미국의 증거배제신청에 관한 연구: 형사소송에서 Motion in Limine와 Motion to Suppress를 중심으로 = The Exclusion of Evidence in the United States: Motion in Limine and Motion to Suppress in Criminal Cases

배심제도를 바탕으로 하는 미국형사절차에서는 증거개시절차(discovery)를 통해 교환한 증거자료 가운데 관련성이 없는 증거, 배심원에게 현출될 경우에 예단이나 편견을 발생하게 할 우려가 있는 증거 및 위법하게 수집된 증거 등이 법정에서 증거로서 사용되는 것을 방지하기 위해 본안 공판이 개시되기 전 법원에 증거의 허용성(admissibility)에 대한 판단을 구하는 신청을 제기할 수 있다. 신청에 따라 법원은 증거의 허용성을 따져 채택 또는 배제의 결정을 내린다. 이처럼 미국은 공판 전 단계에서 증거배제신청을 제기하도록 함으로써 증거의 허용성에 대한 판단을 내리는 심리절차와 본안 판단을 분리하고 본안 판단에서 증거의 허용성에 대한 공방이 이루어지는 것을 최소화한다.
법원에 증거배제의 결정을 구하는 대표적인 절차적 방법으로는 두 가지 신청을 들 수 있다. 민사사건 또는 형사사건에 관계없이 적용되는 유해증거배제신청(motion in limine)과 형사사건에만 적용되는 위법수집증거배제신청(motion to suppress)이다.
유해증거배제신청은 대체로 사실판단자의 예단이나 편견을 불러일으킬 수 있는 증거가 법정에서 예상치 않게 현출되는 것을 막기 위해 법관에게 미리 유해한 증거를 배제해 줄 것을 요청하는 신청이다. 유해증거배제신청은 재판 전 단계에서 제기될 것이 촉구되지만, 필요하다면 재판 중에도 제기할 수 있다. 유해증거배제신청에 대한 법원의 결정은 대체로 언제든지 다시 심리할 수 있는 잠정적인 결정으로 중간불복(interlocutory appeal)의 대상이 되지 못한다. 따라서 신청자는 법원에 의해 자신에게 불리하게 증거가 허용되는 잠정적인 결정이 내려졌다면, 추후 본안 판단 후 항소심에 대비하여 법정에서 해당 증거가 현출된 즉시 다시 이의제기(objection)를 하고 이를 소송기록에 남기기 위해 입증제의(offer of proof)를 하여야 한다.
한편, 위법수집증거배제신청은 피고인이 수사기관의 위법행위를 통해 취득한 증거의 배제를 구하는 요청을 의미한다. 위법수집증거배제신청은 연방대법원의 판례에 의해 정립된 위법수집증거배제법칙(exclusionary rule)을 근거로 형사소송규칙에 공판 전 신청(pretrial motion)의 하나로 법제화되어 있다. 위법수집증거배제신청은 공판 전에 제기하는 것이 원칙이지만, 실기한 신청인 경우라 할지라도 정당한 이유를 소명하면 이를 받아들여 심리를 진행할 수 있다. 연방지방법원 판사는 연방치안판사(magistrate judge)에게 해당 절차를 수행하여 의견을 제출하도록 할 수 있다. 이때 연방치안판사의 의견은 권고사항일 뿐이며 위법수집증거배제신청에 대한 결정은 반드시 연방지방법원 판사가 내려야 한다. 위법수집증거배제신청에 대한 종국적 결정은 이를 연기할 만한 정당한 이유가 소명되지 않는 한 공판 전에 내려진다. 연방 사건의 경우, 1심에서 피고인이 무죄를 선고받게 되면 검사의 불복할 권리를 인정하지 않고 있으므로 피고인의 위법수집증거배제신청에 대한 인용결정에 대하여 검사는 중간불복을 할 수 있다. 반면에 피고인은 추후 유죄판결이 내려지면 종국적 판결에 대한 심사를 항소심에서 구할 수 있다는 가정하에 중간불복을 할 수 없다.
이 연구는 절차적인 측면을 중점적으로 미국의 유해증거배제신청과 위법수집증거배제신청을 개괄적으로 소개·분석하는데 중점을 둔다. 또한 미국의 증거배제신청제도를 토대로 우리나라의 증거채택 단계에서 보다 충실한 심리를 진행하고, 적법하게 수집된 증거로서 공소사실과 관련성이 있고 예단이나 편견을 발생시키지 않는 증거를 집중적으로 조사하여 재판의 공정성 및 형사사법의 염결성을 더욱 향상시키는 데 참고할 만한 시사점을 도출하고자 하였다.
In United States criminal proceedings, the prosecution and the defendant frequently employ motions to ask the court to determine the admissibility of certain evidence which is deemed irrelevant, prejudicial or was illegally obtained before a trial begins. Upon the motion, the court makes an evidentiary ruling admitting or excluding the evidence. Such motions to exclude evidence before trial enable the court to minimize unnecessary trial interruptions by holding separate evidentiary hearings.
There are two types of motions that are most often used to exclude evidence. One is a motion in limine that is appropriate in both civil and criminal proceedings, the other is a motion to suppress that is available only in criminal cases, not civil cases. A motion in limine is a request that the court rule on the admissibility of evidence in advance so as to bar presentation of prejudicial evidence which may cause the jury to make irrational or emotional decisions.
A motion in limine should preferably be raised prior to a trial, but can be brought up at any time during trial. As for an interlocutory appeal of a trial court’s ruling on a motion in limine, since this ruling is preliminary in nature and subject to change during the trial, it is not appealable. Thus, where the court grants or denies a motion in limine to exclude evidence and indicates willingness to reconsider its ruling, the mover must renew its objection if the evidence is offered during trial and make an offer of proof to preserve the issue for appeal.
Meanwhile, a motion to suppress is a request that the judge exclude illegally obtained evidence from consideration by the judge or jury at trial. A motion to suppress stems from the exclusionary rule that forbids the use of evidence obtained in violation of a defendant’s constitutional rights against him or her. A motion to suppress shall be made before trial, otherwise the motion is considered untimely and may not be considered unless good cause is shown. Before ruling on the motion, the court retains discretion to hold an evidentiary hearing. If the court chooses to hold a hearing, a trial judge may designate a magistrate judge to hear a motion to suppress and thereafter submit recommendations for disposition of the motion, including any proposed findings of fact. The court, however, is not bound by the findings and recommendations of the magistrate judge. The court must decide a motion to suppress before trial unless it finds good cause to defer a ruling. On the federal level, the prosecutor may take an interlocutory appeal from the pretrial granting of a motion to suppress because it cannot appeal a judge’s decision or jury’s verdict of acquittal due to the double jeopardy principle, whereas the defendant with a right to appeal his or her conviction cannot appeal the denial of a motion to suppress before the final judgment.
This research focuses on motions in limine and motions to suppress with particular emphasis on their procedural aspects. Hopefully, this research can contribute to the advancement of sound practices for the Korean judiciary in the course of trial, especially at the evidentiary stage.
