국제인권규양상 교육의 권리와 국가의 의무 = Rights to Education and Duties of The State -An Overview of Intermational Human Rights Documents-

The United Nations Universal Declaration of Human Rights of 1948 declares that “every one has a right to education” (Article 26), and The World Declaration on Education for All further elaborates that “every person -child, youth adult- shall be able to benefit from educational opportunities designed to meet their basic leaming needs. (Article 1) While these declarations illuminate the brighter side of the right to education, the duty of state to provide with education meeting one`s basic needs has been an agonizing issue, featuring its darker side, The question of what are the essential elements of the right to education necessarily comes to the nature and extent of the State`s duty to recognize and fulfill such right. This paper is an overview of present address of the right to education as debated under the regime of international human rights law. It is heavily relied on the Background Paper prepared by the Advising Conmmittee of Jurists of The Asia Pacific Forum of Human Rights Institutions, and presented to its 11th Annual conference held between July 31 and August 3, 2006 at Suva, Fiji Islands. Throughout the entire paper, author`s own emphasis has been put in the state-sponsored education, which extends well beyond the minimum level. Duty of the state to respect, protect, and fulfil one`s right to education mandates a concerted actions of the entire member of the community.
