는 공법학의 현실을 큰 틀에서 조화적으로 조망할 수 있게 하는 것을 연구목적으로 한다.
본고는 먼저 헌법과 국제법을 관통하는 기존의 경성적 법체계의 역사적 발전과 그현실적 얼개를 구성 제시하는 것에서 논의를 시작한다. 나아가 국제법의 연성화와 국제법과 세계법, 세계헌법주의와 세계헌법론, 세계행정법 강론 등에 관하여 살펴 본다.
나아가 이러한 논의들의 발전 배경과, 논의들의 주요 주제, 그리고 그 공통점과 차이점에 관하여 살펴본다. 그리고 국제사회의 변화로 인한 새로운 강론들의 미래에 관하여 간략히 진단해 본다.

다국어 초록 (Multilingual Abstract)

The Constitution is the highest law of the country, while international law is a field of law that deals with the rights and obligations between countries. The essence of international community is of decentralized nature, in which the legal order is formed according to the principle of sovereign equality. However, there are many perspectives that approach the international community and international law from a universalistic and idealistic viewpoint. In other words, if the positivist and pseudo-oriented view of international law is the reality of international community and international law, the universalist or idealist perception of international law can be said to be their goals. It is true that those two perspectives on international community and international law are neither omnicient nor all-perceiving, but complexly intertwined.
The Constitution and international law, which can be considered the two axes of public law, are closely interrelated to the formation of a modern absolute state and civic democracy. The absoluteness of state power and civic democracy are doomed to fate our present and our future. This is not only such fundamental political order, but it also has become a foundation for the development of modern and contemporary order of law. And the two dimensions of order, politics and law, are developing in a dialectical manner.
Under this background, this paper aims to provide a harmonious view sprucing up the reality of public law that penetrates both of the international and domestic society within a large framework. It is for research purpose and needs an effort of work by reviewing and analyzing the essence, commonalities, and differences among various adjacent concepts of the Constitution and international law discourse.
This paper first begins with a discussion by presenting the historical development of existing hard legal system that penetrates the Constitution and international law through their realistic framework. Furthermore, we look at the softness of international law, conceptual discourse on the international law and world law, international constitutionalism and constitutional theory, and a compendium of world administrative law. We look at the background for the development of these commentaries, the main topics of discussion, and their commonalities or differences. Finally we briefly diagnose and place the future of new sermons that needs to be adduced due to changes in the international community.
