While the death penalty is indeed one of the oldest punishment in most national legal systems, it has not been too long to discuss it from the perspectives of international law. The discussion over abolition of death penalty existed intermittently even before the Age of Enlightment, but a move toward the abolition was raged particularly after the World War II along with the emergence of international human rights law. Since the European countries such as Germany, Austria and Italy abolished the death penalty as part of transitional justice, the international community, as a whole, is moving from restriction to absolute abolition of death penalty. According to the last year`s annual report on death penalty by the International Amnesty, 140 countries have abolished the death penalty de jure or de facto as of December 31, 2012. There were only 20 abolitionist countries back in the 1960s, however with an effort by the Commission on Human Rights through resolutions on abolition of death penalty in the mid-1990s, a swift increase in the number of abolitionist countries was reported. Korea was designated as de-facto abolitionist country since there has been no actual execution since 1997, yet Korea is constantly and continuously recommended by the peer-review system known as Universal Periodic Review in Human Rights Council to join the global abolition movement. However, in 2010 Korean Constitutional Court again declared the Korean legislation which stipulates the death penalty as one of the criminal punishment as constitutional. The road to abolition de jure seems to be quite rough at this point. At the level of the UN General Assembly, the resolution on death penalty moratorium was finally passed for the first time in 2007 after unsuccessfully attempting to adopt the resolution on death penalty in 1970s and 1990s. While the GA resolution itself might not be legally binding, if the resolution is passed by consensus and the content is universe, then such resolution will contribute to the emergence of a new international customary law. Considering a number of multilateral and regional human rights treaties, it is not viable to retrogress the abolition of death penalty. If the human rights are to be truly globalized, an enhanced and close cooperation among the states is required more urgently than ever. No state should be ``an exception`` in the path toward the abolition.
